Tujuan penelitian ini adalah menganalisis penyebab pihak Badan Pengusahaan Batam belum membebaskan atau mengganti rugi hak erfpacht verponding atas tanah di Batam, menganalisis keberadaan tanah dengan status Hak erfpacht dapat/tidak dialihkan kepada pihak ketiga dengan alas HPL dan menganalisis solusi yang dapat dilakukan agar tanah hak erfpacht di atas HPL dapat diakui kepastian hukumnya. Penelitian ini termasuk penelitian hukum sosiologis dengan teknik pengumpulan data dengan wawancara dan observasi serta dengan analisis data kualitatif. Hasil penelitian ini adalah Badan Pengusahaan Batam belum membebaskan hak erfpacht verponding atas tanah di Batam, karena adanya Peraturan Pemerintah Nomor 46 Tahun 2007 Tentang Kawasan Perdagangan Bebas dan Pelabuhan Bebas Batam dan Keputusan Presiden Nomor 74 Tahun 1971 Tentang Pengembangan Pembangunan Pulau Batam.Solusi yang dapat dilakukan agar tanah hak erfpacht di atas HPL dapat diakui kepastian hukumnya dengan mengukuhkan menjadi hak baru.

Submission of a marriage wish application is required to attach the requirements of the marriage document. Marriage Registration Officer who is given the authority of marriage registration attribution checks and examines the requirements that have been fulfilled according to the laws and regulations for marriage registration. But the reality is that after marriage registration, there are many marriages that are known to violate normative provisions and religious principles. This study uses a sociological juridical research method. As a result, there are still many types of marital law violations to be held accountable for these violations. In the event that there are known elements of marital law violations, there are 3 (three) forms of responsibility for Marriage Registrar, namely: administrative, criminal and civil liability.

Under Article 4, Section 1 of Income Tax Law No 36 of 2008 explicitly stated that income is the object of taxation. The income referred to is any additional economic ability that is obtained or received by the taxpayer with the intent to consume or improve the value of the taxpayer itself. Therefore, all income received by Youtuber or Online Shop Merchants needs to be taxed. The research has a purpose to find out which law that rules Youtuber and Online Shop Merchants especially in a field that concerns income tax. The experiment also reviews which sanction can be applied to Youtuber and Online Shop Merchant should they violate the law. This legal research is in normative form using both the legal approach and analysis approach towards legal concepts or theories. The theories used are the theory of justice and the theory of legal certainty. As for the legal substance, a secondary substance in a form of written laws and regulations as well as research results regarding the issue. Based on the result of this research, the law governing Youtubers and Online Shop Merchants are mentioned in Republic of Indonesia Ministry of Finance Regulation No 210/PMK.010/2018 about laws regarding Tax Application and Trade Transactions through e-commerce with a punishment of administrative sanction or criminal sanction should violation or breach of law occurs.

Perseroan sebagai Badan Hukum (rechtspersoon/legal person) merupakan Perseroan Terbatas yang pengaturannya tunduk pada ranah hukum privat yaitu Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas. Sebagai organ penting Perseroan, Direksi sebagai pengurus adalah pilar utama untuk menjamin dan untuk melanjutkan bisnis Perseroan. Itu sebabnya tanggung jawab Direksi sebagai pengurus atau manajemen didasarkan pada itikad baik, loyalitas, kejujuran, penuh tanggung jawab, kepedulian dan kemampuan serta maksud yang terbaik bagi Perseroan, untuk mengurus hingga tercapainya tujuan Perseroan dan yang mewakili Perseroan di dalam pengadilan dan di luar pengadilan. Tanggung jawab Direksi berdasarkan prinsip Fiduciary Duty dalam Perseroan Terbatas harus mampu melaksanakan tugasnya dengan penuh itikad baik, bertanggungjawab, serta menghindari adanya benturan kepentingan. Direksi juga dituntut untuk bertindak dengan penuh kehati-hatian dalam membuat segala keputusan dan kebijakan (duty of care) serta mampu mengutamakan kepentingan Perseroan di atas kepentingan pribadinya (duty of loyalty). Seorang Direksi dikategorikan melakukan Corporate Opportunity dan melakukan pengelolaan Perseroan yang salah, apabila seorang Direksi melakukan pelanggaran Code Of Conduct. Tidak melaksanakan duty of care dan duty of loyalty yang terdapat dalam prinsip perusahaan dan memiliki itikad buruk dengan mengambil kesempatan bagi dirinya pribadi atas nama untuk kepentingan Perseroan.

Land is a significant part in providing sources for life for human beings. The problems relating to land dispute settlement remain to be unable togive justice and fairness to disputing parties as it is mandated by Pancasila, the 1945 Constitution, Law No.5 of 1960 concerning the Basic Land Law and the Regulation of Agrarian Minister and Head of National Land Body No.5 of 2015 concerning Location Permit. This study reveals that land dispute settlement between community and developers in Batam City should be conducted by litigation and non litigation because these are the appropriate settlement methods in providing justice, security, comfortability and happiness to both disputing parties. === Tanah sebagai bagian yang sangat penting memberikan sumber penghidupan, seluruh umat manusia. Permasalahan penyelesaian sengketa tanah belum dapat memberikan rasa keadilan bagi pihak-pihak yang bersengketa, sebagaimana diamanatkan dalam Pancasila dan UUD 1945 dan Undang-Undang No. 5 Tahun 1960 tentang Dasar Pokok-Pokok Agraria maupun Peraturan Menteri Agraria Dan Tata Ruang/Kepala BPN No.5 tahun 2015 tentang Izin Lokasi. Studi ini mengungkapkan bahwa bentuk penyelesaian sengketa tanah antara masyarakat dan Developer di Kota Batam sebaiknya dilakukan melalui secara Litigasi maupun Non Litigasi karena cara inilah yang paling tepat dalam memberikan rasa keadilan, keamanan dan kenyamanan serta kebahagian bagi kedua belah pihak yang bersengketa.

