Abstract

The proposal of qanun on polygyny by the Acehnese elite (executive and legislative) was aimed at the wider community because of the rampant phenomenon of siri marriage. Siri marriage is not prohibited in Aceh, and administrative requirements are even relaxed for ordinary people. This gap raises the question of whether the Acehnese elite proposed qanun polygyny for the benefit of the community or for subjective interests. This article is classified as field research with a qualitative approach. The methodology used is a descriptive-analytical study. The results of the study found that the administration reactor or key factor of the family law qanun in Aceh lies in the condition where the administration of polygyny requirements is tightened beyond the provisions of The Compilation of Islamic Law (KHI) and Siri Marriage requirements are loosened under the KHI provisions. The motive was an attempt by Acehnese elites to have their siri wives recognized (legality) in Aceh's polygyny qanun. This finding can be an input for family law studies to create regulations that are more objective and independent, especially in regions that have special autonomous rights.

Abstract

Character education is mandatory material in Indonesia. One of the character learning strategies is to use folk songs. This study describes the strategies used by teachers in implementing character learning and explores information about obstacles and supports in its application. There were 12 study participants consisting of religion teachers from six schools in the Yogyakarta and Sumatra Regions. Selection of participants using purposive sampling. Data collection through in-depth interviews using an interview guide. The analysis technique is carried out through the process of reducing, presenting and interpreting data to draw conclusions. The results of this study are very important for education, where the teacher’s strategy, the use of traditional songs can become a new model of character education. Obstacles faced in the form of diverse student abilities can increase innovation, creativity and teacher competence in designing learning. The results of this study can become a basic reference in a new character education strategy. This research has several limitations both from the location, research subjects and the type of research. Subsequent research with a more complete design will add to the strengthening of the results of this study.

Abstract

Polygamy is permissible in Islam. However, an absolute requirement of polygamy applies for a husband. It is allowed only if the husband could deal justly with his wives. If he is unable to act justly, then he is obliged to have only one wife.The provisions on polygamy in Indonesia have been regulated by Law No. 1 Year 1974 on marriage, and as a form of positive response to regulate a man who wants to marry more than one woman. Likewise, Compilation of Islamic Law (Kompilasi Hukum Islam-KHI) also regulates the polygamy’s terms and conditions for Muslims.Ideally, the two regulations - Law No. 1/1974 and KHI-- aim to provide terms and conditions of a man who wants to have next marriage. The provision is aimed to reduce men’s (husbands) arbitrariness on women (wives). Also, it helps in the creation of happy, prosperous, and peaceful family.

