Abstract

This research aims to analyze the impact of the Freedom to Learn-Independent Campus (MBKM) Program on students' rights in the context of higher education in Indonesia. The MBKM Program is expected to bridge the gap between education and industry, providing students with opportunities to develop practical skills. However, this research identifies several challenges faced by students, particularly concerning their legal status as interns and the protection of their labor rights. The research employs a qualitative analysis method with a case study approach, which includes interviews and the collection of secondary data from relevant documents and reports. The findings indicate that although the MBKM Program offers significant benefits in enriching students' learning experiences, the current regulations remain unclear and lack sufficient oversight, which may lead to exploitation. Therefore, this research recommends the need for harmonization between educational and labor regulations, as well as strengthening oversight systems to ensure the protection of students' rights. This study aims to contribute to the development of fairer and more sustainable education policies in Indonesia.

Abstract

The role of the state in enforcing health law in Indonesia is a crucial aspect aligned with constitutional provisions, particularly Article 28H paragraph (1) of the 1945 Constitution, which emphasizes the right to health. The state is expected to create a legal system that protects and fulfills the health rights of the community through the formulation of policies, regulations, and oversight of health service delivery. The implementation of Law No. 36 of 2009 on Health underscores the government's responsibility to provide accessible and quality health services. Health law enforcement includes actions against violations, including sanctions for providers that do not comply with standards. In this context, the state must also respond to health emergencies, such as pandemics, with swift and effective measures. Additionally, public participation in health decision-making processes is vital. In the long term, political commitment and adequate resource allocation are necessary to ensure the sustainability of health programs. Through a holistic, human rights-based approach, the state can create an inclusive and quality health system for all members of society.

Abstract

Cybersecurity in Indonesia is still in its developmental stage and is faced with various complex challenges. One of the main challenges is unequal access to technology and the internet, which contributes to the digital divide in society. In addition, content restrictions often limit freedom of expression, while privacy and data security issues are increasingly pressing as the use of digital platforms increases. While the government has taken positive steps, such as the implementation of the Personal Data Protection Law, the effectiveness of this regulation is still in doubt due to a lack of integration in implementation. The rise in cyber incidents, including ransomware attacks targeting critical infrastructure, highlights the need for a more holistic and proactive approach. This research emphasizes the importance of strengthening the legal framework and improving cybersecurity literacy among the public. In the ever-changing digital era, striking a balance between liberalization and protection of national interests is crucial for Indonesia to optimally harness its digital potential without neglecting crucial security aspects.

Abstract

The damage that has occurred is very concerning and is often caused by human greed and negligence, which will impact future generations. This is a concerning situation and needs immediate special attention. One of the main causes of environmental problems is the lack of public awareness about the importance of environmental preservation. When individuals realize the importance of preserving and conserving the environment, they will be more prudent in utilizing natural resources. In Indonesia, sustainable development is defined as a planned effort that integrates the environment and resources into the development process, in order to ensure the welfare and quality of life for current and future generations. Regulation Number 32 of 2009 on Environmental Protection and Management (PPLH) clearly states that the environment is a spatial unit that includes all objects, forces, conditions, and living beings, including humans and their behavior, which affect nature, the survival, and well-being of humans and other living beings.

Abstract

Taxes are a source of state revenue collected from the public based on legislation and used to finance state interests, including the execution of tasks for the public good. The relationship between taxes and development in Indonesia is very close, as infrastructure development can be realized thanks to tax revenue. The taxes paid by the community are used to finance government expenditures, including public projects such as road widening and asphalting in rural and urban areas. This development aims to ensure that the community has adequate transportation access, so that daily activities run smoothly. Taxes serve as an important source of government funding to finance various activities, including development. Therefore, taxes play a key role in the administration of the state.

