Abstract

Abstract:Indonesia needs a huge investment in infrastructure. Of the total funding needs for strategic infrastructure from year 2019 to 2024, it is projected that the country is only able to provide less than half. Hence, Indonesia needs to seek another source to finance its infrastructure. This research aims to review and provide input to the government on the construction of state-owned infrastructure financing policies to realize national economic resilience. Through legal construction methods using a statutory approach, a conceptual approach, and a multidisciplinary approach. The results of this study show that the right state-owned infrastructure financing model to realize national economic resilience is with the Non-APBN scheme, which is a cooperation between the government and all stakeholders. The infrastructure development is supported by the VfM (Value for Money) method, with a new financing scheme in the form of participation of the entire community through the issuance of securities by the sharia-based government. The development of infrastructure with the Non-State Budget scheme will maintain the country's financial stability and reduce the burden of dependence on foreign debt.Keywords: Infrastructure, Financing, Non-APBNAbstrak:Indonesia membutuhkan investasi Infrastuktur yang sangat besar. Dari total pendanaan ivestasi strategis infrastruktur untuk kurun waktu 2019 sampai dengan. 2024, pemerintah hanya mampu menyediakan pendanaan kurang dari separuhnya saja. Pemerintah perlu mencari alternatif sumber pendanaan lain guna mendanai kebutuhan infrastrukturnya. Penelitian ini bertujuan untuk mengkaji dan memberikan masukan kepada pemerintah terhadap konstruksi kebijakan pembiayaan infrastruktur milik negara untuk mewujudkan ketahanan ekonomi nasional. Melalui metode konstruksi hukum dengan menggunakan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan multidisipliner. Hasil Penelitian ini menunjukkan bahwa model pembiayaan infrastruktur milik negara yang tepat untuk mewujudkan ketahanan ekonomi nasional adalah dengan skema Non-APBN, yang merupakan kerjasama antara pemerintah dan seluruh stakeholders. Pembangunan  infrastruktur tersebut didukung dengan metode VfM (Value for Money), dengan skema pembiayaan baru berupa partisipasi seluruh masyarakat melalui penerbitan surat berharga oleh pemerintah yang berbasis syariah. Penerpan pembanguan infrastruktur dengan skema Non-APBN akan menjaga stabilitas keuangan negara dan mengurangi beban ketergantungan terhadap hutang luar negeri.Kata Kunci: Infrastruktur, Pembiayaan, Non-APBN

Abstract

This research aims to gain a vivid and comprehensive portrait of legal aspects in the digitalization of cultural heritage in Greater Malang in Indonesia from the perspective of ecotourism and the state’s role in terms of policies and involvement of the members of the public in cultural conservation. The involvement of e-tourism and e-government in managing and developing the tourism potential in developed areas is inevitable. Cultural heritage-based tourism promoting the utilization of advanced information and communication technology has attracted the attention of tourists. Empirically, the digitalization of cultural heritage does not stand on its own but is more integrated with other aspects and sectors. The proposed concept in this study reminds us of the urgency in the development and utilization of integrated cultural heritage digitalization from the perspectives of eco-tourism, e-tourism, as well as other sectors such as e-government and spiritual aspect. The process of the development and utilization of digitalization of cultural heritage tourism is intended to ward off any disputes over ulayat rights happening these days. The role of the government and the participation of tribal people are deemed vital in reconstructing the system of social and spiritual values in developing eco-tourism based on the application of an integrated digital information system disseminating local wisdom through the threshold of global civilization.

Abstract

This research aims to inquire into the concept of sustainable tourism development currently taking place in tourism villages in Indonesia, added with the criteria of social complexity of the locals in the digital era. With a qualitative approach, this research obtained samples of the people of Inner Inner Baduy – Banten, Tenganan Pegringsingan – Bali, and Wonokitri – Tengger. Observation, in-depth interviews, and Focus Group Discussion were also performed to gain validated data, which were further analyzed based on SWOT to help formulate the strategies for sustainable tourism village development. The research results indicate that there was disharmony between the policies of the state and the economy of the Adat peoples, cultural exoticism and modernity, economic development, and the culture of adat tourism. Therefore, the process of planning and setting the criteria for sustainable tourism development should take into account the complexity and social diversity. Furthermore, a Plan for Digital Inclusion for adat people needs to be developed. The contribution of this research is expected to help reduce the disharmony of interest in the development of adat tourism villages and bring about the concept of sustainable tourism development to boost the authenticity of adat villages that correspond with their uniqueness in the digital era.