Abstract

The emphasis on customary law within the Aceh Singkil community, alongside the application of fiqh (Islamic jurisprudence) in religious practices, raises important questions regarding the formation of legal realities in practice. This article explores the social considerations underlying legal practices, focusing on the role of ethnic identity within the Aceh Singkil community. The study employs a qualitative methodology to achieve this objective, utilizing in-depth interviews and document analysis as data collection techniques. The data are analyzed through a structural-functional sociological approach, conceptualizing legal practice as a social phenomenon. The findings reveal that ethnic-based collective consciousness significantly influences the community’s tendency to prioritize customary law over formal fiqh rulings when determining kafāʾah (equality) criteria in marriage. This emphasis is evident in applying economic and occupational standards, the prohibition of intra-clan marriage, and the disregard for the religious status of a partner’s parents. These standards are shaped by concerns for individual rights, the preservation of ancestral heritage, and the promotion of social harmony as part of a broader nation-building initiative. Nevertheless, the Aceh Singkil community continues to uphold fiqh norms, particularly the requirement that both spouses share the same religion, demonstrating that Islamic law remains an integral part of the collective consciousness, operating alongside customary norms. These findings affirm that the implementation of law within ethnic communities is grounded in a collective consciousness—shaped by both religious and customary elements—which serves as a foundation for constructing and sustaining social solidarity. [Penekanan terhadap hukum adat dalam komunitas Aceh Singkil, yang juga menerapkan norma fikih dalam praktik keagamaannya, menimbulkan persoalan terkait pembentukan realitas hukum yang berlaku. Artikel ini bertujuan untuk mengungkap berbagai pertimbangan sosial dalam praktik hukum, dengan menitikberatkan pada peran identitas etnis dalam komunitas Aceh Singkil. Untuk mencapai tujuan tersebut, artikel ini menggunakan metode kualitatif dengan teknik pengumpulan data melalui wawancara mendalam dan dokumentasi. Data dianalisis menggunakan pendekatan sosiologi struktural-fungsional yang memandang penerapan hukum sebagai suatu fenomena sosial. Hasil temuan menunjukkan bahwa kesadaran kolektif berbasis etnis memengaruhi kecenderungan untuk lebih mengutamakan hukum adat dibandingkan dengan ketentuan fikih dalam menetapkan kriteria kesetaraan (kafāʾah) dalam pernikahan. Penekanan ini tercermin dalam penetapan standar kesetaraan berbasis ekonomi dan pekerjaan, larangan pernikahan dalam satu marga, serta pengabaian status agama orang tua pasangan. Penentuan standar tersebut mempertimbangkan perlindungan hak individu, pelestarian warisan leluhur, dan pembentukan harmoni sebagai bagian dari proyek kebangsaan. Meskipun demikian, komunitas Aceh Singkil tetap mempertahankan norma fikih, khususnya persyaratan seagama bagi pasangan, yang menunjukkan bahwa hukum Islam merupakan bagian integral dari kesadaran kolektif yang berjalan sejajar dengan hukum adat. Temuan ini menegaskan bahwa penerapan hukum dalam masyarakat etnis bertumpu pada kesadaran kolektif, baik yang dibentuk oleh agama maupun adat, sebagai fondasi dalam membangun dan mempertahankan solidaritas sosial.]

Abstract

Although the main principle in Islamic law emphasizes the clarity of the ḥalāl-ḥarām of a product, the implementation of halal certification standards must still consider aspects of service and convenience for consumers in their management. However, so far, the harmonization between halal certification standards and consumer needs, especially related to satisfaction with halal certification services, has not been optimal. Therefore, the study examines the extent of Indonesian public satisfaction with halal certification services as well as obstacles and strategies in strengthening halal certification services. This study uses quantitative and qualitative data which was analyzed descriptively. A quantitative approach with a survey was conducted to measure public satisfaction with halal certification services. While qualitative methods were used to investigate obstacles and strategies for strengthening halal certification services. This study found that Indonesian public satisfaction with halal certification services is high. However, various factors such as demands for simplicity, access to information, procedures, service time, and complaints must be improved because the public has higher expectations. Strengthening and accelerating halal certification services can be done through education and socialization of ḥalāl awareness, collaboration and expansion of cooperation with all stakeholders, accreditation of the Halal Inspection Institution (LPH), as well as training and certification of halal auditor competencies as an effort to ensure that the products are truly ḥalāl and fit for consumption in accordance with Islamic law.

Abstract

This review examines Islamic Law and International Law: Peaceful Resolution of Disputes (Oxford University Press, 2020) by Emilia Justyna Powell, a groundbreaking interdisciplinary study that explores how Islamic legal traditions influence the engagement of Muslim-majority states with international dispute resolution mechanisms. Drawing from original empirical data and classical Islamic jurisprudence, Powell argues that domestic legal structures—whether secular, Islamic, or hybrid—significantly shape states' preferences for international conflict resolution methods. The book highlights both the consonance and dissonance between Islamic law and international law, particularly in the context of peaceful settlement. Powell challenges prevailing assumptions of uniformity among Islamic Law States and demonstrates the importance of legal pluralism in international relations. Through critical analysis, this review assesses the strengths of Powell’s approach—her empirical rigor, legal-philosophical insight, and contribution to debates on global justice—while also noting the limitations, including the need for a more nuanced understanding of hybrid legal systems and broader geopolitical factors. Overall, the book is a significant scholarly contribution that bridges comparative law, Islamic studies, and international legal theory, offering valuable insights into the evolving dynamics of legal identity and interstate conflict management.
