Abstract

Jumhur ulama berpendapat bahwa walīmah al-‘urs hukumnya sunnah mu’akkad. Namun demikian, ada juga sebagian ulama memandang wajib, pendapat ini dipegang oleh Ibn Ḥazm al-Andalusī. Penelitian ini secara khusus menelaah pemikiran hukum Ibn Ḥazm al-Andalusī yang mengatakan hukum wajib melaksanakan walīmah al-‘urs. Dalam konteks ini, Ibn Ḥazm al-Andalusī cenderung memahami dalil-dalil hadis sebagai dasar hukum perintah wajib melaksanakan walīmah al-‘urs. Fokus penelitian ini adalah: Bagaimana pandangan Ibn Ḥazm tentang hukum melaksanakan walīmah al-‘urs?, dan Bagaimana dalil dan metode istinbāṭ yang digunakan Ibn Ḥazm dalam menetapkan hukum walīmah al-‘urs?. Dalam penelitian ini penulis mengunakan penelitian kepustakaan (library research). Dalam menganalisis data, penulis menggunakan metode kualitatif dengan menggunakan cara analisis normatif. Setelah melakukan analisa mendalam terhadap fokus penelitian, penulis dapat menyimpulkan menurut Ibn Ḥazm, pelaksanaan walīmah al-‘urs hukumnya wajib dan disesuaikan dengan kemampuan. Dalil yang digunakan Ibn Ḥazm mengacu pada tiga riwayat hadis. Pertama hadis qawliyyah riwayat Muslim dari Yaḥyā bin Yaḥyā al-Tamīmī terkait perintah Rasulullah SAW untuk melaksanakan walīmah al-‘urs walaupun hanya sekadar satu ekor kambing. Kemudian, kedua hadis fi’liyyah riwayat Muslim dari Abī Bakr bin Abī Syaibah dan riwayat al-Bukhārī dari Muḥammad bin Yūsuf terkait Rasulullah SAW melaksanakan walīmah al-‘urs. Terhadap pendapat dan dalil hukum yang digunakan Ibn Ḥazm, pola penalaran yang ia gunakan ialah cenderung pada metode istinbāṭ bayānī, yaitu melihat sisi kaidah kebahasaan pada lafaz “أَوْلِمْ” dalam matan hadis riwayat Muslim “أَوْلِمْ وَلَوْ بِشَاةٍ”. Lafaz tersebut menurut Ibn Ḥazm merupakan lafaz amar perintah yang mengandung indikasi hukum wajib. Selain itu, pola penalaran istinbāṭ bayānī juga terlihat pada saat Ibn Ḥazm memandang hadits fi’liyyah Rasul SAW harus didukung dengan petunjuk dalil qawliyyah, sebab perbuatan Rasulullah SAW melaksanakan walīmah al-‘urs tidak dapat dijadikan hujjah wajibnya walīmah al-‘urs, kecuali adanya petunjuk dalil hadis lain yang memerintahkannya. Pola penalaran semacam ini mengarah pada metode istinbāṭ bayānī.

Abstract

Abstract: Constitutional Decision Number 46/PUU-XIV/2016 raises various views. The decision rejected a request for an expansion of Article 292 of the Criminal Code on homosexuals. Regarding this problem, what are the provisions of Decision No. 46/PUU-XIV/2016 regarding homosexual crimes, how and the considerations of the Constitutional Court judges in deciding homosexual criminal cases in Decision Number 46/PUU-XIV/2016, and how Islamic criminal law regarding homosexual crimes in the Constitutional Court Decision Number 46/ PUU-XIV/2016. This research is analyzed by means of descriptive-analysis. The result of the research is that the provisions of homosexual crime in Article 292 of the Criminal Code regulates same-sex sexual abuse, or obscenity in the category of homosexuals. The Constitutional Court Decision Number 46/PUU-XIV/2016 in principle contains a request to expand the scope of Article 292 from previously only adults with children to adults with adults. There are three reasons and also the considerations of the judges of the Constitutional Court in deciding cases of homosexual crimes in Decision Number 46/PUU-XIV/2016, namely juridical considerations regarding the criminal policy or criminal policy, juridical considerations on the application of the principles of legality and consideration of the substance of the petition. Article 292 of the Criminal Code against Article 1 paragraph (3), Article 28D paragraph (1), and Article 28G paragraph (1) of the 1945 Constitution. From the perspective of Islamic criminal law, the Constitutional Court's decision is not in harmony, or at least has not been able to apply legal aspects criminal law based on religious norms and moral norms.Abstrak: Putusan Mahkamah Konstitusi Nomor 46/PUU-XIV/2016 memunculkan ragam pandangan. Putusan tersebut menolak permohonan pemohon salah satunya tentang perluasan Pasal 292 KUHP tentang homoseksual. Terhadap masalah tersebut, bagaimana ketentuan Putusan No. 46/PUU-XIV/2016 tentang tindak pidana homoseksual, bagaimana alasan dan pertimbangan hakim MK dalam memutus perkara tindak pidana homoseksual dalam Putusan Nomor 46/PUU-XIV/2016, serta bagaimana tinjauan hukum pidana Islam tentang tindak pidana homoseksual dalam Putusan MK Nomor 46/PUU-XIV/2016. Penelitian ini analisis dengan cara deskriptif-analisis. Hasil penelitian bahwa ketentuan tindak pidana homoseksual dalam Pasal 292 KUHP mengatur tentang pencabulan sesama jenis, atau pencabulan kategori homoseksual. Putusan MK Nomor 46/PUU-XIV/2016 pada prinsipnya berisi permohonan untuk memperluas cakupan Pasal 292 dari sebelumnya hanya orang dewasa dengan anak-anak menjadi orang dewasa dengan orang dewasa. Terdapat tiga alasan dan juga pertimbangan hakim Mahkamah Konstitusi dalam memutus perkara tindak pidana homoseks dalam Putusan Nomor 46/PUU-XIV/2016, yaitu pertimbangan yuridis terhadap kebijakan kejahatan pidana atau criminal policy, pertimbangan yuridis terhadap penerapan asas-asas legalitas dan pertimbangan substansi permohonan atas Pasal 292 KUHP terhadap Pasal 1 ayat (3), Pasal 28D ayat (1), dan Pasal 28G ayat (1) UUD 1945. Dilihat dari kaca mata hukum pidana Islam, putusan MK tidak selaras, atau sekurang- kurangnya belum mampu menerapkan aspek hukum pidana yang didasari norma hukum agama dan norma susila.

