Abstract

Freedom of religion and belief has long been accepted globally as human rights. This right is formally enshrined in international human rights instruments such as the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights. Indonesia has also adopted these international human rights instruments in its policies and implementation in the applicable laws as seen in the inclusion of this right in the 1945 Constitution, Law no. 39 of 1999 and Law no. 12 of 2005. However, in practice, this right is often violated by the state and civil society either by action (commission) or by omission.  This study also shows religious intolerance, radicalism, and fundamentalism are the manifestations of real challenges in promoting unity in diversity in the country. Therefore, this study recommends the Indonesian government to: review some its policies that are contrary to international and national human rights instruments; cancel lower legal products that are contrary to the 1945 Constitution and other laws; take legal action to suppress and prevent radical and intolerant groups from carrying out violence, discrimination and persecution against certain religious minorities; restore the rights of groups or individuals that have been violated in relation to the freedom to practice or adhere to their respective religions; and improve religious tolerance and moderation education in formal and non-formal educational institutions.Keywords: kebebasan beragama; hak asasi manusia; instrumen HAM; intoleransi; toleransi; kekerasan; moderasi beragama.

Abstract

ABSTRACT:This article talks about the problem of violence against women in the Maumere and Larantuka dioceses, Flores, NTT and how religion (Catholic Church) functions in dealing with it. The aim is to identify the forms of violence, their causes and effects in both dioceses and what the function of religion (Catholic Church) is to prevent and deal with these problems. Interview methods, focused group discussions (FGD) and document studies were used to collect data, while descriptive qualitative analysis was used for data analysis. The results show that violence against women is found in both areas of the diocese with physical, psychological, verbal, economic, cultural-based and online violence. The Catholic Church through the Diocesan Commission on Gender and Women's Empowerment carries out educational, control, fraternal, and transformative functions. This is done in direct collaboration and through networks with multi-stakeholders, although this is not sufficient. This study recommends the importance of strengthening institutional capacity and increasing network collaboration. KEYWORDS: Commission on Gender and Women's Empowerment, institutional capacity, network collaboration, violence against women, women empowerment.

Abstract

This article describes and analyzes human trafficking in East Nusa Tenggara Province (NTT) based on the news/data exposed by two local newspapers, Pos Kupang and Flores Pos, during the past four years (2010-2013). Employing media analysis (content analysis), the exploration of various news items on human trafficking in the two newspapers shows a significant increase in the number of cases in the province. Victims are mostly poor, of different ages but mainly women and children. Many agents played an important role and have employed various modes for recruiting victims. The main root of human trafficking in NTT is the system which allows the agents/actors of recruitment of migrant workers (PJTKI) to operate illegally in the province; individuals are victims of this system of recruitment. This study recommends that there should be a significant change in the system of recruitment and control in the NTT province in particular, and in Indonesia in general, to prevent and overcome the problem of human trafficking along with other efforts to empower the local people economically, socially and culturally by enhancing their knowledge, skills and mentality so that they are able to defend their own rights when being victimized by recruiters, whether individual agents or recruiting companies. Abstract

Free-rider is one of the problems faced in many social movements. The problem is with those who benefit much from a social movement while never investing, or invest very little, into the movement; meanwhile those who invest and sacrifice much get almost nothing from it. This study is an attempt to explore whether or not there is a free rider phenomenon in the Reformation Movement in Indonesia. The findings of studies show that the Reformation Movement did not bring about significant change for most people in Indonesia except for the free riders: the politicians, top military officials, and big corporations (entrepreneurs) who were once part of the previous Suharto Regime. This study suggests that there should be change in the strategies and tactics of the movement to prevent a free rider problem and give more opportunities to people at the grassroots to benefit from the movement. Abstract

This article focuses on identifying social capitals in preventing and handling religious intolerance in West Sumbaand Belu Regencies of NTT Province. Using qualitative approach, descriptive analysis, and employing interviews,and focused group discussions as methods of data collection, this study found that social capitals play a very crucialrole as social bounding in all communities in the three regencies. These social capitals include values such asopenness and willingness to accept others and differences, upholding unity and brotherhood, and traditional norms,customs (including kinship ties), symbols and language; the role of religious leaders, community leaders, traditionalleaders, interreligious harmony forums (FKUB), and youth forums. All of these social capitals become a force thatstrengthens tolerance and prevents intolerance in the three regencies. The implication is that Indonesia as a wholeand other parts of Indonesia can identify and use social capitals to strengthen tolerance and prevent intoleranceamong the people living in multicultural context.Keywords: social capital, intolerance prevention, social bonding, social bridging, social linking.
