Abstract

Illegal investment is a very disturbing business crime. The number of victims and the large value of losses make the case of illegal investment getting special attention. The return of losses from the proceeds of crime is actually the right of the victim, but in law enforcement practice, confiscated objects are usually returned to the state, not to the victim as the rightful party. This study will discuss the problems of investment law in business activities, illegal investment in crime terminology and victims' rights to confiscated objects. This research is normative juridical research examining the legal vacuum of confiscation of assets to be returned to the victim. The results show that investment is a business activity protected by law. In its development, there are investment irregularities in the form of illegal investments, namely investments that are not licensed and carried out against the law. Illegal investment in the terminology of crime is not explicitly stated, but this act is punishable by fraud and money laundering. The proceeds of crime are traced and confiscated, but in legal practice, the return is given to the state. In future legal reformulations, it is necessary to stipulate provisions regarding the seizure of assets; therefore, the victims can get their rights.

Abstract

The development of information and communication technology has brought significant changes to patterns of social interaction within society, particularly through the use of social media. The promotion of online gambling by Instagram celebrities (selebgram) through social media raises issues of criminal liability under Indonesian law. Selebgrams play a role in disseminating prohibited gambling content, thereby potentially expanding online gambling practices. This study aims to analyze the criminal liability of selebgrams who promote online gambling under Indonesian criminal law. This research employs a normative legal method with a statutory approach. The findings indicate that selebgrams who intentionally promote online gambling may be held criminally liable under the Electronic Information and Transactions Law and relevant provisions of the Indonesian Criminal Code.

Abstract

Human organ trafficking has emerged as a serious challenge at the intersection of health law, criminal law, and human rights in Indonesia. Despite the prohibition of organ commercialization under national legislation, the illicit trade in human organs continues to occur, indicating limitations in the existing legal framework and enforcement mechanisms. Aims: This study aims to analyze human organ trafficking as a health-related crime within the Indonesian criminal law system and to critically assess the adequacy of current legal regulations in addressing its complex medical, ethical, and human rights dimensions. The research employs an analytical–critical normative juridical approach. Relevant statutory provisions, including health law, criminal law, and human trafficking legislation, are examined through statutory, conceptual, and limited comparative approaches. The study relies on primary legal materials, scholarly literature, and international legal instruments, which are analyzed using qualitative legal analysis. The findings reveal that Indonesian law addresses organ trafficking through a fragmented regulatory framework, resulting in legal ambiguity and inconsistent enforcement. The absence of a distinct criminal offense for organ trafficking complicates the determination of criminal liability and often leads to disproportionate punishment of vulnerable donors while inadequately targeting organized networks and professional actors. Additionally, victim protection mechanisms, particularly in terms of medical aftercare and legal support, remain insufficient. The study concludes that comprehensive criminal policy reform is necessary to effectively address human organ trafficking in Indonesia. Explicit recognition of organ trafficking as a distinct health-related crime, integration of health law safeguards, and adoption of a victim-centered approach are essential to ensure legal certainty, proportional justice, and alignment with international human rights standards.

Abstract

Tindak Pidana pemerkosaan yang dilakukan oleh anak menimbulkan persoalan hukum yang kompleks karena melibatkan dua kepentingan yang sama-sama harus diberikan perlindungan, yakni perlindungan anak sebagai pelaku karena dianggap masih dibawah umur dan pemenuhan rasa keadilan bagi korban pemerkosaan. Sistem Peradilan Pidana Anak (SPPA) pada prinsipnya mengedepankan pendekatan perlindungan dan pembinaan, namun dalam kasus pemerkosaan yang tergolong tindak pidana serius, sering menghadapi dilema dalam praktik penegakan hukum. Penelitian ini bertujuan untuk menganalisis bentuk dan batas pertanggungjawaban pidana anak sebagai pelaku tindak pidana pemerkosaan dalam kerangka Sistem Peradilan Pidana Anak di Indonesia. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa pertanggungjawaban pidana anak pelaku pemerkosaan tetap dimungkinkan, namun harus dilaksanakan secara proporsional dnegan mengutamakan prinsip kepentingan terbaik bagi anak, ultimum remedium, serta perlindungan hak korban. Sistem Peradilan Pidana Anak memberikan ruang pembatasan pemidanaan melalui pemberian pengurangan ancaman pidana, penerapan saksi khusus bagi anak, serta pendekatan rehabilitasi. Oleh karena itu, diperlukan perlindungan anak dan keadilan substantif bagi korban. Kata kunci: Pertanggungjawaban pidana anak, pemerkosaaan, sistem peradilan pidana anak, perlindungan anak.
