Abstract

Abstract

Asset confiscation as an effort to recover state financial losses due to corruption crimes in Indonesia still faces substantial challenges. The legal framework stipulated in the Criminal Procedure Code limits confiscation only for evidentiary purposes in the judicial process, these restrictions impact the non-optimal recovery of state financial losses. This research aims to analyze the regulatory and technical substance obstacles in the implementation of asset confiscation and develop a progressive legal strategy based on the theory of justice. This research is normative juridical research that integrates John Rawls' theory of justice, Richard A. Posner's Economic Analysis of Law Theory, and Lawrence Friedman's legal system theory and the theory of legal expediency as an analytical knife as a consideration to provide recommendations for reform of special confiscation arrangements for corruption crimes. The results show that the gap between the Criminal Procedure Code and the Corruption Eradication Law worsens the effectiveness of asset confiscation, especially at the investigation stage. The expansion of objects that can be seized and the Non-conviction based (NCB) asset forfeiture approach are identified as potential solutions that are more efficient and fair in overcoming this obstacle. The proposed strategy includes expanding the scope of confiscation and harmonizing regulations between KUHAP and the Law on the Eradication of Corruption. This research confirms the importance of legal reform to improve the efficiency of recovering state losses due to corruption while strengthening a fair and beneficial legal system. The strategy of expanding asset confiscation arrangements has urgency in efforts to recover....

Abstract

The issue on violence and discrimination against child and female workers in Indonesia remains significant to date. The government aims to protect children and women, prevent violence and discrimination, and address these issues through legal instruments and other promotion. This study centers its objective on identifying the factors contributing to human rights violations against child and female workers, as well as promotion to prevent and address these violations. The study employs normative juridical methods and data collection techniques based on journals, articles, laws, and conceptual approaches. The results indicate that poverty, culture, low levels of education, and economic pressure are factors contributing to human rights violations against children. The marginalization of women in the workplace, their subordinate position in society and culture, stereotypes against them, low education, patriarchal culture, and the interests of the authorities are all factors behind human rights violations against female workers. Promotion to prevent such violations include making laws regarding the protection of children and women, among other measures. Keywords: Child and Female Workers, Human Rights, Legal Protection

Abstract

The leadership of Balinese customary village is highly patriarchal so the position of the women in the leadership system is merely a subordinate of the man. It is an issue since the leadership development of the modern era does not discriminate against gender. This discrimination leads this study to formulate a new concept concerning leadership in customary villages based on gender equality. This study used the social-legal method. An interdisciplinary study is a hybrid of a grand study concerning the jurisprudence and science of law from a societal perspective. This study formulated a customary village leadership based ongender equality. This formulation was formed by implementing functions of the customary village comprehensively in form of the Woman Association (Pakis) as a new organization which empowers Balinese women. Pakis should make programs to empower and develop leadership for Balinese women, especially in the customary village leadership. Besides that, the nyentana marriage system that transforms the role of purusa (man) to be predana (woman) must be implemented comprehensively in Banjar so the woman who conducts this marriage system takes the position as a man and her name is listed in Banjar. The final formulation is by duplicating the leadership pattern in sekeha teruna teruni which has concerned with gender equality.

Abstract

The research aims to explore the impact of geographical indications on increasing the value of products or commodities, thereby boosting the economy of the region where the geographical indications originate. This focus is directed towards the producers rather than the farmers (protecting the communal society) and adheres to the "first to file" principle, where the party that first applies for registration is prioritized. The study utilizes a normative legal research method, focusing on the lack of norms regarding the parameters for protecting the registration of geographical indications. It appropriately employs the following approaches: statute approach, conceptual approach, and analytical approach. The research emphasizes that the assessment and application of geographical indications with a combination of factors must be fulfilled jointly or consider both natural and human factors influencing the quality characteristics of the produced goods. For instance, potential protection under geographical indications with a combination of factors involves products with main raw materials. The goal is to prevent imitation claiming to be a genuine product in circulation and exploiting geographical indications for the benefit of the rights holder. To ensure beneficial certainty, the geographical indications with a combination of factors require a parameter.
