Abstract

IntroductionOne of the business transactions that developed in the digital era is futures trading. This type of transaction involves high risk where profit is obtained from the difference between buying and selling, with goods being delivered at a later date. Profits are obtained from price fluctuations on traded commodities. This type of futures trading is also done on the Binance platform. Many traders are interested in this type of trade but do not have sufficient knowledge and understanding, especially regarding Fiqh legality.ObjectivesThe study aims to explain the practice of futures trading on the Binance platform from the perspective of Fiqh Muamalah. MethodThis study is literature research with a juridical-normative approach that relates facts to futures trading cases.ResultsThe results of this study explain that futures trading on the Binance platform includes bay' al-şarf, a type of money trade in which money is obtained and delivered at a later date. ImplicationsFutures trading on the Binance platform in Fiqh Muamalah is prohibited because it involves elements of uncertainty (gharar) and speculation (maysir). The exchange rate is uncertain, which can cause one party to benefit and the other party to be harmed.Originality/NoveltyThis research contributes to the theory of Fiqh legality in future trading practices.

Abstract

This study aims to discuss the legal culture of inheritance distribution in a Sasak community in Jerowaru Village, Lombok by reveal the interaction of customary law and Islamic law used in distributing inheritance. This study is a qualitative descriptive which considers normative legal research and empirical legal research, as well as Islamic law anthropology and legal pluralism perspective. Qualitative data was collected by conducting in depth interviews with religious leaders, traditional leaders and community members. Number three: Sasak community has a pattern of heritage distribution (inheritance distribution) in the form of "Sak Mame Belembah Sak Nine Bereson" sons get more than daughters. It illustrates the give and take of customary law with its emphasis on social equilibrium and family responsibility, together with Islamic legal practices tailored to local realities. The analysis by Griffiths and Hooker in legal pluralism theory, as well as from Clifford Geertz and John Bowen in Islamic legal anthropology, shows that the law in the Sasak community has appeared not static law but dynamic law, which is responsive against social change. Inheritance law integrates customary law, and Islamic law eventually produces an inheritance legal system that is broad and flexibly ensures substantive and distributive justice; one way is to amalgamate cultural values and religious needs embraced by the society. To its academic contribution, this research is an answer revealing how complex the legal dynamics are in a plural societies context, and there is a new way of looking to create Islamic Law in line with Consuetudo Law to build a legal system that is fair and responsive by referring to local wisdom.

Abstract

Tanah merupakan faktor penting dalam stabilitas dan krisis tatanan sosial umat Islam. Islam dan ajarannya yang berkeadilan akan menjadi solusi atas masalah penguasaan dan kepemilikan tanah dan sumber air oleh manusia termasuk di Indonesia. Hal ini karena Indonesia mengalami ketimpangan kepemilikan lahan dan sumber daya agraria. Peraturan Pemerintah Nomor 64 Tahun 2021 menjadikan bank tanah sebagai suatu badan kelembagaan baru dalam upaya pemerintah telah memberikan pengaturan yang jelas tentang pertanahan di Indonesia. Jenis penelitian ini adalah penelitian pustaka. Pendekatan yang digunakan dalam penelitian ini adalah Pendekatan yuridis normatif yang mana pendekatan ini dilakukan berdasarkan bahan hukum utama dengan cara menelaah teori-teori, konsep-konsep, asas-asas hukum serta peraturan perundang-undangan yang berhubungan dengan penelitian ini. Sumber data penelitian ini berupa sumber data sekunder, yaitu Fikih Agraria karya Majelis Tarjih dan Tajdid PP Muhammadiyah. Berdasarkan UUPA mengatur tentang dasar hukum pengadaan tanah untuk pembangunan bagi kepentingan umum, pengadaan tanah adalah tindakan pemerintah untuk mengambil alih tanah untuk kepentingan umum, berdasarkan pertimbangkan untuk mencapai kesepakatan tentang pelepasan hak dan kompensasi sebelum mengambil hak pencabutan. Menurut hukum Syariah Pemerintah memberikan tanah kepada mereka yang membutuhkannya disebut al-iqtâ'. Pengadaan Tanah di Indonesia menurut PP No. 64 Tahun 2021, dijelaskan pada Pasal 18 UUPA yang menjabarkan 2 (dua) komponen penting pengadaan tanah jika negara “terpaksa” untuk memperoleh tanah dari masyarakat, yaitu hak dilakukan semata-mata untuk kepentingan umum dan pemegang hak atas tanah harus di berikan ganti kerugian. Menurut Fikih Agraria terhadap Pengadaan Tanah di Indonesia menurut PP No. 64 Tahun 2021, menjelaskan bahwa negara dapat memberikan tanah kepada rakyat siapa yang membutuhkannya atau kepada orang-orang apa yang layak diberikan bisa dilakukan oleh pemerintah.

