Abstract

The implementation of regional autonomy through Acts Number 23/2014 on Regional Government formulates the authority that can be maintained by local governments. One of the authorities’ is the political autonomy. The efforts to implement the political autonomy can be done through the institutionalization of local political parties. However, according to Indonesian Law, the institutionalization of  local political parties is not regulated  in the provisions  of acts related to political parties. The legislation that regulates local political parties can be found only in Acts Number 11/2006 on Aceh Government and Acts Number 21/2001 on Special Autonomy for Papua Province. Therefore, this paper analyzes the theoretical, juridical and sociological reasons underpinned the idea of local political parties’ institutionalization. This research is a normative legal research which uses legal matter and acts to analyse the problems. This research finds strategies that is relevant to make local political parties institutionalized. There are five reasons to deliver local political parties in Indonesia based from this research. First, the theoretical foundation describes Indonesia as a country with federalism autonomy.  Second,  the constitutional  juridical  basis consists  of two principles of the Constitution, namely the principle of the autonomy of the unitary state and the principle of equality and freedom of every citizen in governing. Third, The platform of sociological based on the fact that the choice of pluralistic Indonesian society is still diverse in many elections. Fourth, the historical background in the form of historical experience that in 1955 General Election and Local Election, there  were  several  local  political  parties.  Fifth, the comparative study  in  United  Kingdom as a unitary state and  Malaysia as a Federal State, which both have local political parties. The concept of local political parties that are relevant to be applied in Indonesia in the constitutional juridical perspective related to the decentralization of political parties can be built through four strategies. First, the local political party whose presence was based on pluralist paradigm which provides the idea that in a pluralistic society should be built a decentralized party system in order to sustain the plurality of society. Second, the local political party which drafted is a separate legal entity which is dichotomous from the national political parties as a legal entity. Third, local political party’s participation in elections only to the General Election and Local Elections for Legislative Elections candidates, the Provincial Representatives, Regency / City. Fourth, the formation mechanism, supervision and dissolution  of local political parties are designed similar to national political process for parties as applicable today.

Abstract

Politik hukum nasional terhadap keberadaan ekonomi syariah di Indonesia, dapat kita lihat melalui dua aspek, yaitu aspek kelembagaan dan aspek substansi hukum yang tercermin dari lahirnya peraturan perundang-undangan. Dari aspek kelembagaan dapat kita lihat salah satunya dalam kewenangan pada Peradilan Agama, dimana sengketa ekonomi syariah menjadi kewenangan mutlak Peradilan Agama, disamping diakuinya keberadaan Dewan Syariah Nasional (DSN) dan Badan Arbitrase Syariah (Basyarnas) yang kedudukannya berada di bawah Majelis Ulama Indonesia. Dari aspek peraturan perundang-undangan, dapat kita lihat dalam UU No.21 Tahun 2008 tentang Perbankan Syariah, UU Nomor 19 Tahun 2008 tentang Surat Berharga Syariah, UU 23 Tahun 2011 tentang Pengelolaan Zakat, dan UU Nomor 50 Tahun 2009 tentang Peradilan Agama, UU 41 Tahun 2004 tentang Wakaf serta yang lain-lainnya.

Abstract

Abstract:Indonesia needs a huge investment in infrastructure. Of the total funding needs for strategic infrastructure from year 2019 to 2024, it is projected that the country is only able to provide less than half. Hence, Indonesia needs to seek another source to finance its infrastructure. This research aims to review and provide input to the government on the construction of state-owned infrastructure financing policies to realize national economic resilience. Through legal construction methods using a statutory approach, a conceptual approach, and a multidisciplinary approach. The results of this study show that the right state-owned infrastructure financing model to realize national economic resilience is with the Non-APBN scheme, which is a cooperation between the government and all stakeholders. The infrastructure development is supported by the VfM (Value for Money) method, with a new financing scheme in the form of participation of the entire community through the issuance of securities by the sharia-based government. The development of infrastructure with the Non-State Budget scheme will maintain the country's financial stability and reduce the burden of dependence on foreign debt.Keywords: Infrastructure, Financing, Non-APBNAbstrak:Indonesia membutuhkan investasi Infrastuktur yang sangat besar. Dari total pendanaan ivestasi strategis infrastruktur untuk kurun waktu 2019 sampai dengan. 2024, pemerintah hanya mampu menyediakan pendanaan kurang dari separuhnya saja. Pemerintah perlu mencari alternatif sumber pendanaan lain guna mendanai kebutuhan infrastrukturnya. Penelitian ini bertujuan untuk mengkaji dan memberikan masukan kepada pemerintah terhadap konstruksi kebijakan pembiayaan infrastruktur milik negara untuk mewujudkan ketahanan ekonomi nasional. Melalui metode konstruksi hukum dengan menggunakan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan multidisipliner. Hasil Penelitian ini menunjukkan bahwa model pembiayaan infrastruktur milik negara yang tepat untuk mewujudkan ketahanan ekonomi nasional adalah dengan skema Non-APBN, yang merupakan kerjasama antara pemerintah dan seluruh stakeholders. Pembangunan  infrastruktur tersebut didukung dengan metode VfM (Value for Money), dengan skema pembiayaan baru berupa partisipasi seluruh masyarakat melalui penerbitan surat berharga oleh pemerintah yang berbasis syariah. Penerpan pembanguan infrastruktur dengan skema Non-APBN akan menjaga stabilitas keuangan negara dan mengurangi beban ketergantungan terhadap hutang luar negeri.Kata Kunci: Infrastruktur, Pembiayaan, Non-APBN

