Abstract

Perlindungan hukum merupakan salah satu hal yang di miliki bagi setiap manusia tanpa terkecuali yang mana tidak hanya manusia saja lah yang memiliki perlindungan hukum melainkan juga perusahaan. Perusahaan yang menjadi korban dari tindak pidana yang dilakukan oleh tenaga kerjanya sehingga dapat di ancam dengan pidana penjara jikalau tenaga kerja tersebut tidak segera menggembalikan uang yang ia ambil dari perusahaan secara melawan hukum.Dalam hal tenaga kerja tidak kooperatif dengan tindakan yang di ambil oleh perusahaan, maka salah satu jalan untuk perusahaan dapat mengambil kembali uang nya yakni dengan jalan hukum. Pihak perusahaan sampai dengan sudah di somasi dan sudah di laporkannya tenaga kerja tersebut ke kepolisian, pihak perusahaan masih memiliki itikat baik untuk tidak terburu-buru menjalankan alur perkara pidana dengan berpandangan bahwa akan lebih baik jika perkara tersebut di lakukan dengan jalan non litigasi untuk mendapatkan kata mufakat antar kedua belah pihak. Kata-Kunci: Perlindungan Hukum, Perseroan Terbatas, Tenaga Kerja,Tindak Pidana, Non litigasi Legal protection is one of the things that is owned for every human being without exception, where not only humans have legal protection but also companies. Companies that are victims of criminal acts committed by their workers so that they can be threatened with imprisonment if the worker does not immediately multiply the money he takes from the company unlawfully.In the event that the workforce is uncooperative with the actions taken by the company, then one of the ways for the company to take back its money is by legal means. The company has been somasi and has reported the manpower to the police, the company still has good intentions not to rush to run the flow of criminal cases with the view that it would be better if the case was carried out with a non-litigation method to get a consensus between the two parties. Abstract

Kepala Desa merupakan penguasa tunggal dalam pemerintah desa. Maka, upaya dalam proses penyelenggaran pemerintahandesa, dilihat dari ekeftivitas kinerja kepala desa untuk menciptakan mekanisme pemerintahan yang dapat mengemban visi misi kepala desa dalam mewujudkan masyarakat yang sejahtera secara berkeadilan, Visi misi merupakan fokus dan arah bagi pemerintahan secara keseluruhan termasuk bagi kinerja kepala desa. Dengan demikian, yang menjadi penelitian yaitu : Untuk mengetahui bagaimana efektivitas kinerja Kepala Desa, dan Untuk mengetahui faktor yang mempengaruhi kinerja Kepala Desa dalam mewujudkan visi misi pembangunan desa. Metode penelitian dilakukan dengan jenis pendekatan kualitatif, jenis dan sumber data meliputi data primer dan sekunder.Pengumpulan data melalui teknik observasi, wawancara, dan dokumentasi.Instrumen penelitian meliputi peneliti sendiri, panduan wawancara, dan catatan lapangan, Teknik sampling menggunakanpurposive sampling.Keabsahan data menggunakan teknik triangulasi.Analisis dengan Reduksi, Penyajian dan penarikan kesimpulan. Hasil penelitian adalah Efektivitas kinerja kepala desa dalam mewujudkan visi misi pembangunan desa sudah dapat dikatakan baik dengan dilihat dari berbagai aspek. Adapun faktor yang mempengaruhi kinerja kepala desa dalam mewujudkan visi misi pembangunan desa yaitu cara berpikir masyarakat untuk meningkatkan SDM, partisipasi, taraf pendidikan, kerja sama yang baik, serta rasa tangung jawab bersama yang masyarakat dan perangkat desa. Adapun gaya kepemimpinan kepala desa sangat mendukung berjalannya visi misi

Abstract

This study aims to comparatively examine legal regulations related to criminal defamation occurring through social media during the regional head election (Pilkada) campaign period in Lamongan Regency. This study refers to the provisions of Law Number 7 of 2023 concerning Elections, which explicitly prohibits acts of insult or defamation during the election process. On the other hand, there are also regulations governing similar crimes in the electronic domain, as stipulated in Law Number 1 of 2024 concerning Electronic Information and Transactions (UU ITE). This study employs a qualitative approach with a comparative method to analyze the changes, advantages, and weaknesses in the provisions of the latest ITE Law, particularly in the context of political dynamics during the Pilkada campaign period in Lamongan Regency. The analysis shows that Law Number 1 of 2024 provides a more detailed and firm definition and limitations for the crime of defamation on social media. This regulation more clearly establishes the threshold for legal violations and the applicable sanctions, thereby creating greater legal certainty. These findings are expected to serve as a reference for law enforcement in strengthening legal protection for victims of defamation against individuals in the digital era.

