Abstract

Article 24A paragraph 3 provides a provision that candidates for Supreme Court justices are proposed by the Judicial Commission to the House of Representatives for approval and to subsequently be appointed as chief justices by the president and the Supreme Court Law states that the appointment of Supreme Court Judges is carried out by the President on the proposal of the House of Representatives or the dismissal of the Chairman, Vice Chairman, Junior Chairman, and Member Judges of the Supreme Court is dismissed by the President on the proposal of the Supreme Court, so that the President, the House of Representatives (DPR, and the Judicial Commission (KY) have loopholes that can later influence the psychic judges in making decisions if the case is related to the 3 (three) institutions. This study aims to determine the Independence of Judicial Power in Indonesia. This research includes library research, research whose data sources are obtained through good literature sources and laws and regulations and using normative and juridical approaches, the Compiler concludes that the proposal for the appointment and dismissal of Supreme Court judges by the Judicial Commission, the House of Representatives and the President may affect the psychic of a judge in making a decision so that this can eliminate the meaning of Article 24 paragraph 1 of the 1945 Constitution which shows less independence of judicial power in upholding justice in accordance with the ideals of the 1945 Constitution.

Abstract

Religious moderation is actually the key to creating tolerance and harmony, both at the local and national levels. Religious moderation should be understood as a balanced, non-exclusive, and tolerant religious attitude.  In the midst of the strengthening of radical understanding among the younger generation, it is necessary to convey a narrative about Islam that is cool, tolerant and non-violent among students and university students. This study aims to find out (1) the Socialization Strategy of the Constitutional Law Study. The method used in Research is qualitative research. From the studies carried out it is known; First;  The socialization strategy of the FSEI IAIN Curup Constitutional Law Study Program on Religious Moderation in the 4.0 era is to socialize to the community in collaboration with the Indonesian Ulema Council (MUI) of Rejang Lebong Regency by campaigning for the importance of Washatiyyah/moderate Islamic views for the plural Republic of Indonesia, through social media, (Fb, IG, Twitter, and YouTube). Second, the Effectiveness of the Introduction of the FSEI IAIN Constitutional Law Study Program Curup based on religious moderation in the 4.0 era is quite good with the increasing interest of prospective new students studying in the Constitutional Law study program, and the campaign about the importance of Washatiyyah/moderate Islamic views for the plural Republic of Indonesia is increasingly spread among students of the Constitutional Law Study Program through Social Media portals.

Abstract

Article 24 paragraph 1 of the 1945 Constitution "Judicial power is an independent power to administer justice to uphold law and justice". Will However, Article 24A paragraph 3 makes a provision that candidates for Supreme Court judges are proposed by the Judicial Commission to the DPR for approval and subsequently appointed as Supreme Court justices by the president and the Supreme Court Law states that the appointment of Supreme Court Judges is carried out by the President at the proposal of the DPR or the dismissal of the Chair, Deputy Chairperson. , Junior Chairmen, and Member Judges of the Supreme Court are dismissed by the President at the suggestion of the Supreme Court, so that the President has loopholes that can later affect the psyche of judges in making decisions. This study aims to determine the independence of judicial power in Indonesia in the perspective of Islamic law. This study uses a normative and juridical approach. The authors conclude that the proposal for the appointment and dismissal of Supreme Court judges by the Judicial Commission, the DPR and the President may affect the psychology of a judge in making a decision so that This can eliminate the meaning of Article 24 paragraph 1 of the 1945 Constitution which shows the lack of independence of the judicial power in upholding justice in accordance with the ideals of the 1945 Constitution. Indeed, in the history of the Islamic judiciary, it is the Caliph (President) who has the authority to appoint and dismiss a judge/qhadi. judges have a fear of Allah so that judges decide cases based on Islamic law.

