Abstract

The existence of discretion on the one hand it is beneficial for administration officials to overcome  the stagnation of government.  Discretion allow a government  official to issue a policy even though there is no legislation that became law umbrella issuance of the policy. But on the other hand, if the discretion is not used in accordance with the procedures and requirements specified will open up opportunities for abuse of power by government officials, which of course would be  detrimental  to the  citizens  as victims. The problem in this research are, first, what is the fruit simalakama discretion to governance? Secondly, how the problems of discretion in the application of laws and regulations in Indonesia after Law No. 30 Year 2014 on Government  Administration? This research is the use of doctrinal primary law and secondary law.  The method  used the normative approach. The study concluded that, tops, discretion has been the fruit othe  governance  dilemma  because  on  the  one  hand  can  overcome  the  stagnation of government but on the other hand open the possibility of abuse of authority. Secondly, there are many problems arising after the enactment of Law No. 30 Year 2014 on Government Administration in particular  with regard to discretion

Abstract

Constitutional amendments that accommodate various rights are the starting point for a new era of human rights in Indonesia, including for people with disabilities. Along the way, the Indonesian government has also responsively ratified the Convention on the Rights of Persons With Disabilities (CRPD) into Law Number 19 of 2011, Law Number 8 of 2016 concerning Persons with Disabilities, and PP Number 39 of 2020 concerning Adequate Accommodation for Persons with Disabilities in Judicial Process. Departing from the two contexts above, namely the weak protection of access to justice for people with disabilities and the fairly complete normative guarantee of the right to justice for people with disabilities, the author looks at the further implications for practice in the District Court. Apart from that, the author also analyzes the problems faced by the District Court in providing access to justice, by using the Padang District Court and the Wonosari District Court as research objects. The research results show that to this day, people with disabilities still encounter many obstacles in gaining access to justice. These obstacles are encountered both in terms of regulations, human resources, and facilities and infrastructure. A comparison of the fulfillment of access to justice for persons with disabilities between the Padang District Court and the Wonosari District Court gives rise to quite a sharp gap because it is influenced by at least three factors, namely: the perspective of the Chief of Justice, support from civil society organizations, and support from universities.

Abstract

It is reported that the development of Nusantara as Indonesia’s new capital city tends to be pragmatic and disregards the quality of its processes and outcomes. Such a development has reduced the public’s trust, mainly because of this project’s environmental loss, social-humanity problems, and economic challenges. By employing human rights-based approaches to development, this article discusses the implementation and policy issues of the development of Nusantara in more depth and detail based on the rights holders’ experiences living in the Nusantara and its neighbouring areas. The research reveals that the development of Nusantara, ranging from its planning and policy formulation to its implementation, clearly neglected applicable laws and regulations. It failed to respect the rights of local communities, including indigenous peoples who enjoy their livelihoods in Nusantara and its neighbouring areas. We argue that the lack of respect and protection of human rights in the development implementation is because the development policy of Nusantara is grounded in autocratic legalism, even if it is established in a democratic mechanism.

Abstract

Harus diakui, memasuki usianya yang ke-14 tahun Mahkamah Konstitusi, kita masih tetap dalam fase pencarian format ideal pelembagaan MK. Sejak awal berdirinya pada tahun 2004, MK telah memberikan warna baru bagi perwujudan negara hukum di Indonesia, tidak berhenti sampai disitu, MK telah juga membuka ruang perdebatan baru yang dalam dan substantif di kalangan ahli hukum tata negara. Bagaimana tidak, kewenangan untuk membatalkan undang-undang yang dibuat oleh presiden dan DPR (lembaga negara konstitusional yang mendapat mandat lansung dari rakyat), adalah konstruksi baru yang sebelumnya tidak dikenal dan bahkan cenderung di haramkan dalam masa Trias Politika. Rumus dasarnya, bahwa masing-masing kekuasaan (eksekutif, legislatif, dan yudikatif) itu terpisah dan tidak boleh saling mencampuri. Namun MK bukanlah tanpa cacat sama sekali, dari aspek struktur, sudah ada dua hakim MK yang saat ini mendekam di penjara karena terbukti melakukan korupsi. Ditambah lagi dengan berbagai pelanggaran etik yang dilakukan oleh beberapa hakim lain. Sedangkan dari aspek kewenangan, sudah banyak pihak yang mengkritisi beberapa keputusan MK yang dinilai tidak lagi berpihak pada keadilan. Pada mulanya, Komisi Yudisial diberikan kewenangan untuk melakukan pengawasan, namun melalui putusannya sendiri, MK membatalkan kewenangan tersebut sehingga saat ini, pengawasan hanya dilakukan oleh internal kelembagaan MK sendiri. Tulisan ini akan mengkaji lebih jauh urgensi pengawasan hakim MK oleh Komisi Yudisial. Adapun metode penelitian yang digunakan adalah metode normatif.

