Abstract

This study intends to identify the epistemology of the Fatwa of the Indonesian Ulema Council on the monasticism of money politic. Qualitative research in the form of literature studies uses a normative-philosophical approach. The primary data of this study is in the form of a document of the Ijtima' Ulama Decree of the Indonesian Fatwa Commission in 2018. Secondary data uses a variety of correlative scientific literature with a focus on discussion. The theory of idealism and the realism of Islamic law became the theory of analysis of this research. Data collection through documentation. Meanwhile, data analysis goes through the stages of data reduction, data presentation, and data verification. This research shows the epistemological construction of the fatwa of the Indonesian Ulema Council on the political monastery of money not only based on the idealistic-normative-deductive epistemology of Islamic law, but also emphasizes the aspects of Islamic legal realism in the form of considerations about the effectiveness of the fatwa in the midst of community life. The theoretical implications of this study show that the provisions of Islamic law (fatwa) related to the prohibition of money politics require considerations of legal formulations that do not only refer to normative idealism of law, but also legal realism. The limitations of this study have not identified the method of interpretation of the Indonesian Ulema Council on various theological foundations of monasticism of money politics.

Abstract

Akal merupakan salah satu alat atau sarana yang sangat penting bagi manusia. Di samping sebagai alat untuk pengembangan ilmu pengetahuan yang sangat dibutuhkan manusia dalam kehidupannya, akal merupakan salah satu persyaratan mutlak adanya taklif (hukum) yang dibebankan kepada manusia. Bahkan, dalam pandangan Islam akal merupakan salah satu piranti metode dalam mengistinbath hukum Islam yang diistilahkan dengan Ijtihad. Islam menjadikan akal sebagai salah satu diantara lima hal primer yang diperintahkan oleh syariat untuk dijaga dan dipelihara (hifzhu ad-daruriyyat al-khams), dimana kemaslahatan dunia dan akhirat disandarkan pada pemeliharaan kelima unsur tersebut, yaitu: agama, jiwa, akal, keturunan, dan harta. Tulisan ini bertujuan untuk mengkaji lebih jauh tentang konsep akal dalam Islam dan relasinya dengan pendidikan Islam khusunya pada pembelajaran Fiqih.Dengan menganalisis berbagai sumber literatur keislaman melalui metode deskriptif penulis mencoba menyajikan pembahasan topik ini meliputi: definisi dan hakikat akal, relasi akal, otak dan nafsu manusia, dan fungsi pendidikan terhadap pengembangan akal, fiqih berbasis nalar manhaji.

Abstract

As the global world develops rapidly and massively, there is a delay in Islamic law in responding to contemporary problems. In relation to Indonesia, many implementations of developments over time have resulted in new jurisprudence and institutions. This research uses normative research methods using libraries (library research) with descriptive qualitative analysis of materials. Reformulation in Islamic law is not westernization which is contrary to Islam (laws that are absolute). Recently, Muslims have shown their de facto lack of ability to meet the demands of the modern world creatively. The main things in contemporary ijtihad are, firstly, methodology, secondly operations. These two ingredients must work in synergy and integrity with each other to produce contextual fiqh. The orientation of contemporary ijtihad is not just contemporary fiqh, but also the development of dawabit al-fiqhiyyah. In the Indonesian context, the implementation of contemporary ijtihad is felt in various fields, especially law in Indonesia.. In conclusion, the implementation of contemporary ijtihad including: 1)Fatwa institutions, 2)Religious Courts, 3)Compilation of Islamic Law, 4)Office of Religious Affairs, 5)Sharia Economics, 6) Zakat Institutions, 7)Halal Labels, 8)Indonesian Fiqh, 9)Medicine, 10)Gender Equality.
