Abstract

This study aims to examine the forms of land ownership conflicts in Palopo City. This research was conducted using qualitative method with the type of field research. Data collection in the form of primary data and secondary data through observation, interview and documentation techniques and literature studies through 4 stages, namely reduction (data is filtered/selected), connection (data is connected), interpretation (data is translated/explained) and conclusions (data is concluded). The results showed that: (1) land conflicts occurring in Palopo City are categorised into 4 categories, namely: land boundary conflicts, land ownership conflicts, inherited land conflicts, and conflicts between the government and the community/legal entity; (2) factors causing ownership conflicts, namely unclear land boundaries, incomplete land ownership documents, landowners do not manage their own land, land is not physically controlled, land is abandoned, undivided inherited land, dishonesty of heirs, multiple and overlapping certificate claims, and infrastructure development; (3) The Palopo City Land Office is an institution that has an important role in managing and regulating land aspects in its area by making efforts to minimise the occurrence of land conflicts.

Abstract

This research thoroughly examines the relationship between customary law and Islamic law and how they relate to Mampatangpulo. This type of research is qualitative, and the research location is in Enrekang Duri, where a sociological and phenomenological approach is used. The data in this research comes from primary and secondary data, while the data collection techniques used in this research use observation, interviews, and documentation. Data is processed and analyzed using data reduction techniques, presentation, and conclusion drawing. The results of this research show that the process of implementing the Mampatangpulo Tradition starts from the Sangbonginna, Mangbongi tallu, Mangbongi pitu events and the peak of the Mampatangpulo event after the death of the deceased. In the process of implementing the Mampatangpulo Tradition, several stages of traditional processions are considered sacred and essential to carry out, namely Mangpepellao (Lowering), Mampakande-kande (Feeding), Manggere' beke (Slaughtering a goat). The Mampatangpulo tradition can only be carried out if the procession does not violate Islamic law. According to a review of Islamic law regarding the implementation of the Mampatangpulo tradition, the law is okay when the procession does not violate Islamic law because, in the implementation of the Mampatangpulo tradition that developed in the people of South Sulawesi, there are habits that have positive values. This research also shows a strong relationship between customary law and Islamic law in the Mampatangpulo tradition, such as in the takziah and friendship events. The results of this study confirm that the culture that develops in Indonesian society and globally can be preserved if it does not conflict with Islamic values.

Abstract

ABSTRACTThe role of the prosecutor's office in prosecuting cases of criminal acts of corruption starts when the case has not been transferred to the Court until the implementation of the court's decision, including receiving notifications, examining case files, conducting pre-prosecution, detaining, making indictments, closing cases, and transferring cases to court, bringing cases to justice the accused went to trial, read out the indictment, presented witnesses, prepared evidence, read out the indictment, and carried out the court's decision. In prosecuting corruption, the witnesses was not cooperative in providing information regarding the alleged corruption crime or as a witness to the alleged corruption crime, because they are afraid of superiors, the existence of suspects and witnesses who often move places so that it hinders the examination process. conduct identification of evidence, especially in relation to assets owned by the suspect ABSTRAKPeranan kejaksaan dalam hal penuntutan perkara tindak pidana korupsi dimulai saat perkara belum dilimpahkan ke Pengadilan sampai pada pelaksanaan putusan pengadilan, mencakup menerima pemberitahuan, memeriksa berkas perkara, melakukan prapenuntutan, melakukan penahanan, membuat surat dakwaan, menutup perkara, dan melimpahkan perkara ke pengadilan, menghadapkan terdakwa ke persidangan, membacakan surat dakwaan, menghadapkan saksi-saksi, menyiapkan barang bukti, membacakan surat tuntutan, dan melaksanakan putusan pengadilan.  Dalam melakukan penuntutan tindak pidana korupsi adalah tidak koperatifnya para saksi dalam memberikan keterangan terkait adanya dugaan tindak pidana korupsi maupun sebagai saksi pada dugaan tindak pidana korupsi, karena takut kepada atasan, keberadaan tersangka dan saksi yang sering berpindah-pindah tempat sehingga menghambat proses pemeriksaan, susahnya melakukan identifikasi terhadap barang bukti terutama terkait dengan harta kekayaan yang dimiliki tersangka.