Abstract

The people of Banda Aceh City were shocked by the emergence of online-based gambling, namely the higgs domino game. Statistically, there are 3 cases of higgs dominoes that occurred in the people of Banda Aceh City in 2021 and 2022, there are as many as 3 cases that have been heard and have even been executed by whips. However, not a few of the players of this game are free from legal snares or not tracked massively. This fact raises academic anxiety, especially how the game indicators fall into the gambling category or not, especially in the perspective of Islamic Law. This research is a qualitative type through literature studies and field studies with a descriptive analysis approach. Data collection was carried out by observation, interviews, documentation and literature studies by compiling literature sources, both primary and secondary. The results of this study state that; Judging from the Islamic Criminal Law, the higgs domino online game has fulfilled the three elements of gambling (maisir), namely the element of the game being played, the element of profit and the element of betting at stake is chips (virtual coins)

Abstract

Riba hutang piutang yakni penerapan riba berupa tambahan, manfaat atau tingkatan lebihan tertentu yang diprasyaratkan terhadap pihak yang berhutang sedari awal atau tambahan hutang nantinya dibayar lebih besar daripada harta pokoknya akibat si penghutang tidak mampu melunasi hutangnya sampai jatuh tempo. Sedangkan Jenis riba jual beli sangat mungkin terjadi pada pertukaran komoditi tertentu yaitu emas, perak, gandum, tepung kurma dan garam sesuai dengan hadits Rasulullah Saw. Pada riba hutang piutang ulama berbeda pendapat. Pendapat pertama bahwa semua tambahan dari pokok pinjaman yang disyaratkan sebelumnya adalah riba dan hukumnya haram karena illat yang terdapat di dalamnya, sama dengan illat riba yang terdapat dalam Al-Qur‟an. Pendapat kedua bahwa tambahan dari pokok pinjaman seperti bunga bank konvensional adalah boleh, selama tidak mengandung unsur- unsur kezaliman dengan melakukan qiyas berdasarkan hikmah, bukan illat. Keterbatasan nash dalam menjelaskan komuditi lain selain barang ribawi menjadikan ijtihad sebagai keniscayaan untuk menangkap pesan-pesan Al- Qur’an dan sunnah. Para Ulama menggali illat hukum (rasio logis) dan tujuan yang dikandung hukum yaitu pencapaian kepada kemaslahatan atau penolakan terhadap kemudharatan sehingga dapat disamakanlah furu’ (cabang) yang tidak ada nashnya kepada asal yang sudah ada nash mengenai hukumnya.

