Abstract

Notary is a public official who has the authority to make authentic deeds and has other authorities as referred to in Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notary. Notary as a capital market supporting profession to be able to make authentic deeds, and carry out activities in the capital market sector must first be registered with the Financial Services Authority (OJK), meet the requirements, and fill out an application for registration of a notary as a capital market supporting profession in the attachment to the Financial Services Authority regulations (OJK) Number 67/POJK.04/2017 Concerning Notaries Conducting Activities in the Capital Market. According to Article 1868 of the Civil Code, an authentic deed is a deed which, in the form determined by law, is made by or before public officials who have the power to do so at the place where the deed was made. The Authority of a Notary in Providing Legal Counseling for Making Deeds Based on the Notary Office Act (UUJN), a notary must educate the public or the parties who will draw up a deed before a notary regarding the rights and obligations of each party.

Abstract

Penelitian ini membahas tentang tugas dan kewenangan notaris terhadap keabsahan dokumen legalisasi waarmerking dan legalisir berdasarkan undang-undang yang mengaturnya, sehingga mempunyai kekuatan hukum pembuktian yang sempurna. Tujuan penelitian ini untuk mengetahui tentang keabsahan dokumen sebagai tanda bukti bahwa dokumen yang ditandatangani oleh para pihak sudah sesuai dengan adanya kebenaran. Penelitian ini menggunakan metode penelitian yuridis normatif dimana jenis pendekatannya melalui pendekatan perundang-undangan dan berfokus pada hukum positif berupa Undang-Undang Kitab Hukum Perdata (KUHPerdata) dan Undang-Undang Jabatan Notaris (UUJN) yang didalamnya mengkaji peraturan perundang-undangan yang mengatur dan membedakan pengertian dari legalisasi, waarmerking, dan legalisir pada akta notaris untuk mewujudkan kepastian hukum bagi para pihak terhadap keabsahan dokumennya. Hasil pembahasan menjelaskan bahwa tugas dan kewenangan notaris bukan hanya untuk membuat akta autentik namun juga memiliki wewenang untuk mengesahkan tanda tangan dan menetapkan kepastian tanggal Surat dibawah tangan dengan mendaftarkannya ke dalam buku secara khusus. Kesimpulan Penelitian menjelaskan bahwa Notaris adalah pejabat umum yang berwenang untuk membuat akta autentik dan kewenangan lainnya, selain itu kewenangan lainnya Notaris dapat mengesahkan tanda tangan dan menetapkan kepastian tanggal Surat di bawah tangan dengan mendaftarkan dalam buku khusus dengan cara (legalisasi) dan notaris dapat pula menerima pendaftaran atas akta yang sudah ditanda tangani oleh para pihak.

Abstract

This study aims to analyze the legal status of joint property that has not been divided after divorce when one of the parties passes away, as well as to examine the judge’s ratio decidendi in Decision No. 520/Pdt.G/2022/PN.DPS concerning the distribution of joint property and inheritance. The research method used is normative juridical research with statutory, conceptual, and case approaches. Legal materials were obtained through library research and analyzed qualitatively using legal interpretation methods. The novelty of this study lies in the analysis of the relationship between the distribution of joint property after divorce and the distribution of inheritance in childless marriages, particularly when the joint property has not been separated before one party dies. Based on the results of the study, it is concluded that joint property must first be separated before the inheritance distribution is carried out. The analysis of Decision No. 520/Pdt.G/2022/PN.DPS shows that the judges recognized the existence of joint property and the rights of the second ex-wife; however, the direct division into two portions was not fully in accordance with the legal construction of the Civil Code because the joint property should first have been separated, after which the deceased’s share should have been proportionally distributed among the heirs in order to ensure legal certainty and justice for the parties.