Abstract

Health services play an important role in fulfilling human rights, especially the right to health. In this context, health law serves to protect the rights and obligations between medical personnel and patients. Various regulations, such as Law No. 36 of 2009 concerning Health and Law No. 29 of 2004 concerning Medical Practice, regulate standards and ethics in medical services. Medical personnel are required to provide professional services and respect patient rights, such as the right to information and consent, while patients are required to provide accurate information. However, legal issues such as malpractice and violations of patient rights often occur, which shows the importance of understanding and implementing the law in health services. The era of digitalization and the pandemic also presents new challenges, such as data security and electronic medical consent. Therefore, this study discusses the legal implications in health services, highlighting the importance of education and compliance with regulations to prevent conflict and improve the quality of services. By understanding each other's rights and obligations, it is hoped that a fairer, more transparent, and quality health service system can be created.

Abstract

This study aims to analyze the legal protection of the famous Biostime trademark registered by Biostime Indonesia under Law Number 20 of 2016 on Trademarks and Geographical Indications, as well as to examine the responsibility of the Directorate General of Intellectual Property in handling the trademark dispute. The methodology of this research is categorized as normative legal research with legislative, conceptual, and historical approaches. This article uses an analysis of applicable regulations, trademark protection theories, and legal practices in resolving trademark disputes in Indonesia. The findings of this study show that legal protection for famous trademarks in Indonesia needs to be improved to provide better legal certainty for trademark owners, especially in dealing with the registration of similar or identical trademarks. The Directorate General of Intellectual Property, as the responsible institution, must be more careful and thorough in conducting substantive examinations to ensure that no violations occur against famous trademarks that could harm their owners.

Abstract

Perkembangan teknologi dan informasi mempengaruhi pola kehidupan masyakarat, salah satunya pada sektor keuangan. Pada awalnya sektor keuangan menggunakan sistem konvensional menjadi sistem modern. Inovasi pada sektor keuangan bernama fintech (financial technology) atau biasa dikenal dengan pinjaman online. Pinjaman online adalah layanan keuangan digital berbasis teknologi dan informasi dengan memberikan kemudahan terhadap pemberi pinjaman dan penerima pinjaman tanpa harus bertemu langsung. Pinjaman online diatur oleh Peraturan Otoritas Jasa Keuangan Nomor 77/POJK.01/2016. Semakin marak terjadinya pinjaman online, terjadi dengan adanya pinjaman online ilegal. Pinjaman online ilegal adalah pinjaman berbasis jaringan internet yang tidak terdaftar dari Otoritas Jasa Keuangan (OJK). Sistemnya dengan syarat mudah menggunakan KTP dan verifikasi wajah yang membuat masyarakat tergiur untuk memakai pinjaman tersebut. Pinjaman online ilegal ini memiliki ciri-ciri bunga yang tinggi dan ketika tidak membayar, konsumen terkena ancaman oleh pihak pelaku usaha. Metode penelitian yang digunakan adalah yuridis normatif dan penelitian bersifat deskriptif. Jenis data penelitian yang digunakan adalah data primer dan data sekunder. Penelitian ini bertujuan mengidentifikasi risiko bagi konsumen yang terjerat pinjaman online ilegal. Hasil penelitian dinyatakan bahwa konsumen harus memahami risiko terhadap pinjaman online ilegal agar tidak terjebak dalam pinjaman online ilegal dan memahami upaya hukum dari pemerintah untuk masyarakat.

Abstract

Ideally, registered trademark owners receive full legal protection to prevent unauthorized use of their trademarks by other parties. However, in reality, trademark disputes still frequently occur, as seen in the case between PT X and Company Y, highlighting gaps in legal protection for trademark owners. This study aims to analyze legal protection for registered trademark holders and evaluate the effectiveness of regulations in resolving trademark disputes. This article falls under library research with a qualitative approach, utilizing normative legal study methodology. The findings indicate that the trademark dispute between PT X and Company Y underscores the importance of legal protection for registered trademark holders, where the first-to-file registration system grants exclusive rights to the legitimate owner. However, despite existing regulations, disputes persist, necessitating active monitoring and legal enforcement by trademark owners through legal action or dispute resolution in commercial courts.