Abstract

Management rights are control rights from the state, part of which is given to the right holder. Management rights on customary land can contribute to the state and customary law communities by paying attention to the customary rights of customary law communities recognised by the constitution. This research explores the legal basis for the recognition of customary rights, the concept of management rights over customary rights, and how the time limit for management rights cooperated with third parties can provide justice to Indigenous peoples. The method employed is the normative legal method, utilising both statutory and conceptual approaches. The research results highlight a legal vacuum regarding the time limit of management rights when engaging with third parties, where legal protection to the parties cannot be provided due to a legal vacuum. This gap in legal protection necessitates prompt regulation to set time limits that are equitable for Indigenous communities to ensure certainty, justice and legal protection for all parties involved. Abstrak Hak pengelolaan merupakan hak menguasai dari negara yang sebagian pelaksanaannya diberikan kepada pemegang haknya. Hak pengelolaan di atas tanah ulayat dapat memberikan konstribusi bagi negara dan masyarakat hukum adat dengan memerhatikan Hak ulayat masyarakat hukum adat yang di akui oleh konstitusi. Tujuan penulisan ini untuk menganalisis  pengakuan hak ulayat, kedua konsep hak pengelolaan diatas hak ulayat, ketiga dan batasan waktu hak pengelolaan yang dikerjasamakan kepada pihak ketiga dapat memberikan keadilan kepada masyarakat hukum adat. Metode yang digunakan adalah  metode penelitian hukum normatif, dengan menggunakan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukan bahwa kekosongan hukum mengenai batasan waktu hak pengelolaan yang akan dikerjasamakan kepada pihak lain/ketiga, yang dimana perlindungan hukum kepada para pihak tidak dapat diberikan karena adanya kekosongan hukum, sehingga demi menjamin kepastian, keadilan dan perlindungan hukum bagi pihak ketiga, terkhusus masyarakat hukum adat, maka perlunya segera diatur batasan waktu yang berkeadilan bagi masyarakat hukum adat.

Abstract

This research aims to obtain a general overview of marine ecotourism and marine sports tourism in Olele Village. Applying qualitative description methods, this research uses interview techniques, observation, and literature study for data collection. This research shows that sports tourism activities are in the marine ecotourism area in Olele Village. Types of sports activities, namely snorkeling and diving. Abstract

Desa Sibalaya Selatan memiliki berbagai potensi sumber daya alam yang cukup baik, salah satunya di bidang pertanian yaitu perkebunan jagung,yang di mana merupakan bahan baku briket yaitu limbah tongkol jagung. Tujuan dari penelitian ini adalah untuk mengetahui strategi pemasaran briket pengganti arang. Pengumpulan data dilakukan melalui observasi langsung di lokasi penelitian, serta wawancara dengan petani jagung. Analisis SWOT (Strengths, Weaknesses, Opportunities, dan Threats) digunakan untuk merumuskan alternatif strategi pemasaran briket arang. Hasil penelitian ini menunjukkan alternatif strategi sebagai berikut: Strategi SO: Pemanfaatan sumber bahan baku yang melimpah, pengurangan biaya produksi, pemanfaatan teknologi. Strategi WO: perbaiki tampilan kemasan dan label produk, tingkatkan promosi. Strategi ST: Meningkatkan kualitas dan mengembangkan variasi produk yang kompetitif. Strategi WT: mengelola manajemen keuangan.

Abstract

Infrastructure is an instrument to facilitate the rotation of the economy so that it can accelerate development. Funding is a major challenge in national infrastructure development. The state budget is only able to support about one-third of the total infrastructure funding required. Unconventional financing alternatives provide significant benefits to national infrastructure development. Unconventional state-owned infrastructure financing has a positive impact on national economic resilience. Increasing the speed of infrastructure development by using non-conventional approaches, infrastructure development can be accelerated because it can involve private participation in financing and managing infrastructure projects. This research uses normative juridical method by using statutory approach and conceptual approach.