Abstract

The Indonesian legal system recognizes the term criminal justice system as a system of law enforcement aimed at resolving and overcoming criminal cases that occur in society. The purpose of the criminal justice system is not only to process the settlement of criminal cases that are fast, inexpensive, and short but also to provide human rights protection, respect the principle of presumption of innocence and the process of punishment that provides a balance of law, defendants and victims. In dealing with these conditions, it takes the rules that underlie the settlement of criminal cases by promoting the principles of justice, expediency, and legal certainty. The Republic of Indonesia Police Agency is the main key in determining whether or not a criminal case can proceed into a criminal justice process, in this case issuing the Republic of Indonesia State Police Regulation Number 8 of 2021 concerning Handling of Criminal Acts Based on Restorative Justice. The author conducted research on the case resolution process carried out by the Batu Police in handling theft cases and whether the settlement process has realized restorative justice. The rule can be used as a reference by investigators in conducting mediation outside the court by using the development of the principle of restorative justice, which means returning to normal before the crime took place.

Abstract

Conflicts over forest land ownership in Indonesia continue to recur due to the lack of synchronization between the agrarian and forestry regimes. This overlapping authority creates legal uncertainty and impacts the protection of the economic rights of communities living in and around forest areas. This situation occurs in Ngadirenggo Village, Wlingi District, Blitar Regency, where tensions between the community and Perhutani regarding the control and utilization of forest crops continue. This study aims to analyze the legal regulations for forest land ownership based on applicable laws and regulations in Indonesia and reconstruct its ownership policy from the perspective of maqashid sharia, specifically hifz al-mal, to support sustainable development in Ngadirenggo Village. The study used an empirical juridical method with a qualitative descriptive approach to examine the process of law working in society. The results of the study indicate that regulations on land ownership in forest areas have not been harmoniously integrated, giving rise to policy dualism and prolonged conflict. Policy reconstruction is directed at strengthening the recognition of local community rights, harmonizing agrarian and forestry regulations, strengthening land ownership resolution mechanisms, and orienting policies towards sustainable development that balances economic, social, and environmental aspects. In the perspective hifz al-mal, the policy update emphasizes certainty and protection of the results of community efforts without ignoring the sustainability of the ecological function of forest areas. The academic contribution of this article lies in integrating the maqashid sharia approach, particularly hifz al-mal, into the discourse of forest land governance and sustainable development, offering a conceptual framework for harmonizing agrarian and forestry policies while strengthening legal protection for local communities in forest areas

Abstract

Sustainable economic development requires significant funding, which is often obtained through borrowing between creditors and debtors. One of the guarantee instruments in the financial world is fiduciary guarantees, which are regulated in Law Number 42 of 1999 concerning Fiduciary Guarantees. Fiduciary guarantees provide legal protection for creditors, but if they are not registered in accordance with the provisions of the law, legal protection for creditors becomes limited. This study aims to analyze the legal position of creditors in unregistered fiduciary agreements, the legal consequences that arise for creditors, and the legal protection that can be provided. This study used a normative juridical approach with analytical descriptive analysis. Based on the results of the study, it can be concluded that unregistered fiduciary guarantees do not have executory power and preferential rights for creditors, so creditors lose the legal protection provided by the Fiduciary Guarantee Act. This makes it difficult for creditors to claim their rights in the event of a default. Therefore, it is important to ensure the registration of fiduciary guarantees so that creditors' rights are protected in accordance with applicable provisions.

