Abstract

This article aims to critically evaluate the relocation of the capital city of Indonesia based on the principles of al-maqāṣid (the objectives of Islamic law), as outlined in the existing legislation. The relocation of a capital city has historical precedence in Islamic tradition, with its primary justification being the fulfillment of the public good (maslahah). Through a normative legal study, this research reveals that the objective of relocating national capital is fundamentally a secondary need (ḥājiyyāt) rather than a primary necessity (ḍarūriyyāt) for the Indonesian populace. This classification indicates that the process of developing new national capital may face significant challenges in the future, as it does not address an essential or urgent need, but rather a secondary one. Consequently, the potential for encountering serious issues during the development and implementation phases of new capital is high, warranting a careful and well-considered approach to avoid future complications.

Abstract

Ketahanan pangan merupakan isu strategis bagi Indonesia yang berpenduduk hampir 280 juta jiwa. Global Food Security Index (GFSI) menempatkan Indonesia pada peringkat 69 dari 113 negara, menunjukkan masih adanya tantangan dalam ketersediaan, keterjangkauan, kualitas, dan keberlanjutan pangan. Dalam perspektif Maqosid Al-Syari'ah, pangan termasuk bagian dari penjagaan jiwa (hifz al-nafs) dan harta (hifz al-mal), sehingga penguatan pengawasan pangan menjadi kebutuhan mendesak. Penelitian ini bertujuan menganalisis kontekstualisasi dan merumuskan strategi revitalisasi institusi al-hisbah pangan di Indonesia untuk mewujudkan ketahanan pangan nasional. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan library research, content analysis, dan kajian retrospektif. Hasil penelitian menunjukkan bahwa sistem pengawasan pangan di Indonesia masih menghadapi kekosongan moral yang memicu penyimpangan regulasi, sehingga diperlukan revitalisasi institusi al-hisbah melalui penguatan tata kelola dan internalisasi nilai moral ekonomi syariah. Revitalisasi dilakukan dengan pendekatan persuasif yang dapat ditingkatkan menjadi represif bila terjadi pelanggaran serius, serta melibatkan koordinasi lintas lembaga dan pendidikan etika ekonomi syariah bagi seluruh pemangku kepentingan. Temuan ini berimplikasi pada perlunya integrasi prinsip Maqosid Al-Syari'ah dalam desain kebijakan pangan nasional agar pengawasan tidak hanya administratif, tetapi juga berlandaskan integritas moral dan keberlanjutan.

Abstract

Global food crises occurred post 2008 have clearly figured out the susceptibility of food security of world countries not only in poor countries but also welfare countries. World Bank data shows that there are millions of hungry people everyday. Referring to FAO data, it is known that the buried countries in the world caused by food are primarily faced by Muslim countries. This research aims to study strengthening food security in Muslim countries and resolution mechanism. Food problem is a common problem that is difficult to be overcome by each country alone. That is why a cooperation mode becomes important to overcome food problem of Muslim countries. Food problem is economic problem both conventional and Islamic economic. In Islamic economic aiming to realize al-falah, food sufficiency is a primer condition in gaining the aim. World Islamic Economic Forum is international organization of Muslim world which concerned to food problem. Therefore, it is very relevant for this international organization to be subject of research. Starting studying on condition of food security in Muslim world and food in a global context, research questions will be discussed by using operational frame in gaining al-falāh and through integration of Muslim world and representative concept of food security. Technically this research is using double research strategy mutually combining quantitative and qualitative approach to gain sharp analyses. The result of the study is strengthening food security in Muslim world done by World Islamic Economic Forum is significant first step by availability of Memorandum of Agreement (MoA) among Muslim countries, mutually cooperation of agriculture investment, and effort to upgrade the potentiality of each Muslim countries by conductively trade cooperation. The process of gaining al-falāh is manifested in effort step to fulfill a sufficiency of food in Muslim world.

Abstract

Islamic economic developments in the country, covering an academic study in universities or in practice operasioanl as happened in the Islamic economic institutions such as Islamic Banking, Takaful, Islamic Capital Market, and so on. The development is expected to further broaden to include aspects and a very broad scope, such as economic policy, local economics, macroeconomic (fiscal policy, public finance, strategy to overcome poverty and unemployment, inflation, monetary policy), and other economic issues, such as wage and labor and others. In the development of economic institutions in order to compete and in accordance with the needs of modern business society, necessary to create innovative products to remain in compliance with Shariah principles in its operations. The development also has implications for many Indonesian people who move in an Islamic economy, it is very possible legal disputes in the field of Islamic economics. Therefore, it takes the application of Islamic law in the practice of Islamic economics in Indonesia.Walaupun seem a bit slow when compared to the rise of Islamic economic institutions in Indonesia, but the presence of Islamic Economics Law Compilation (KHES) in Indonesia in late 2008 and should be appreciated by good. KHES least is a new breakthrough in the economic aspects of Islamic legal thought in Indonesia. Application of Islamic law in the practice of Islam in other Indonesian economy is the implementation of DSN MUI fatwas that ensures products and operations of Islamic economic institutions in Indonesia are in accordance with Islamic principles.

Abstract

This paper discusses price fluctuations for personal protective equipment (PPE) during the Covid-19 pandemic in terms of Islamic economic law in the principles of al kharāj bi al dhomān. This issue is very interesting for two reasons: the massive phenomenon of PPE hoarding during the pandemic and the need for an understanding of sharia economic law to be empowered to understand the risks associated with fluctuations in PPE prices during the pandemic. This paper is a qualitative research with a sociological juridical approach. In the perspective of sharia economic law, especially in the context of the rules of al kharāj bi al dhomān, ideally PPE producers or resellers should dare to take risks due to pandemic conditions and not, so they carry out hoarding under the pretext of waiting for prices to stabilize or worry that they will not be able to buy more products to be resold. These conditions caused the price of PPE to increase many times. Within the framework of the rules of al kharāj bi al dhomān, producers or resellers must be able to make mitigations to bear the risk of profit and risk of loss. In terms of consumer protection, the government's role is very important. Mitigation measures can be taken with government regulations to standardize prices, market operations, and strict regulations that will catch violators during a pandemic.
