Abstract

Islamic boarding schools are one of the educational programs among the many levels of education that have been passed down from generation to generation by the people of Indonesia. Islamic boarding school is a national education identity that has special characteristics in the form of religion-based education that is thick with scientific nuances. This study aims to 1) Know the definition of Islamic boarding school in law number 18 of 2019; 2) Knowing the implementation of Law No. 18 of 2019 on graduates of Islamic boarding schools in state universities. The research method used is normative legal research with a doctrinal approach with a descriptive type of study. Article 1 paragraph (1) of this Law states that Islamic boarding schools are community-based institutions established by individuals, foundations, Islamic community organizations, and/or communities that instill faith and piety to Allah SWT, cultivate noble character and adhere to the teachings of Islam. Islam rahmatan lil’alamin which is reflected in the attitude of humility, tolerance, balance, moderation, and other noble values of the Indonesian nation through education, Islamic da’wah, exemplary, and community empowerment within the framework of the Unitary State of the Republic of Indonesia. Muhammadiyah Boarding School Klaten or commonly referred to as MBS Klaten is a modern boarding school combining religious education with general science and Information Technology (ICT). The implementation of the law to accommodate graduates of Islamic boarding schools to continue their studies to a higher level has been carried out through a scholarship program to all Islamic boarding schools in Indonesia. However, MBS Klaten provides extremely strict requirements so that few students have the opportunity to continue their studies at State Universities.Keywords: Boarding school; Government policy; Education

Abstract

Wadah platform online saat ini menjadi sarana komunikasi berbagai pihak, media sosial pun memberikan dampak positif maupun negatif terhadap masyarakat. Platform online menjadi salah satu strategi dalam aktivitas berkampanye dengan memanfaatkan literasi digital sebagai tujuan mengedukasi masyarakat secara kolektif terhadap wawasan dalam berpolitik. Metode pada penelitian ini menggunakan hukum normatif yang dikaitkan oleh studi kepustakaan dengan mengumpulkan data yang ada di masyarakat menjadi satu argument yang efektif, dengan didukung oleh berbagai sumber literasi hukum. Membahas berbagai aturan hukum dalam berkampanye online serta berkolaborasi dengan berbagai pihak pengawasan kampanye seperti Bawaslu dan KPU, akibat hukum yang dapat terjadi karena hal tersebut dapat berupa sanksi administrative dari mulai teguran hingga diskualifikasi selai itu dapat juga mendapat sanksi pidana yang diatur dalam pasal 492 dan 521 UU No.7 Tahun 2017 tentang Pemilihan Umum dan diakamodir pada pasal UU No.19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik. agar dapat meminimalisir terjadinya chaos atau perang tidak sehat antar sesama partai maka dibutuhkan sanksi bagi mereka yang melanggar berbagai aturan yang dibentuk oleh pemerintah.

Abstract

Divorce is the main cause of the dissolution of a marriage, as stated in Article 38 of UUP No.1 of 1974. Currently, one of the problems in society is the nusyuz case, which is defined as disobedience or non-compliance between husband and wife in prioritizing roles and obligations. contained in a marriage bond. The word nusyuz is found in Qs. An – Nisa verses 34 and 128, nusyuz cases are rife in religious courts. Therefore, the researcher used a normative juridical approach method by referring to Islamic law and positive civil law, statutory regulations and supported by secondary data in the form of interviews from several opinions and considerations of court judges' decisions. Comparisons with previous research can be found in interviews conducted by researchers with one of the chairmen of PA Surakarta, in terms of considering a decision in the form of livelihood, as well as developments in regulations issued by the Supreme Court. Often the children and wife are still the parties who suffer losses after a divorce, the basis for the judge's consideration in granting maintenance rights to the wife and children after the divorce. It is explained in Islamic law using 4 (four) methods: "Al - Qur'an, As - Sunnah, istidlal and ijma". Supported by Perma No. 3 of 2019, Law No. 16 of 2019 in regulating maintenance rights for wives and children. As an effort to protect the law, referring to the Decree of the Director General of the Supreme Court of Republic of Indonesia Religious Courts No. 1951 of 2021 concerning the Implementation of a Policy Brief Guaranteeing the Protection of the Rights of Women and Children Post-Divorce.