Abstract

Bahwa wakaf untuk proyek jalan tol adalah peristiwa yang sudah sering terjadi di Indonesia dan hal tersebut menimbulkan persoalan dalam perspektif Hukum Islam, sehingga artikel ini bertujuan untuk menggali rumusan tentang hukum ruislag tanah wakaf yang berlaku di Indonesia dan pandangan Hukum Islam terhadap tanah wakaf belum bersertifikat yang terdampak proyek pembangunan jalan tol. Penelitian ini dilakukan dengan tujuan untuk mengkaji tentang bagaimana ruislag tanah wakaf menurut hukum yang berlaku di Indonesia dan menjelaskan bagaimana ruislag tanah wakaf belum bersertifikat untuk proyek pembangunan jalan tol dalam perspektif Hukum Islam. Penelitian ini menggunakan penelitian kepustakaan (library research) dengan menggunakan pendekatan yuridis normatif. Teknik pengumpulan data dilakukan dengan cara dokumentasi, kepustakaan dan wawancara. Hasil dari penelitian ini menunjukan bahwa penyebab terjadinya ruislag tanah wakaf di Indonesia disebabkan oleh 2 faktor, yaitu faktor kepentingan pihak tertentu dan faktor kepentingan umum. Ruislag tanah wakaf belum bersertifikat dalam perspektif Hukum Islam tetap sah dengan syarat dan rukun wakaf yang sudah terpenuhi. The endowment of land for toll road projects is a recurring event in Indonesia, and it raises legal issues from an Islamic perspective. Therefore, this article aims to explore the formulation of the law of ruislag tanah wakaf (the transfer of endowment land) in Indonesia and the Islamic perspective on non-certified endowment land affected by toll road construction projects, necessitating the application of ruislag. This research is conducted with the purpose of examining how ruislag tanah wakaf is regulated by the prevailing laws in Indonesia and non-certified endowment land for toll road development projects is viewed from the perspective of Islamic law. This study utilizes library research as a method, employing a normative juridical approach. Data collection techniques include documentation, literature review, and interviews. The findings of this research indicate that the occurrence of ruislag tanah wakaf in Indonesia is caused by two factors: specific interests and public interests. Non-certified ruislag tanah wakaf remains valid from the perspective of Islamic law, provided that the conditions and pillars of the endowment have been fulfilled.

Abstract

This study aims to describe and analyze the recommended times for sexual intercourse as outlined in the bookQurrah Al-'Uyūn bi Syarḥ Naẓm Ibni Yāmūn. A common misconception exists that the best time forintercourse is solely on Friday night due to its supposed spiritual rewards. This research, which is of the libraryresearch type, utilizes secondary data sources, primarily the book Qurrah al-'Uyūn bi Syarḥ Naẓm Ibni Yāmūnby Shaykh Abū Muhammad At-Tihāmī bin Madānī. Content analysis was employed to examine the data. Thefindings reveal that Shaykh At-Tihāmī emphasized that there is no specific time restriction for sexual intercourse,meaning it can be conducted at any time, whether day or night. Despite the permissibility of intercourse at anytime, Shaykh At-Tihāmī identifies certain preferable times, including the beginning and end of the night, Fridaynight, Monday night, and the month of Shawwal. A sahih hadith narrated by Muslim corroborates this, notingthat the Prophet married and consummated his marriage with Aisha during Shawwal. This study contributes tothe theoretical understanding of recommended times for sexual intercourse.

Abstract

Penelitian ini bertujuan untuk menganalisis kedudukan hukum dan hak keperdataan anak yang lahir dari perkawinan yang tidak dicatatkan secara resmi oleh negara, serta mengkaji implikasi yuridis dari kebijakan pencatatan kelahiran berdasarkan Permendagri Nomor 9 Tahun 2016 terhadap anak hasil perkawinan siri. Penelitian ini menggunakan pendekatan yuridis normatif dengan menelaah peraturan perundang-undangan, putusan Mahkamah Konstitusi, dan doktrin hukum yang relevan. Hasil penelitian menunjukkan bahwa status anak menurut Undang-Undang Nomor 1 Tahun 1974 dibedakan menjadi anak sah dan anak luar kawin, yang berimplikasi pada perbedaan hak keperdataan, terutama dalam hal waris, nafkah, dan nasab. Meski Undang-Undang Perlindungan Anak Nomor 35 Tahun 2014 menjamin hak anak tanpa diskriminasi, pengakuan terhadap hak keperdataan anak luar kawin tetap harus melalui proses pembuktian hukum. Penerapan SPTJM dalam pencatatan kelahiran melalui Permendagri Nomor 9 Tahun 2016 mempermudah akses administrasi, namun tidak serta merta memberikan legitimasi hukum penuh terhadap hubungan keperdataan anak dengan ayahnya. Oleh karena itu, pengakuan hak keperdataan anak hasil perkawinan siri tetap memerlukan validasi hukum melalui bukti atau penetapan pengadilan.

Abstract

This research aims to determine waqf literacy products in journals in Indonesia and Malaysia, especially cash waqf, which is expected to address the problem of low public understanding of cash waqf and may be due to not being supported by adequate literacy products. Research on waqf literacy products that focus on cash waqf is more due to the increasing trend of cash waqf, along with its great potential. The research method uses bibliometric mapping with metadata obtained from the Publish or Perish (PoP) application to access Google Scholar by filtering the titles Cash Waqf Indonesia and Malaysia and its publications in the form of journals. To visualize the bibliometric network, this study used the VOSViewer version 1.6.19. The accessed journals are limited to the last five years, 2018-2023. From the search results, Cash Waqf Indonesia had 106 journal articles, and Cash Waqf Malaysia had 40. Indonesian and Malaysian cash waqf literacy products published in journals are few. Likewise, cash waqf studies associated with productive waqf themes are still few in number, and the focus of productive waqf studies is still limited to sukuk and micro-enterprises. The low level of public understanding of cash waqfs in Indonesia and Malaysia may be partly due to the lack of literacy products.