Abstract

The younger generation will continue to grow up with unlimited access to digital technology and have different thinking patterns from previous generations. If it is not balanced with knowledge, it will easily become an instant generation. Digital literacy is needed in this situation to search, find, classify and understand accurate and relevant information. One of the difficulties of the digital literacy era is negative content. For example, material related to various issues and concerns related to SARA, which often triggers various horizontal conflicts between citizens or communities and various issues both on a local and global scale. Digital literacy must go hand in hand with individual capacity to access the internet, especially information and communication technology, so that everyone can understand it completely and there is no gap in understanding due to only obtaining one-sided information. Digital literacy plays an important role in improving students' skills in this digital era. . This really allows generations already at various levels of education to gain the skills and knowledge they need to be successful in the world of education and their future.

Abstract

The UN Declaration on the Rights of Indigenous Peoples and the Indonesian Constitution both recognize the traditional rights of indigenous peoples. New regulations in Indonesia have introduced management rights originating from customary land. However, a legal vacuum exists regarding the terms of agreements to collaborate with third parties, putting both indigenous communities and third parties at risk. The research aims to safeguard and establish clarity for the traditional rights of indigenous peoples, as well as those of third parties seeking land management rights. This research employs a normative, juridical approach. Using a statutory approach and a conceptual approach, legal construction methods analyze the basic concepts for determining management rights over customary land of indigenous peoples. The results of this study emphasize the importance of setting fair timeframes to ensure fairness for all parties involved. This aims to eliminate legal uncertainty and potential losses, particularly for indigenous communities and those seeking these management rights. Provisions for the term of land use by third parties with the goal of fairness based on rights inequality; then, to come to an agreement that is good for both sides, the maximum term is based on the term of the Business Use Rights (HGU), which was 35 years, extended to 25, and renewed for another 35 years   Hak tradisional masyarakat hukum adat telah diakui dalam Deklarasi PBB tentang Hak-Hak Masyarakat Adat dan pada Konstitusi Indonesia. Peraturan baru di Indonesia memperkenalkan hak pengelolaan yang berasal dari tanah adat, namun terdapat kekosongan hukum terkait jangka waktu perjanjian untuk berkolaborasi dengan pihak ketiga, ketidakpastian ini membahayakan masyarakat adat dan pihak ketiga. Tujuan penelitian untuk melindungi dan memberikan kepastian hak tradisional masyarakat adat dan juga pihak ketiga yang akan mengusahakan tanah hak pengelolaan. Penelitian ini menggunakan jenis penelitian yuridis normatif, studi ini menggali konsep dasar untuk mengetahui hak pengelolaan di atas tanah ulayat  masyarakat adat dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual yang dianalisis dengan metode konstruksi hukum. Temuan penelitian ini menekankan perlunya menetapkan jangka waktu yang adil untuk memastikan keadilan bagi semua pihak yang terlibat. Hal ini bertujuan untuk mengatasi ketidakpastian hukum dan potensi kerugian, khususnya bagi masyarakat adat atas hak tradisionalnya dan bagi pihak yang akan mengusahakan hak pengelolaan tersebut. Ketentuan jangka waktu pemanfaatan lahan oleh pihak ketiga dengan tujuan keadilan atas dasar ketidaksamaan rawls, maka dasar penetapan perjanjian yang saling menguntungkan kedua belah pihak menggunakan jangka waktu maksimal sesuai dengan jangka waktu dari Hak Guna Usaha (HGU) diberikan 35, diperpanjang 25, dan diperbaharui 35 Tahun.

Abstract

This article aims to explore the legal policy on national legal development in the 1973 and 1978 Guidelines of State Policy of the Republic of Indonesia (GBHN). Through a normative legal research approach, incorporating statutory, historical, and conceptual analysis, the study reveals several key insights. First, the GBHN serve as the overarching framework for national development, ensuring continuity across various sectors to realize the national goals outlined in the Preamble to the 1945 Constitution. Pancasila and the 1945 Constitution are positioned as enduring legal policy. Second, both the 1973 and 1978 GBHN emphasize the creation, renewal, codification, and unification of laws. The legal policy on legal development outlined in the 1978 GBHN not only build upon but also expand the initiatives of the 1973 GBHN. The development of the national legal system in both guidelines occurs simultaneously, addressing the legal substance, structure, and culture within society. Third, while legal development is crucial, it is not the highest priority, as it is seen as a supportive element to the economic sector, which was considered more pressing at the time.