This research aims to determine how the arbitration principles applied in the consumer disputes settlement based on Law No. 8 of 1999. This research used a normative legal research. After analyzing the data research, it can be seen that the implementation of the Arbitration principles in consumer dispute settlement in terms of Law No. 8 of 1999 was deviating from the Arbitration principles of arbitration pursuant to Law of Arbitration namely Law No. 30 of 1999. Among them was a court intervention in the Arbitration?s settlement in Consumer Dispute Settlement Board, whereas with the presence of the arbitration agreement, it should remove the authority of the district court to check the dispute. This kind of Consumer dispute settlement process, also adheres to the principle of final and binding decision, as referred to article 54 paragraph ( 3 ) of Law No. 8 of 1999, but it still opens for legal remedy of appeal so that it raises legal uncertainty. Hence, the arbitration principles cannot be applied in consumer dispute resolution pursuant to Law No. 8 of 1999 and may raise new legal issues. === Penelitian ini bertujuan untuk mengetahui bagaimanakah prinsip-prinsip arbitrase yang diterapkan dalam penyelesaian sengketa konsumen berdasarkan Undang-undang Nomor 8 tahun 1999. Penelitian ini merupakan penelitian yuridis normatif. Setelah dilakukan analisis terhadap data-data penelitian, dapat diketahui bahwa penerapan prinsip-prinsip arbitrase pada penyelesaian sengketa konsumen ditinjau dari Undang-undang Nomor 8 tahun 1999 tentang Perlindungan Konsumen adalah menyimpang dari prinsip-prinsip arbitrase menurut Undang-undang Arbitrase nasional yaitu Undang-undang Nomor 30 tahun 1999. Diantaranya adanya campur tangan pengadilan dalam penyelesaian secara Arbitrase di BPSK, padahal dengan adanya perjanjian arbitrase menghapus wewenang pengadilan negeri untuk memeriksa sengketa tersebut. Proses penyelesaian sengketa konsumen melalui BPSK, juga menganut prinsip putusan final dan mengikat, sebagaimana yang dimaksud di dalam Pasal 54 ayat (3) Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, namun masih dapat dilakukan upaya hukum keberatan yang dapat dilakukan oleh para pihak sehingga menimbulkan adanya ketidakpastian hukum. Atas dasar itulah prinsip-prinsip arbitrase tidak dapat diterapkan dalam penyelesaian sengketa konsumen menurut Undang-undang Nomor 8 tahun 1999 tentang Perlindungan konsumen dan menimbulkan permasalahan hukum baru.

The thesis discussed the effectiveness of task force of the efforts to the removal of trade women and boy who is victims of human . Various policies which created a government pertaining to crimes trade women and children , basically the policy made relatively comprehensive , starting from the constitution of 1945 to regulations below. Effort task force against the removal of trade women and children is currently still less effective. This can be seen from there are still many the cases of trafficking of women and children. Efforts task force made in to reduce and a handle human trafficking as a form of prevention to be victims , done by means of coordination , socialization , rehabilitation and reintegrated.

Abortion or abortus provokatus constitutes a termination of pregnancy before the time of delivery. The objective of the study is to ascertain if the Abortion-related Health Law is a realistic rule based on the health aspects, as well as to analyze how long it should be allowed by the Health Law to perform an abortion according to medical criteria. The study uses a method of normative legal research. It concludes that the Health Law pertaining abortion is a realistic rule based on health aspects. Yet, it is necessary to revise the abortion rules due to rape incidents. The rules permits the abortion if the gestational age is 6 (six) weeks or 40 (forty) days. It is calculated from the first day of the last period. It suggests that the gestational age should be 12 (twelve) weeks or 3 (three) months from the first day of the last period. Law No. 32 of 2004 on Local Government and Government Regulation No. 6 of 2010 on the Civil Service Police Unit has mandated that Public Protection is obligatory under the authority of both the Provincial and Local Government District and the City. On Government Regulation No. 6 of 2010 on the Civil Service Police Unit that requirements to be appointed as Municipal Police are civil servants, but in the province of Riau Islands Civil Service Police Unit number is still much that is not civil servant status. On Government Regulation No. 6 of 2010 on the Civil Service Police Unit that Article 16 point a that the requirements to be appointed as Municipal Police are civil servants, which Civil Service Police Unit has the task of enforcing local laws, organizing public order and peace and the protection of society, but to carry out this task Municipal Police Units are often contradictory and conflicted with the community. Civil Service Police Unit has the task of helping the head area as Regional Regulatory enforcement to create a serene area conditions, and orderly. Legal remedy solving problems where the Civil Service Police Unit of the police human resources of the Civil Service has had Permendagri 38 of 2010 on the Civil Service Training police, merging function that refers Satlinmas Regulation No. 6 of 2010 on the civil service and police force Regional Government only raised police members of the Civil Service only for the status of Civil Servants.