Abstract

ABSTRACTThe  era of disruption that  occurred globally had affected all human life in various fields, both in the economic, social, cultural, political, educational and other fields. Disruption had a positive impact, but it would also have a negative impact if it was not treated wisely. Geostrategy could be used as an effort to maintained ideological resilience, which was one of the basic things needed in realizing national resilience.The research method used in this article was normative research; the research stage, literature study; and deductive analysis, the type of research approach used was the conceptual approach and the statutory approach. This study discussed Pancasila as the source of all sources of law as well as the ideology of Indonesia's geostrategic resilience in the face of an era of global disruption. The author also used the literature methodIn this era of global disruption, Pancasila as the basis of the state and the nation's outlook on life played an important role in being able to filtered new values, by applying Pancasila values in all aspects of national life so as to maintained national resilience while still paying attention to the existence of Indonesian geostrategy  which had Pancasila as an ideology of geostrategic resilience which was a reflection of the existing values and lives of the precepts contained in it.ABSTRAKDistrupsi industri 4.0 telah mempengaruhi seluruh kehidupan manusia di berbagai bidang, baik di bidang ekonomi, sosial, budaya, politik, pendidikan, dan bidang lainnya. Memberikan dampak positif dan negatif jika tidak disikapi dengan bijak. Geostrategi dapat dimanfaatkan sebagai upaya menjaga ketahanan ideologi yang merupakan salah satu hal dasar yang diperlukan dalam mewujudkan ketahanan nasional.Metode penelitian yang digunakan dalam artikel ini adalah penelitian normatif; tahap penelitian, studi kepustakaan; dan analisis deduktif, jenis pendekatan penelitian yang digunakan adalah pendekatan konseptual dan pendekatan perundang-undangan. Penelitian ini membahas mengenai Pancasila sebagai sumber segala sumber hukum yang juga sebagai ideologi ketahanan geostrategi Indonesia dalam menghadapi era  global. Peneliti juga menggunakan metode kepustakaan (library research).Dalam distrupsi industri 4.0, Pancasila sebagai dasar negara dan pandangan hidup bangsa memegang peranan penting untuk dapat menjadi filter nilai-nilai baru, dengan menerapkan nilai-nilai Pancasila dalam segala aspek kehidupan nasionalnya diharapkan mampu mempertahankan ketahanan nasional dengan tetap memperhatikan eksistensi geostrategi Indonesia.

Abstract

A district autonomy as the consequence of UUD 1945 amendment, gives several authorities to the local government, and one of the autonomies is in politics. The local politic parties are expected to be able to apply the political autonomy, even though juridically its existence is still difficult to be conducted by the national party regulation in UU Nomor 2 Tahun 2008 (constitution number 2 year of 2008) about Political Party and UU Nomor 10 Tahun 2008 (constitution number 10 year of 2008) about Public Election. The focuses of this research are; first, what is the theoretical basis in creating the local political party in Indonesia as a united nation? Second, how is the concept of local political party that is relevantly applied in Indonesia as a united nation which is suitable with Indonesian constitutional substance? The method used in this research is the qualitative investigation of law material with the juridical approach which is completed by political approach. This research has concluded; first, the urge of local political party has presented in Indonesia, not only as the consequence of the realization of district autonomy, but also as the implementation of ideology federalism theory which is aimed as the existence guard of a country.Second, a local political party that can be developed in Indonesia, in the future, is a political party that has no relation with a national party, as it is a structure as well as in election.Key words : Local autonomy, unitarian state, local poltical party

Abstract

Infrastructure is an instrument to facilitate the rotation of the economy so that it can accelerate development. Funding is a major challenge in national infrastructure development. The state budget is only able to support about one-third of the total infrastructure funding required. Unconventional financing alternatives provide significant benefits to national infrastructure development. Unconventional state-owned infrastructure financing has a positive impact on national economic resilience. Increasing the speed of infrastructure development by using non-conventional approaches, infrastructure development can be accelerated because it can involve private participation in financing and managing infrastructure projects. This research uses normative juridical method by using statutory approach and conceptual approach.
