Abstract

Studi ini bertujuan untuk mengetahui tentang bagaimana kebijakan Gubernur Provinsi DKI Jakarta yang dijabat oleh Basuki Tjahaja Purnama dan Anies Baswedan dalam menata Kawasan Kampung Akuarium, Jakarta Utara. Metode pendekatan yang dipergunakan dalam penelitian ini adalah dengan menggunakan metode pendekatan yuridis empiris. Hasil penelitian menunjukkan kebijakan Ahok sangat kontroversi dengan tidak menerapkan konsep konsolidasi tanah dan terus mendapat penolakan keras dari para warga masyarakat, menjadi sorotan publik dan mendapat kontra dari masyarakat luas di Indonesia karena melakukan penggusuran paksa dan merelokasi warga ke beberapa rusun. Sementara itu, kebijakan Gubernur Provinsi DKI Jakarta Anies Baswedan, yang akan membangun shelter, hunian sementara bagi eks warga di tempat itu yang dahulu tergusur dan berencana menata ulang kawasan tersebut dengan konsep konsolidasi tanah secara konsisten, berkeadilan dan berkesinambungan. Abstract This study aims to find out about the policies of the Governor of Jakarta Province, held by Basuki Tjahaja Purnama (a.k.a Ahok) and Anies Baswedan in managing the Aquarium Village Area, North Jakarta. The approach method used in this study is to use an empirical juridical approach. The results of the study show that the policy of Ahok is very controversial because by not applying the concept of land consolidation and continues to receive a strong rejection from the community, it becomes the public spotlight and gets contra from the wider community in Indonesia for carrying out forced evictions and relocating residents to several flats. In contrast, the policy of the Governor of Jakarta Province, Anies Baswedan, is to build temporary shelters for former residents in the area who were previously evicted and plans to reorganize the area with the concept of consistent, equitable, and sustainable land consolidation. Abstract

There are still major challenges in its implementation, such as lack of public awareness of the importance of land registration, lack of socialization from the authorities, and administrative barriers faced by the community, especially in rural areas. The existence of this time limitation also raises new concerns regarding land disputes, especially if there is a conflict between the owner of the girik and the owner of the valid certificate. Therefore, this study is very important to dig deeper into the issue of the deadline for registration of customary land after the entry into force of government regulation number 18 of 2021. This study aims to understand how the policy is implemented, its impact on the renewal of the land system, as well as its relevance in providing legal certainty to citizens. Therefore, this research is expected to provide real contributions and benefits in encouraging fairer and more effective land reform in Indonesia. Legal protection for owners of girik land who have not registered their land after the deadline for land registration according to PP number 18 of 2021 ends, they still get legal protection from the state, because the owner of girik land is still given the opportunity to register his girik land, but the basis for registering his land is not with written evidence in the form of girik, but with a mechanism for applying for recognition of land rights provided that the land has been physically controlled by the person concerned for 20 (twenty) years or more continuously, without any objection from any party (the land is not in dispute).

Abstract

Abstract. The enactment of Indonesia’s Job Creation Law in 2020, known as the Omnibus Law, marked a pivotal moment in the country’s pursuit of economic growth and legal reform, aiming to foster job opportunities and sustainable development while streamlining regulatory frameworks and attracting investments. This paper presents a comprehensive analysis that explores the law’s implications in comparison with historical policies such as the 1992 Deregulation Policy Package and the 1993 Deregulation Policy Package. Utilizing qualitative methodology, the research investigates economic impacts through a thorough review of legal documents, policy reports, scholarly articles, and relevant literature, employing thematic analysis to uncover recurrent themes and patterns. The study elucidates how these policies have shaped Indonesia’s economic landscape, highlighting their interplay and contribution to the nation’s ongoing economic trajectory, offering valuable insights into the intricate dynamics between legal reforms and economic development. Pemberlakuan Undang-Undang Cipta Kerja di Indonesia pada tahun 2020, yang dikenal sebagai Omnibus Law, menandai momen penting dalam upaya pertumbuhan ekonomi dan reformasi hukum negara tersebut, dengan tujuan menciptakan peluang kerja dan pembangunan berkelanjutan sambil menyederhanakan kerangka regulasi dan menarik investasi. Makalah ini menyajikan analisis komprehensif yang menjelajahi implikasi hukum ini dibandingkan dengan kebijakan historis seperti Paket Kebijakan Deregulasi 1992 dan Paket Kebijakan Deregulasi 1993. Dengan menggunakan metodologi kualitatif, penelitian ini menyelidiki dampak ekonomi melalui tinjauan mendalam terhadap dokumen hukum, laporan kebijakan, artikel ilmiah, dan literatur relevan, dengan menerapkan analisis tematik untuk mengungkapkan tema-tema dan pola-pola yang berulang. Studi ini menjelaskan bagaimana kebijakan-kebijakan ini telah membentuk lanskap ekonomi Indonesia, menyoroti interplay mereka dan kontribusi terhadap lintasan ekonomi negara, memberikan wawasan berharga tentang dinamika rumit antara reformasi hukum dan pembangunan ekonomi. Abstract

This study examines the legal implications and liability of a Notary for the forgery of a Sale and Purchase Agreement Deed that occurred due to the Notary's negligence in carrying out his/her obligations. The research method used is normative juridical with a statutory approach and a case approach, based on the theory of legal certainty and the theory of legal responsibility. The results of the study indicate that the Notary's negligence in verifying the identity of the parties and the authenticity of the document resulted in the deed losing its authenticity based on Article 1868 of the Civil Code and can be declared null and void (nietig van rechtswege) based on Article 1320 of the Civil Code. The Notary's liability is multidimensional, including criminal liability based on Articles 263 and 264 of the Criminal Code, civil liability based on Article 1365 of the Civil Code, and administrative liability through the Notary Supervisory Board mechanism, as reflected in the Denpasar District Court Decision Number 89/PID.B/2020/PN DPS. The Notary's professionalism and thorough attitude are the main foundations in realizing legal certainty for the community.
