Abstract

This research uses normative juridical research method. The results of the study are: The basis of business ethics in Indonesia should be the same as business ethics around the world. Business ethics is also part of the culture of the community concerned. Therefore, the business ethics of Indonesian society must reflect the culture, civilization, values of religious character of the Indonesian nation.

Abstract

In determining an actor crime as a political offense we have to look at the background of these actions. The problem, however, related with the codification such as the Criminal Code. It does not expressly provide the identification the action in the field of politics. In the Criminal Code, for example, the murder of president or vice president, did not be regarded as the murder. That is, evidence about the political background is not necessary to have the trial court. While the law relating to this problem such Act. 11/PNPS/1963 on Combating Subversive Activities that have been revoked, have two opinions. First, states have no political background. Second, there should be no political background. The fundamental difference of these two opinions is about an act as a political offense,one side assumes the other party would destroy the existing system, on the other hand is considered an act of rescue (hero).

Abstract

In the Indonesian justice system found three (3) judicial institutions authorized to settle economic disputes, the District Court, Commercial Court and the Court of Religion. With the presence of the three courts that settle economics disputes, it can also be compared the advantages and disadvantages from each judiciary in the resolution of economic disputes.Assessment implemented through legislation approach as normative legal research which is equipped with study of the principles of law, systematic legal, comparative law, and history of law.This paper find that the settlement of economics disputes through the Commercial Court is superior compared to the other court. Unfortunately, business dispute settlemet authority for the Commercial Court is still limited to bankruptcy issues and delays payment of debt obligations as well as certain disputes in the field of intellectual property rights. Considering the excellence of the Commercial Court in the resolution of economic disputes, it is better to extend the authority of the Commercial Court, including in the areas of tort and breach of contract for other business disputes.

Abstract

Marriage is a legal event when the marriage is a legal marriage. The development of science and technology that so rapidly bring the influence on the easier possibility of relations between human beings, between ethnic groups, and between countries in all aspects of life. One of the effects is mixed marriage phenomenon between spouses of different citizenship, including on Indonesian workers with foreign workers. Different nationalities marriage often raises a problem, especially related to the process of marriage registration that will take place, whether in the country of origin of a prospective husband or in the country of origin of a prospective wife. The procedure of mixed nationality marriage according to international civil law explains that marriage rules to different citizen pairs will use either law of the prospective husband’s State or law of the prospective wife’s State. The problems that arise in a mixed nationality marriage procedure are in the process of preparing a certificate from the marriage officer and at the preparing of the letter or other documents. Completion of the problems that arise in mixed marriages procedures that have prepared government is to provide clear information and website to couples who want to get married. For those who do not comply the rules will be imposed a sanction.

Abstract

One of the MSME-based social communities affected by the COVID-19 pandemic is the Gedog batik community in Kerek District, Tuban Regency. However, women in the Gedog batik community continue to face challenges in understanding and interpreting the COVID-19 pandemic. This study analyzes the social construction of women in the batik community during the COVID-19 pandemic. This study employs Peter L. Berger’s social construction theory, utilising a phenomenological approach. Qualitative research methods were employed in this study, utilising observation and in-depth interviews as data collection techniques with 20 research informants. The data analysis technique in this study uses data collection, reduction (data categorization), data visualization, and conclusion. This study found that the interpretation of women in the batik community towards the COVID-19 pandemic has a dichotomy that pretends to be positive and negative aspects. This is due to their subjective experiences with the COVID-19 pandemic and other health policies. In addition, socio-economic background, social environment, and technology adoption are fundamental bases that contribute to forming the social construction of women in the batik community. The social construction of the COVID-19 pandemic also reflects social processes manifested in practical actions, such as affirmation (positive) or resistance (negative).

Abstract

Artikel ini membahas konsep estetika yang digali dari tradisi tayuban, sindhir memiliki peranpenting dalam setiap pergelaran. Kehadiran masyarakat dituntun oleh pandangan ideal tentangsindhir, terpenuhinya hajat hidup melalui tradisi tayuban. Untuk itu penelitian difokuskanpada penuturan emik yang memaparkan tentang konsep estetika sindhir. Pengamatan langsungdilakukan terhadap peristiwa tradisi tayuban dimana sindhir memiliki peranan penting dalammembangun estetika dan dinamika tayuban. Wawancara mendalam, metode mendengarmenjadi sarana utama dalam menggali konsep estetika sindhir dalam tradisi tayuban. Daripenelitian yang dilakukan dapat dirumuskan bahwa dalam tradisi tayuban terdapat konsepkeindahan yang bersifat lahiriah, keindahan batiniah, dan keindahan illahiah. Konsepkeindahan lahiriah merupakan keindahan yang dibangun dalam tatanan indah inderawi.Keindahan batiniah melalui kekuatan intensitas batin melalui puasa dan doa keindahan illahiahmerupakan keindahan karena karunia illahi, diberkati oleh Tuhan. Konsep wiraga, konsep ayukebatinan, dan konsep angsar harus dibangun oleh sindhir melalui laku.Kata Kunci: Sindhir, Estetika, Tradisi Tayuban, Tayub Tuban

Abstract

Apart from having a socio-economic dimension, agrarian conflicts in Bongkoran, Banyuwangi Regency, East Java Province, Indonesia, also have a legal dimension. There is a dualism of law that is conflictual in terms of land tenure and use claims. One party, the government, and corporations rely on legalistic-positivistic state laws, while local people rely on folk law, namely informal laws that have existed, lived, and developed in communal society for generations. This research focuses on how the sociological perspective of law analyzes the legal conflicts that occur in Bongkoran agrarian conflict, particularly between state law and folk law. This research used a qualitative method with a legal sociology perspective. The research subjects were farmers/people of Bongkoran, Community Legal Advisors (CLA), Government (Local Government, National Land Agency, and Police), and corporate elements (PT Wongsorejo). Informants were selected using a purposive sampling technique, based on certain considerations that can be recognized beforehand, namely recognizing and understanding the problem under this research. Data collection was conducted through observation, in-depth interviews, and documentation. The collected data were analyzed qualitatively by referring to the perspectives that have been presented. The results indicated that the resolution of agrarian conflicts in Bongkoran requires the implementation of laws that are more just for local communities. The implementation of the laws is not only based on rigid articles in the law, but it needs attention to the socio-cultural and historical context of the community. The dominance of state law over folk law in agrarian conflicts results in the practice of subjugation of state law to folk law, both persuasively and repressively. Therefore, to minimize the tension and conflict between state law and folk law in agrarian conflicts, it is necessary to have a new understanding of the relationship between the two laws. The existence and enforcement of folk law are used as a complementary element in normative aspects that have not been regulated in state law.
