Abstract

Regarding the existence of a state administrative court, we must look at the country next to us such as France, a country which historically was the pioneer of the birth of this kind of institution for the first time. The role of the French state is still felt today. the state acts as a leader in the "Association Internationale des Houtes Administrative Jurisdiction".

Abstract

Indonesia is a constitutional state, which means that almost every action taken in it is regulated in accordance with applicable legal provisions. The State Administrative Court is one form of implementing the rule of law. This state administrative court is regulated in Law no. 5 of 1986 concerning the State Administrative Court which is the realization of the provisions of Article 24 of the 1945 Constitution and Article of Law No. 14 of 1970 which was amended by Law no. 35 of 1999 concerning Main Provisions of Judicial Power, whose authority is to inspect to protect and develop and maintain state administration that is appropriate according to law or according to law or is appropriate effectively or functions efficiently. Today if we analyze the existing laws in Indonesia socially, there are still many people who are less concerned about the concepts and objectives of the laws issued by the government. therefore, from this journal, the author intends to provide legal education related to the position of state administrative justice in Indonesia.

Abstract

Execution of the decision (executie) is the method and conditions that used by the tools of state power to help interested parties to carry out the judge's decision if the losing party is not willing to comply with the substance of the decision within the allotted time.limiting court decisions that have permanent legal force that are relevant to implementation, namely a decision that has been accepted by the parties or has not been submitted again legal action (appeal or cassation). Court decisions that have not yet obtained force the law still does not have the power of execution or in other words a court decision who still have legal remedies. State business as a manifestation of the implementation of the judicial function to control its course. The executive function in the form of testing a form of state administration decision issued by State Administrative Officials that the decision was in accordance with the provision legislation and general principles of proper government administration in accordance with Article 115 of Law Number 5 of 1986 concerning Administrative Court A state that states that only decisions have gained legal force fixed that can be implemented.

Abstract

Putusan Mahkamah Konstitusi, yang mencerminkan nilai keadilan konstitusional, baik menjamin pengujian UUD 1945 maupun seringkali menimbulkan situasi yang berlawanan dalam sengketa hasil pemilu yang seharusnya diselesaikan oleh semua pihak yang terlibat dalam putusan tersebut. Mahkamah Konstitusi berwenang untuk mengambil keputusan tingkat pertama dan terakhir, yang keputusannya bersifat final dalam mengubah undang-undang yang terkait dengan UUD 1945. Keberadaan undang-undang untuk meratifikasi perjanjian internasional merupakan subjek khusus dalam sistem pelaksanaan konstitusi Indonesia. Komitmen pemerintah terhadap perjanjian internasional diwujudkan berdasarkan pengesahan undang-undang oleh DPR dan Presiden. Lisensi khusus ini terdiri dari peraturan hukum. Sebagai undang-undang, menjadi pertanyaan tersendiri apakah undang-undang pengesahan ini dapat digolongkan sebagai ketentuan hukum yang berjenjang di bawah UU No. 12 Tahun 2011 yang berimplikasi pada uji materil oleh Mahkamah Konstitusi.

Abstract

Mahkamah Konstitusi Indonesia telah memainkan peran dan fungsi penting untuk melindungi dan memenuhi hak asasi manusia dalam sistem hukum Indonesia termasuk hak-hak ekonomi, sosial, dan budaya melalui kekuasaan hukum peninjauan kembali (judicial review). Hal ini menegaskan bahwa hak-hak ekosob adalah hak-hak yang dapat dibenarkan secara hukum dan merupakan bagian dari mandat konstitusi. Ini berarti bahwa keputusan peninjauan yudisial mengharuskan Negara untuk berperilaku sesuai dengan ambang batas hukum yang diputuskan oleh Pengadilan. Tidak diragukan lagi, kepatuhan terhadap putusan tersebut akan mengungkapkan fakta-fakta yang tidak terbantahkan bagi pemenuhan perilaku negara. Namun, tampaknya masih banyak pertimbangan, penekanan, dan alasan untuk mengurangi atau mengabaikan ambang batas penerapan keputusan Pengadilan. Kompleksitas aktor, institusi, otoritas, tingkat implementasi, dan orientasi kebijakan, program, tindakan, dan dana tertentu mengurangi ambang batas.