Abstract

Roads are key supporting facilities for land mobility, both for people and for land transportation vehicles transporting people and goods. Roads, as vital infrastructure, play a central role in supporting modern life. However, the function and sustainability of roads are often disrupted by various violations that harm the public interest. One form of violation of road utilization and management is the unauthorized installation of road portals.This research is a juridical-empirical legal study using a sociological juridical approach and a statutory regulatory approach (Stuttute Approach). The objectives of this research are to analyze and describe: (1) the government's role in regulating and supervising road portal installation, (2) the impact of road portal installation on public mobility, and (3) the legal implications of violations of road management and utilization. The data used are primary data from direct sources and secondary data from legal materials in the form of laws and regulations, scientific journals, and relevant documents. Data collection was conducted using interviews and literature review techniques. The research findings indicate that the installation of road portals in Sungai Toman Village constitutes a violation of the law regarding the implementation and utilization of road functions. In general, the government has the authority to regulate and supervise the installation of portals, the provisions of which are realized in Regional Regulation Number 29 of 2001 concerning Tonnage and Portals and Regional Regulation Number 9 of 2017 concerning the Implementation of Public Order. The installation of these portals has an impact on various aspects of community life, including impacts on public mobility, economic and commercial mobility, as well as impacts on social dynamics and horizontal conflict

Abstract

This study aims to analyze polygamy practices and their positive and negative impacts on family life as well as the psychological conditions of wives and children in the community of Paciran District, Lamongan Regency. This research employs a qualitative approach, with a conceptual and case study design. Data were collected through in-depth interviews, observations, and documentation involving polygamy practitioners, community leaders, and related parties. Data analysis was conducted through data reduction, data display, and conclusion drawing. The findings reveal that polygamy practices in Paciran vary, ranging from open to covert arrangements. Normatively, polygamy is perceived as permissible in Islamic law under strict conditions of justice and financial capability. However, in practice, polygamy tends to generate more negative impacts than positive ones, particularly affecting the psychological well-being of wives and children, including jealousy, emotional instability, domestic conflict, and declining family harmony. Nevertheless, a limited number of families demonstrate relative stability through equitable treatment and effective communication. This study highlights that polygamy requires strong psychological, economic, and moral readiness to prevent broader social and familial harm.

Abstract

This study aims to analyze the effectiveness of the premarital counseling program organized by the Office of Religious Affairs (Kantor Urusan Agama/KUA) of Bululawang District, Malang Regency, in enhancing prospective brides’ and grooms’ knowledge of the concepts of sakinah, mawaddah, and rahmah in family life. The high divorce rate in Indonesia—reaching 480,618 cases in 2021, with 110 cases recorded in Bululawang District alone in 2022—constitutes the underlying urgency of this research. This study employs a descriptive, qualitative approach using field research methods. Data were collected through participant observation, in-depth interviews, and documentation. Informants included the head of the KUA, marriage counselors, program facilitators, and ten pairs of prospective brides and grooms. The findings indicate that: (1) the premarital counseling program at the KUA of Bululawang has been implemented in accordance with the Regulation of the Director General of Islamic Community Guidance (Bimas Islam) Number 379 of 2018, encompassing six core modules delivered using andragogical methods; (2) supporting factors include the availability of instructional modules, the capacity of certified facilitators, and adequate facilities and infrastructure, while inhibiting factors comprise budget constraints, the absence of mandatory participation regulations, and suboptimal participant engagement; (3) overall, the premarital counseling program has proven effective in enhancing both the knowledge and psychological readiness of prospective couples, with the average readiness score reaching 74.65%. This study recommends strengthening regulations to mandate participation in premarital counseling programs and increasing budget allocations for the KUA.

Abstract

Flooding remains a persistent threat in Indonesian urban areas, including Batu City, East Java, causing extensive physical, social, and economic impacts. This study examines flooding impacts and analyzes prevention and mitigation efforts from a socio-legal perspective, with a focus on governance and spatial planning. Using a qualitative sociological-legal approach, the study finds that recurrent flooding in Batu City is primarily driven by human-induced land-use changes and weak enforcement of spatial planning regulations. Conversion of protected forests into agricultural land and settlements has reduced water catchment capacity, while degradation of the Brantas River Basin, including sedimentation and river narrowing, exacerbates flood risk. Batu, Junrejo, and Bumiaji sub-districts are the most affected, with flood durations often exceeding three hours. The findings indicate that deficiencies in spatial planning governance and law enforcement are key institutional factors in flood vulnerability. This study contributes to environmental administrative law by linking spatial governance failures to disaster risk and offers policy recommendations for revising the Regional Spatial Plan (RTRW) and strengthening local flood mitigation regulations.
