Abstract

Judicial decisions must have legal implications for relevant parties. PMK No. 2/PUU-XIX/2021 remains debatable between creditors and debtors because it seemingly weakens the protection of creditors' rights. Creditors cannot immediately carry out enforcement procedures that cut off the creditor's business flow because the position of the subject of fiduciary obligations is in the debtor's control, making it possible for disputes between debtors and creditors. This normative legal research was conducted using a philosophical, juridical approach covering statutory policies, conceptual and case approaches. PMK No. 2/PUU-XIX/2021 does not regulate creditor legal provisions in enforcing fiduciary securities, making it difficult for creditors to execute them. The Constitutional Court should decide to guarantee justice for all parties and provide a decision with clear content and sentence structure, so multiple interpretations will not occur. The execution of fiduciary securities during the Covid-19 pandemic should not be immediately carried out because the creditor had to follow the predetermined procedures.

Abstract

The popularity of the creative industries continues to rise around the world, both among consumers and entrepreneurs who are due to a variety of factors, including technological advances and changes in consumer behavior. Malang City has also been recognized as one of the cities that has great creative economic potential. The direction of development of Malang City is also increasingly clear leading to strengthening its status as a creative economy city marked by three milestones. To build an optimal industrial ecosystem in the creative economy sector, especially in Malang City, requires a hexahelix synergy approach which refers to cooperation between six entities in developing a better and sustainable innovation ecosystem. Collaboration between industry and academia has a very strategic role because it can provide significant benefits for the quality of innovation and research development of the creative industry. The government also strongly encourages academics to collaborate with industry, government, media, and society, where various programs are directed to encourage collaboration between universities and industry to conduct joint research and development. A concrete example is the existence of an independent research center called ISDEI (Intelligent Systems and Digital Economic Innovation) which has collaborated for research and community service. With great academic research potential with the existence of more than 50 higher education institutions, the Association of Creative Economy Academics (AACE) is committed to being an aggregator in the creative economy ecosystem at the Malang Creative Center (MCC) that synergizes academic activities from academics with creative industry players, the Malang City government, and the creative economy community in Malang City.

Abstract

Creative Economy SMEs (Small and Medium Enterprises) Indonesia, as part of micro, small, and medium enterprises, play a vital role in the national economy with their creative and innovative value addition. This sector encompasses 17 subsectors, including culinary, film, and applications. Malang City, recognized as one of Indonesia's creative cities, exhibited significant growth with 12,345 creative economy MSMEs in 2022, a 10.5% increase from the previous year. The three dominant subsectors are culinary, applications and games, and film, video, and animation. However, MSMEs in Malang face challenges such as lack of capital, low product quality, unappealing packaging, and difficulty in reaching markets. To address these issues, an innovative collaboration platform has been developed, connecting MSMEs with communities, investors, academics, and the government. Through these efforts, MSMEs are expected to enhance competitiveness, product quality, and market access, supporting sustainable growth in the creative economy sector.

Abstract

Today the growth of the business world is growing so rapidly, it is also supported to expand the business which is more varied, including through franchise (Franchise). Which of these principles for some entrepreneurs is considered more effective, effective and profitable in the development of a business. In Indonesia, the regulation of franchises is based on agreements made by the parties on the basis of the applicable law, in this case the Government Regulation and the Minister of Trade Regulation. Franchise is a form of business that gets a lot of attention from business people, because it can be one way to increase economic activity and give opportunity to weak economic class to try, this means, Franchise can provide job opportunity, equality and also create field work for the community. In addition, the profits of this business are low cost and the materials already provided are also not too take place so vast, franchise recipients no longer need to bother developing their business by building a good and famous image. It is enough to ride on the famous fame of the franchisor, so franchisees who are generally small entrepreneurs will enjoy the success and luck of large-scale companies without having to carry out their own research and development, marketing and promotion that usually requires enormous expenses that the small businessman is unlikely to bear.

Abstract

Dewasa ini bisnis ritel tumbuh luar biasa, seperti dapat kita lihat munculnya alfamart, indomart, alfamidi sampai ke pelosok-pelosok desa. Tatashop merupakan unit usaha bersama yang tergabung dalam UD Sumber Dagang Sejahtera dibidang Jasa, jual beli dan penyediaan barang kebutuhan pokok secara eceran dan grosir yang mafhum dikenal sebagai usaha ritel, dengan sumber daya yang terbatas, produk sampai pada pola pemasaran yang mereka hasilkan masih secara sederhana dan belum dilengkapi dengan kelengkapan administratif dan teknologi informasi yang dibutuhkan agar bisa menjangkau pasar secara luas. Untuk menyikapi persaingan usaha yang semakin kompetitif maka dipandang perlu untuk memberikan pendampingan agar unit usaha ritel dalam hal ini adalah pelaku usaha umkm dapat terus bersaing dan dapat membuka lapangan pekerjaan lebih luas dengan pendekatan hukum bisnis dan manajemen sumber daya manusia.