Abstract

Zakat merupakan salah satu rukun Islam. Praktek pelaksanaannya tidak terlepas dari tuntunan syara’. Tujuan zakat adalah menghilangkan kemiskinan yang terjadi dan menjamin hidup seluruh masyarakat khususnya muslim. Zakat bertindak sebagai alat yang diberikan Islam untuk menyadarkan akan tanggung jawab sosial bagi orang yang memiliki harta berlebih terhadap orang dibawahnya. Mazhab Syafi'i dalam literaturnya tidak ada yang membahas secara eksplisit tentang pendistribusian zakat secara produktif. Namun demikian ada dua orang tokoh mazhab Syafi'i yaitu Imam Abu Ishaq Asy-Syirazi dan Imam an-Nawawi dalam pembahasan kitabnya mengindikasikan kebolehan zakat didayagunakan (produktif) dengan persyaratan-persyaratan tertentu. Distribusi zakat di Indonesia ada dua jenis yaitu distribusi secara konsumtif dan distribusi secara produktif. Selama ini dalam prakteknya pendistribusian zakat masih lebih didominasi oleh pendistribusian zakat secara konsumtif. Dengan adanya batasan persyaratan sebelum pendistribusian zakat produktif oleh kedua ulama ini, zakat yang diberikan dapat didayagunakan hingga zakat itu menjadi tumbuh dan berkembang terus-menerus, dan hal ini akan menjamin kelangsungan hidup perekonomian kedepannya. Pendapat yang dikemukakan oleh kedua murid Imam Syafi’i ini sangat relevan sesuai dengan kebutuhan masyarakat pada masa kini, karena dengan produktifitas zakat ini diharapkan dapat mengubah tatanan perekonomian masyarakat secara luas dan menghilangkan kemiskinan dan menjamin kehidupan masyarakat menjadi lebih makmur, sesuai dengan fitrah yang Allah berikan kepada setiap manusia. Dengan demikian tujuan disyariatkannya zakat akan tercapai yaitu: zakat akan terus tumbuh dan berkembang

Abstract

Criminal acts of illegal mining in East Labuhahaji District, South Aceh, continue to be carried out by the community without paying attention to the negative impacts on the surrounding environment, which can result in losses for the benefit of the community. This article aims to analyze the factors and impacts of illegal gold mining on the environment of the people of Labuhan Haji Timur District, South Aceh Regency, in terms of environmental fiqh. Data was obtained through interviews and analyzed critically. The research results show that the factors causing people to carry out illegal gold mining in East Labuhanhaji District are low economic life and community education, minimal socialization regarding mining prohibitions, and minimal public awareness of religious values regarding environmental damage. Illegal gold mining has a negative impact in the form of deforestation, making it prone to flooding and damage to plantation land. Judging from environmental fiqh, the criminal act of illegal gold mining in Labuhan Haji Timur District, South Aceh Regency, is an act of jihad that is contrary to Islamic law because it hurts environmental damage and the benefit of the community at large. Therefore, in Islamic law, illegal gold mining can be subject to sanctions in the form of ta'zir.

Abstract

Triple talaq (Third Divorce) at once is a prominent topic in Islamic jurisprudence that continues to be of great interest to modern academics, including Yusuf Al-Qaradawi. Yusuf Al-Qaradawi holds a divergent perspective from the majority of ulama who regard the law on maximum talaq at once as equivalent to triple talaq (the one mentioned three times). This research seeks to analyze Yusuf al-Qaradawi's perspectives on triple talaq at once by employing the sadd al-żarī'ahtheory. This study employs a normative legal approach, utilizing the sadd al-żarī'ah theory for descriptive and analytical analysis. According to Yusuf al-Qardhawi,  maximum talaq at once is illegal due to its non-compliance with the commandments of Islamic law. The process of divorce should follow several steps, including the initial divorce, followed by the iddah period, and then the possibility of reconciliation. The second or third divorce procedure can be pursued if reconciliation is not achieved. The argument presented relies on the historical account of Imam Muslim from Ibn Abbas, which elucidates that the occurrence of maximum talaq at once throughout the era of the Prophet, Abu Bakr, and the first two years of Umar's caliphate was seen as a single talaq. Ibn Wahhab's historical account of Al-Nasa'i documents the incident where the Messenger of Allah declined to listen to the news of a maximum divorce being pronounced simultaneously. The historical account of Abu Dawud, as related by Nafi', documented the divorce of Rukanah from his wife, which eventually reached the Messenger of Allah. According to Yusuf Al-Qaradawi, the immediate restriction of the maximum talaq at once is an attempt to conceal the harm caused. The fundamental principle of sadd al-żarī'ah's theory posits that every action that is forbidden by the Qur'an and hadith is intended to hinder the occurrence of harm or wrongdoing.

Abstract

Online Service lending has become a widely used financial product due to its accessibility, including in Aceh, which has implemented Qanun Number 11 of 2018 concerning Islamic Financial Institutions that prohibits interest-based lending practices. Therefore, this study focuses on the supervision of conventional online lending conducted by the government in Aceh following the implementation of Qanun Number 11 of 2018. This research adopts a descriptive method with data collected through interviews. The findings indicate that, to date, conventional online service lending (pinjol) operations in Aceh remain unrestricted, with no limitations imposed on their activities. In Aceh, stakeholders have yet to take concrete measures to curb or prohibit conventional online lending practices. Consequently, many consumers in Aceh, including educated individuals such as teachers and students, as well as the general public, have been trapped in debt and faced payment defaults. Therefore, strategic actions are required from both the Aceh government and religious scholars (ulama) to collaborate and synergize with relevant institutions such as the Financial Services Authority and Bank Indonesia to curb conventional fintech practices in Aceh, in accordance with the provisions outlined in Qanun Number 11 of 2018 on Sharia Financial Institutions in Aceh
