Abstract

Penelitian ini bertujuan untuk menggambarkan konsep hak ijbar dalam fiqh, dan menyelidiki relevansinya dengan isu-isu gender saat ini. Penelitian ini dimulai dengan menjelaskan wali dan kepercayaan, makna hak ijbar, opini ulama ‘tentang hak ijbar, dan relevansi hakijbar terhadap isu-isu gender. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan deskriptifkualitatif,karena penelitian ini dimaksudkan untuk mengungkapkan dan menjelaskan hak ijbar di fiqh dilihatdari perspektif gender. Dengan menggunakan metodepenelitian yang diuraikan di atas, dapat disimpulkan bahwa hak ijbar tidak berlaku untuk gadis-gadis yangmatang dan kompeten tentang hukum. Ini berarti hakuntuk memilih calon pendamping hidup adalah milikanak. Peran wali adalah sebagai pertimbangan pemberidan masukan saja. Perubahan sosial yang sangat signifikanmembuat wanita lebih mudah untuk berinteraksi denganlaki-laki, dan memungkinkan mereka untuk mengetahui sifat dan karakter mereka.kata kunci: fiqh, hak ijbar, wali

Abstract

Abstract

The trademark plays an important role in economic life, as it is a way for the merchant to distinguish his products from those produced by others. It also helps consumers to identify the products they want. Therefore, the countries of the world have agreed to conduct agreements to protect it, on top of which is the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). When the State of Indonesia agreed to sign this agreement, it had to provide legal cover in the field of the trademark. The research aims to demonstrate trademark protection in Indonesian law and Islamic jurisprudence. This research falls within the library search, and its description is an analytical and critical description. After careful consideration, the research concludes that Indonesian law and Islamic jurisprudence are in agreement of considering the trademark as property and right. So, they agree on the necessity of trademark protection and imposing the punishment for the aggressor. Meanwhile, they differ in the imprisonment; the law considers it as a basic punishment while Islamic jurisprudence considers it as a secondary punishment

Abstract

This study sought to examine and evaluate the elements that affect customer loyalty in Islamic commercial Banks, using a quantitative associative method and intervened by customer satisfaction variable. The distribution of survey questions was utilized to collect data. SEM PLS ver.3 Software is used to process and analyze the data. According to the findings, customer loyalty was influenced by brand equity and customer satisfaction. However, customer loyalty was not influencing customers among ICBs. Theoretically, this study implies that banking awards and client pride make it easier for consumers and potential customers to learn about the quality of ICBs’ products and services and trust them. It indicates that the public believes the services offered by ICBs to be of average quality, falling short of excellence. Therefore, ICBs must increase banking awards and client pride to make it easier for clients and prospective consumers to recognize and trust the quality and services.

Abstract

Islam is a comprehensive religion. The comprehension of Islam does not lie in the completeness of the content of the Qur'an and Hadith, because in fact the verses of the Qur'an and Hadith are limited in number, while the human problems are growing. So, the role of ijtihad as a means of reform of Islamic law is vital. One of the methods of ijtihad is istishab. This study aims to describe the nature of istishab, clerical opinion about the value of its strength as a source of law, as well as the influence of ulama's opinion about the value of his resistance to differences of opinion in Islamic law. The approach used in this research is descriptive-qualitative. By using this method of research, this study concludes that the majority of scholars of the Maliki, Shafii, and Hambali sect assert that istishab is a hujjah to defend something that already exists (daf'i) and establish something that does not exist yet (itsbat). The late ulamas of the Hanafi sect assert that istishab is a hujjah in defense of something that already exists, while the majority of the Hanafi scholars and some scholars of the Shafi'i sect state that istishab is not a hujjah at all. The difference of the ulama's view of the use of istishab in ijtihad has led to differences in their views on Islamic law, as in the case of the law of the disappeared’s inheritance. Islam merupakan agama yang komprehensif. Komprehensifitas Agama Islam tidak terletak pada kelengkapan kandungan al-Qur’an dan Hadis, sebab faktanya ayat al-Qur’an dan hadis jumlahnya terbatas, sedangkan permasalahan manusia semakin kompleks. Karenanya, peran ijtihad sebagai sarana pembaharuan hukum Islam sangatlah vital. Salah satu metode ijtihad adalah istishab. Penelitian ini bertujuan untuk mendeskripsikan hakikat istishab, pendapat ulama tentang nilai kehujjahannya, serta pengaruh perbedaan pendapat ulama tentang nilai kehujjahannya terhadap perbedaan pendapat dalam hukum Islam. Pendekatan yang penulis gunakan dalam penelitian ini adalah deskriptif-kualitatif. Dengan menggunakan metode penelitian tersebut, penelitian ini menyimpulkan bahwa mayoritas ulama dari mazhab Maliki, Syafi’i, dan Hambali menyatakan bahwa istishab merupakan hujjah untuk mempertahankan sesuatu yang sudah ada (daf’i) dan menetapkan sesuatu yang belum ada (itsbat), sedangkan ulama Muta’akhirin dari mazhab Hanafi menegaskan bahwa istishab merupakan hujjah dalam mempertahankan sesuatu yang sudah ada saja, sementara mayoritas ulama mazhab Hanafi dan sebagian ulama mazhab Syafi’i menyatakan bahwa istishab bukan merupakan hujjah sama sekali. Perbedaan pandangan ulama tentang penggunaan istishab dalam ijtihad ini ternyata menyebabkan perbedaan pandangan mereka dalam hukum Islam, seperti dalam kasus hukum waris orang hilang.

Abstract

Emotional intelligence is one that has a big influence on success in achieving success in the future is that students are able to be embedded in their souls. Emotional intelligence is one of the major influences on success in achieving success in the future is that students are able to be embedded in their souls . The objectives achieved in this study are: 1) To analyse the form of mujahadah activities that can increase emotional intelligence in students at Pondok Pesantren Nurul Falah Bagusan Selopampang, 2) To analyse the strategy of instilling emotional intelligence in students at Pondok Pesantren Nurul Falah Bagusan Selopampang, 3) To analyse the values of emotional intelligence produced in students at Pondok Pesantren Nurul Falah Bagusan Selopampang. This research uses a qualitative method (field research) with a phenomenological approach. Data collection in this research is done by interview, observation, and documentation. The results of the data that have been collected are analysed using analytical techniques from data reduction, data presentation, and conclusion drawing.This research shows that1) mujahadah activities become a routine agenda at Ponpes Nurul Falah Selopampang which is carried out every day after mahgrib prayer except Friday night, 2) the method of cultivating emotional intelligence that is applied is the Zero Mind Process (ZMP) or the process of cleaning the heart and mind, Mental Building (mental building) which is trying to clear the heart according to its nature, Induvidual Strength (personal resilience), 3) the resulting values are Santri have good spiritual values, Santri can regulate the mood by not being easily provoked or anger. Santri have the value of empathy and prayer, Santri are able to survive with frustration, Santri have a sense of responsibility. The novelty in this research is the cultivation of emotional intelligence in students so that they can use their intelligence appropriately. And that is certainly very different from the planting process in other educational institutions.
