Abstract

Peneliti memiliki tujuan untuk mengetahui faktor-faktor bagaimana peran inovasi Polres Situbondo dalam melakukan kegiatanya dalam meminimalisir tindak pidana pencurian. Metode penelitian ini menggunakan kualitatif (field research) dengan pendekatan yuridis empiris dimana mengacu kepada undang-undang yang berlaku dalam kehidupan masyarakat. Lokasi penelitian ini dilakukan di Polres Situbondo. Hasil penelitian menunjukkan terjadinya tindak pidana pencurian kendaraan bermotor dapat berasal dari faktor intern dan faktor ekstern. Upaya penanggulangan terahadap tindak pidana pencurian kendaraan bermotor dilakukan dengan penerapan manajerial dalam kegiatan penyidikan yang dilaksanakan kepolisian, penerapan upaya preventif dan represif sebagaimana upaya represif diatur dalam pasal 362 KUHP. Dengan mengacu kepada angka kejahatan dari tahun 2019-2022 mencapai 61 kasus, maka perlu untuk melakukan penceggahan dengan upaya inovasi konsep dalam bidang pelayanan, menjaga keamanan, keyamanan dan ketentraman, beberapa penyebab terjadi pelaku melakukan tindak pidana kejahatan yaitu didorong oleh beberapa faktor, ekonomi, budaya dan sosial yang dapat menyebabkan seseorang melakukan tindak pidana pencurian kendaraan bermotor dan upaya apa saja yang dapat dilakukan untuk menekan tindak pidana pencurian kendaraan bermotor (curanmor) di Polres Situbondo.

Abstract

In this study, the author will present a unique phenomenon about the marriage process in Kedungdowo Village, Arjasa District, Situbondo. In this society, when getting married, the groom will bring a set of household tools to present to the prospective bride. This is not a request from the bride but because of the customary factor. The items they carry are very many such as chairs, tables, cupboards, and others. Then the concern of the researcher is when their marriage relationship breaks up in the middle of the road or is divorced then what happens? Before we continue the results of this study, that this research is field with a qualitative approach. The focus of the discussion is how the above incident is viewed from the perspective of Islamic law and positive law or the Civil Code. And in extracting the data sources of researchers Then in looking for data sources, the authors use primary data sources in the form of: observations, interviews, and documentation. And the author will also optimize secondary data, namely additional data such as from books, books and others. From the analysis and studies conducted by the researchers, it can be concluded that: In Islamic law, it is permissible to withdraw the property given by a husband to his wife after a divorce in Kedungdowo Village, Arjasa Situbondo District, because the gift does not include a grant. And in Positive law, grants may be withdrawn if they have fulfilled the three things mentioned in the Civil Code article 1688.

Abstract

Narcotics abuse is a criminal offense in Indonesia that is still predominantly addressed through a repressive legal approach, without clear distinction between users and traffickers. In practice, many narcotics abusers, who are essentially victims of addiction, are sentenced to imprisonment without consideration for rehabilitation alternatives. This study aims to examine the application of the restorative justice concept in handling narcotics abusers in Indonesia and to assess its effectiveness as an alternative to imprisonment. This research employs a normative juridical method with a statutory approach and a case study of Denpasar District Court Decision Number 1030/Pid.Sus/2024/PN Dps. The findings indicate that, normatively, the application of restorative justice for narcotics abusers has a legal basis through Law Number 35 of 2009, the Indonesian Attorney General’s Regulation Number 15 of 2020, and the Indonesian National Police Regulation Number 8 of 2021. However, its implementation in practice remains suboptimal due to the absence of integrated assessment requests, the persistence of retributive legal paradigms, and limited inter-agency coordination among law enforcement institutions. Therefore, legal policy reform oriented toward the recovery of abusers through systematic rehabilitative and restorative approaches is urgently needed.

Abstract

Service is an act to provide comfort to customers. Good service is a service that is economically profitable and procedurally easy and enjoyable as a separate image for BMT progress by showing truly satisfying performance to customers. So it can be said that service quality has considerable influence in determining customer interest in using services which in this case is saving. Even though the desired expectations for satisfying customers from good service are not as easy as imagined. because customers do not always tell about their wishes about things that exist in the BMT structure, unless we watch ourselves and anticipate various kinds customer mindset. To facilitate understanding in this study, the researchers used qualitative research methods. By multiplying digging data sources from various literature relating to good service procedures. The data obtained by researchers in the field included interviews with the leadership of the BMT NU Guluk-Guluk Sumenep Branch to find out the service system implemented by the BMT NU. In addition, data collection techniques were carried out by researchers by means of interviews, observation and documentation. In this study, the presence of researchers is very important because researchers are human instruments as well as data collectors.

Abstract

Islamic microfinance offers an alternative, ethical approach to financial inclusion, especially for marginalized populations traditionally excluded from conventional banking systems. In the Caribbean context, where economic disparities persist and Muslim minorities face systemic challenges, the potential for Islamic microfinance remains underexplored. This study investigates the role of Islamic microfinance in empowering marginalized Muslim and non-Muslim communities in Trinidad and Tobago. The research employs a qualitative case study approach, combining semi-structured interviews with microfinance practitioners, community leaders, and beneficiaries across three local institutions offering Shariah-compliant financial services. Findings reveal that Islamic microfinance models—particularly those based on qard al-hasan (benevolent loans) and murabaha (cost-plus financing)—are perceived as more culturally inclusive, trust-based, and ethically appealing than their conventional counterparts. However, institutional limitations, lack of regulatory clarity, and insufficient awareness among beneficiaries restrict broader scalability. The study concludes that Islamic microfinance, when locally adapted and supported by policy and education, holds significant promise for advancing socio-economic empowerment in Caribbean plural societies. This case contributes to the growing discourse on Islamic social finance in non-Muslim-majority regions and highlights its relevance in fostering inclusive development models.

Abstract

Poverty remains a critical challenge in many Muslim-majority communities, where conventional welfare and microfinance programs often fail to achieve sustainable economic empowerment. Islamic social finance instruments, including zakat and waqf, offer alternative mechanisms to address both immediate needs and long-term income generation. Integration of these instruments within microfinance programs presents an opportunity to create ethically aligned, sustainable interventions for economically marginalized households. The study aims to evaluate the effectiveness of combined zakat-waqf microfinance programs in enhancing household income, savings, and asset accumulation, while assessing institutional governance and operational sustainability. The research seeks to provide evidence-based guidance for designing integrated Islamic social finance initiatives that promote long-term poverty alleviation. A mixed-methods approach was employed, including quantitative assessment of 150 participating households, analysis of financial records, and qualitative interviews with beneficiaries and program administrators. Statistical analyses, including income growth measurement, savings accumulation, and repayment performance, were combined with thematic evaluation of governance and operational challenges to provide a comprehensive assessment of program impact. Results indicate that integrated zakat-waqf programs significantly increase household income by 25–28%, improve productive asset acquisition, and maintain high repayment rates above 92%. Findings demonstrate that combining short-term relief and long-term investment creates sustainable poverty alleviation. Integrated programs enhance financial inclusion, empower beneficiaries, and provide a replicable model for ethical microfinance.