Abstract

Tegaknya keadilan dengan terwujudnya kekuasaan kehakiman yang independen sebagaimana cita-cita UUD 1945. Khususnya Pasal 24 1945, yang berbunyi “Kekuasaan kehakiman merupakan kekuasaan yang merdeka untuk menyelenggarakan peradilan guna menegakkan hukum dan keadilan”. Prinsip ini kemudian dilegalformalkan dalam Pasal 1 Undang-Undang No. 48 Tahun 2009 tentang Kekuasaan Kehakiman. Akan Tetapi pada prinsipnya didalam Undang-Undang MA yang memuat ketentuan bahwa pengangkatan Hakim Agung oleh Presiden atas usul DPR dan pemberhentian Ketua, Wakil Ketua, Ketua Muda, dan Hakim Anggota MA juga dilakukan oleh Presiden atas usul MA, ternyata disitu Presiden mempunyai celah yang nantinya dapat mempengaruhi psikis hakim dalam membuat keputusan. Penelitian ini menggunakan pendekatan normatif dan yuridis guna mencari kesesuaiannya dengan prinsip keadilan dalam Islam, karena dalam Islam (baik nas al-Qur’an atau hadis) tidak memuat secara eksplisit tentang adanya kekuasaan kehakiman. Penyusun menyimpulkan pengangkatan dan pemberhentian hakim oleh Presiden tentu saja tidaklah tepat karena dapat mempengaruhi psikis hakim dalam membuat keputusan dan hal ini dapat mengaburkan makna Pasal 24 UUD 1945 dan menunjukkan kurang independennya kekuasaan kehakiman.

Abstract

Abstrak: Ada kesenjangan aturan dimana ketentuan Kitab Undang-Undang Hukum Perdata (KUH Perdata)tidak membolehkan adanya pernikahan bagi pasangan zina, namun di sisi lain Kompilasi Hukum Islam (KHI) membolehkan berlangsungnya pernikahan antara pasangan yang berzina.  Penelitian ini fokus mengkaji perbandingan kemaslahatan larangan dan kebolehan pernikahan sebagai diatur dalam KUH Perdata dan KHI. Penelitian ini menggunakan metode penelitian kepustakaan (library research). Sumber data utama penelitian adalah KUH Perdata dan KHI. Adapun hasil penelitian ini adalah dalam Hukum Perdata Indonesia yaitu terdapat larangan pernikahan pelaku zina dalam pasal 32 KUH Perdata yang larangan ini bertujuan supaya bermaksud untuk meminimalisir kasus perzinaan yang terjadi dalam pergaulan masyarakat. Sedangkan ketentuan KHI memboleh pernikahan dalam rangka menjaga kehormatan nasab. Maka, untuk memelihara nasab dianjurkannya pernikahan, sehingga pernikahan sesama pelaku zina dibolehkan. Hal ini berdasarkan kesepakatan para ulama dan sesuai dengan surat an-Nur ayat 3 serta sejalan dengan pasal 53 KHI. Kebolehan pernikahan zina ini secara keseluruhan dilihat dari segi kemaslahatan dan kekhawatiran dari kemudharatan yang akan ditimbulkan. Kesimpulan penelitian ini adalah bahwa KUHPerdata melarang adanya pernikahan zina dikarenakan supaya masyarakat tidak terjerumus ke dalam zina dan tidak merugikan kepentingan masyarakat luas. Sedangkan KHI membolehkan pernikahan zina karena melihat kemaslahatan yang akan ditimbulkan yaitu terpeliharanya kehormatan nasab.

Abstract

The implementation and institutionalization of democracy with the absence of substantial democratization in the lower level of community does necessarily cause a problem. What it has been becoming a culture and being embraced by people for hundred or even thousand years, would be difficult to be transformed, even though its canalization is in the form of constitution. It may work in the conceptual level yet it may find obstacles in the implementation one. This condition influences the implementation of Village Constitution. The village democracy institutionalization is the focus of this study that covers three forms, they are: the election of village head, the village head election disputes, and term of office of village head. The research method of this study is normative-juridical. The writer initially studied the juridical provisions concerning the three main problems above, and then analyzed the implementation problems in the field. The result of this research showed that the direct election of village heads, village head election disputes done by the regional head, and term of office of the village head office for six (6) years in three periods as it is written on Laws Number. 6 of 2014, causes many problems theoretically as well as philosophically.