Abstract

Program pengabdian masyarakat ini dilaksanakan untuk mengatasi permasalahan pengelolaan sampah di Perumahan Grha Palem Indah, Kapanewon Depok, Kabupaten Sleman, DIY. Kegiatan ini dilatarbelakangi oleh krisis pengelolaan sampah di Yogyakarta, dengan produksi sampah mencapai 327 juta ton per hari pada tahun 2021. Program dilaksanakan melalui tiga tahapan utama: sosialisasi pengelolaan sampah, edukasi anak-anak melalui kegiatan mewarnai, dan praktik pengomposan menggunakan alat LOSIDA (Lodong Sisa Dapur). Materi sosialisasi mencakup perspektif Islam tentang lingkungan, kondisi persampahan Yogyakarta, klasifikasi sampah, dampak kesehatan, dan teknik pengomposan. Kegiatan ini berhasil menarik partisipasi aktif warga, tercermin dari antusiasme dalam sesi tanya jawab dan praktik pengomposan. Evaluasi menunjukkan peningkatan pemahaman warga tentang pengelolaan sampah, dibuktikan dengan testimoni positif dan minat tinggi dalam mengimplementasikan teknik pengomposan. Penyerahan alat LOSIDA kepada ketua RT menjadi langkah konkret mendukung keberlanjutan program. Untuk memastikan efektivitas jangka panjang, tim berencana melakukan monitoring dan evaluasi berkala. Program ini tidak hanya berkontribusi pada solusi masalah sampah lokal, tetapi juga berpotensi menjadi model percontohan untuk pengembangan program serupa di lokasi lain. Keberhasilan ini menegaskan pentingnya kolaborasi antara akademisi, masyarakat, dan pemangku kepentingan dalam menciptakan solusi berkelanjutan untuk permasalahan lingkungan.

Abstract

Normatively, the right to vote for persons with mental disabilities in elections was not fully recognized in Article 57 paragraph (3) of Law no. 8 of 2015. This law stipulates that one of the conditions for voters in elections is "not having mental/memory problems". This phrase interpreted broadly that all persons with mental disabilities are not entitled to the right to vote. This phrase was then tested by the Constitutional Court, whereupon the Constitutional Court issued Decision No. 135/PUU-VIII-2015 which substantially invalidates the phraselet's talkand granting the right to vote in general elections for persons with mental disabilities. This decision is considered a progressive leap taken by the Constitutional Court to ensure fair elections, because people with mental disabilities are not the same as people with schizophrenia, with a more humane approach and adequate medicine, people with mental disabilities are the same as people without mental disabilities. Therefore, the author is interested in seeing more deeply how this Constitutional Court Decision can fulfill the right to vote for persons with disabilities. This research is a type of non-doctrinal research that uses both primary and secondary data. The areas that are used as research objects are the provinces of Bali and DIY. The results of the study show that from a quantitative aspect there has been an increase in the participation of voters with mental disabilities. However, the implementation of the Constitutional Court's decision by the election organizers is also still encountering various obstacles, both administration, infrastructure, and services

Abstract

Tegaknya keadilan dengan terwujudnya kekuasaan kehakiman yang independen sebagaimana cita-cita UUD 1945. Khususnya Pasal 24 1945, yang berbunyi “Kekuasaan kehakiman merupakan kekuasaan yang merdeka untuk menyelenggarakan peradilan guna menegakkan hukum dan keadilan”. Prinsip ini kemudian dilegalformalkan dalam Pasal 1 Undang-Undang No. 48 Tahun 2009 tentang Kekuasaan Kehakiman. Akan Tetapi pada prinsipnya didalam Undang-Undang MA yang memuat ketentuan bahwa pengangkatan Hakim Agung oleh Presiden atas usul DPR dan pemberhentian Ketua, Wakil Ketua, Ketua Muda, dan Hakim Anggota MA juga dilakukan oleh Presiden atas usul MA, ternyata disitu Presiden mempunyai celah yang nantinya dapat mempengaruhi psikis hakim dalam membuat keputusan. Penelitian ini menggunakan pendekatan normatif dan yuridis guna mencari kesesuaiannya dengan prinsip keadilan dalam Islam, karena dalam Islam (baik nas al-Qur’an atau hadis) tidak memuat secara eksplisit tentang adanya kekuasaan kehakiman. Penyusun menyimpulkan pengangkatan dan pemberhentian hakim oleh Presiden tentu saja tidaklah tepat karena dapat mempengaruhi psikis hakim dalam membuat keputusan dan hal ini dapat mengaburkan makna Pasal 24 UUD 1945 dan menunjukkan kurang independennya kekuasaan kehakiman.

Abstract

Indonesia is a country with high religious, cultural, and social diversity. Freedom of religion, belief, and harmony between religious communities are important elements to maintain social stability. Normatively, protection for this has been regulated, but its implementation faces challenges, especially in Kulonprogo, which has significant social and religious diversity. This challenge is increasingly complex due to the construction of Yogyakarta International Airport (YIA), which has triggered massive population migration, bringing various religious and cultural identities and increasing the potential for social friction. This study uses a qualitative descriptive approach that is exploratory in nature with primary and secondary data collected through interviews, field observations, and documentation. Data analysis follows the Miles and Huberman model, including data collection, reduction, presentation, and drawing conclusions. The results of the study show that although the construction of YIA brings major challenges, Kulonprogo has strong social capital, such as mutual cooperation, deliberation, and mutual respect, which are the basis for harmony between religious communities. In addition, the presence of religious figures who actively promote tolerance is a key factor in reducing conflict. The principles of justice (‘adl) and reconciliation (islah) in Islam can be an ethical guide for building social harmony through collaboration between government, local communities, and religious figures.
