Abstract

This research aims explicitly to explain the authority and role of the traditional village in utilizing customary village land for investment activities for tourism areas based on local wisdom in the Kerobokan Customary Village. This study used an empirical research type, with the research subjects of the Bendesa Adat and the village Prajuru. The data collection techniques used in this study were observation, a document study, in-depth interviews, purposively selected informants, namely each of the Indigenous Prajuru in the Kerobokan Customary Village, and Focus Group Discussion. The finding showed that the Kerobokan Customary Village has a role in the use of land for investment in tourism areas. The use of customary land for tourism investment activities was carried out with a lease agreement under the supervision of the Bendesa Adat. The finding showed that the involvement of the Customary Village in maintaining the balance of Tri Hita Karana values implementing tourism investment was not optimal, which can be seen from the effect of this activity in the form of environmental pollution within the tourism area, the shifting values of the local wisdom to be more commercialism, liberalism, and individualism.

Abstract

Pemerintah Indonesia melalui Undang-Undang Nomor 7 Tahun 1984, tentang Pengesahan Konvensi Mengenai Penghapusan Segala Bentuk Diskriminasi Terhadap Wanita. Dalam hal ini, pemerintah indonesia telah berkomitmen untuk menghapuskan segala bentuk diskriminasi terhadap perempuan dengan berbagai upaya, antara lain: mempromosikan, memenuhi dan melindungi perempuan dari segala bentuk diskriminasi dan kekerasan. Peran perempuan yang berkembang di masyarakat baik dari aspek refroduksi, ekonomi, sosial, politik dan kepemimpinan bahwa selama ini perempuan ditempatkan hanya sebagai anggota dalam hal kegiatan kemasyarakatan atau keorganisasian.

Abstract

The leadership of Balinese customary village is highly patriarchal so the position of the women in the leadership system is merely a subordinate of the man. It is an issue since the leadership development of the modern era does not discriminate against gender. This discrimination leads this study to formulate a new concept concerning leadership in customary villages based on gender equality. This study used the social-legal method. An interdisciplinary study is a hybrid of a grand study concerning the jurisprudence and science of law from a societal perspective. This study formulated a customary village leadership based ongender equality. This formulation was formed by implementing functions of the customary village comprehensively in form of the Woman Association (Pakis) as a new organization which empowers Balinese women. Pakis should make programs to empower and develop leadership for Balinese women, especially in the customary village leadership. Besides that, the nyentana marriage system that transforms the role of purusa (man) to be predana (woman) must be implemented comprehensively in Banjar so the woman who conducts this marriage system takes the position as a man and her name is listed in Banjar. The final formulation is by duplicating the leadership pattern in sekeha teruna teruni which has concerned with gender equality.
