Abstract

Drug abuse by several officials of the National Narcotics Agency (BNN) in the Province of Lampung has become a serious issue that affects the image of law enforcement agencies and has a negative impact on society. The alleged abuse involves not just ordinary civilians, but a viral case involving Fredy Pratama. It was in the online news media metrotv news that Lampung Police arrested an honorary member of the Lampung National Narcotics Agency (BNN) named M.Y. According to Kapolda Lampung Irjen Helmy Santika, MY, who is 26 years old, serves as a courier who ships drugs of the type Fuj-sabu. He stated that M.Y was arrested on January 14, 2024 at Bakauheni Executive Port with 28 packages of drugs. The research method used is normative. The results show that working environment factors, social stress, and a lack of internal supervision contribute to drug abuse. Effective preventive efforts include improved surveillance, rehabilitation programmes, and sustained education for BNN staff. BNN also held an internal seminar to give an understanding of the gravity of the punishment for drug abuse perpetrators. At the local level, initiatives such as the inauguration of the Drug-Free Hard Village in Sukaraja Kelurahan show concrete steps in prevention efforts. The village was chosen on the basis of increasing data on drug abuse cases, and is expected to be an example for other areas in creating a drug-free environment. Drug abuse among civil government officials (PNS) is also a concern. Factors such as the living environment and free association are often the main triggers. The preventive efforts included socialization on the dangers of drugs and periodic urine tests to detect drug abuse among the PNS. There are three ways to combat crime, mainly narcotics abuse, namely pre-emtive (planning), preventive (prevention), and repressive.

Abstract

A dispute is a difference of interest between individuals or institutions on the same object that is manifested in the relationships between them. On August 26, 2019, President Joko Widodo announced the transfer of the country's capital (IKN) to East Kalimantan Province. To begin with, the National Development Planning Agency (Bappenas) has investigated various aspects related to the stage of ICT transfer. These include the economic impact, regional readiness, and the potential development of industrial areas. In the preventive protection of the law, the government should take into account the fate of the local citizens when making plans for the development of the ICT area, both in making decisions and decisions related to the construction of the Nusantara ICT. Following the decision to transfer the capital of Nusantara to the East Kalimantan Province, the transfer of land rights has increased, according to data from the Regional Office of the National Agriculture Authority of the East Calimantan province. By 2020, the rights to land were transferred through a sale agreement at 175 locations in the territory of the capital of Nusantara. By 2021, the number of transactions has increased significantly to 294. Based on these backgrounds, researchers are interested in conducting research entitled “Debate on the Implementation of the Final Decision of the Land Dispute in Kalimantan which is to be made the capital of Indonesia”, through two issues to be discussed, namely, First, the setting up of land freezing as part of the ICT program in East Kalimanthan and Second, on the social impact of the land-freezing program on citizens in particular in East Calimantan. The research method in this research uses normative law research.

Abstract

Salah satu agenda hukum nasional adalah pembaharuan KUHP, yang telah muncul sejak tahun 60-an. KUHP yang sekarang digunakan di Indonesia berasal dari hukum kolonial Belanda (Wetboek van Strafrecht), yang pada praktiknya sudah tidak sesuai dengan keadaan Indonesia saat ini. Sebagai Negara hukum Indonesia menjunjung tinggi supremasi hukum, perubahan dari KUHP lama ke KUHP baru, khususnya perubahan yang dibuat dalam UU Nomor 1 Tahun 2023 Tentang Kitab Undang-Undang Hukum Pidana. Dikatakan oleh beberapa ahli bahwa pembaharuan hukum KUHP ini dibuat untuk memperbaiki masalah dan melindungi orang miskin. Undang-Undang Republik Indonesia No.1 tahun 2023 tentang Kitab Undang-Undang Hukum Pidana (selanjutnya disebut KUHP Nasional) menggunakan sistem pemidanaan dua jalur, yang memungkinkan di antara lain pelaku tindak pidana untuk dijatuhi sanksi pidana Penelitian ini akan menentukan bagaimana kebijakan restoratif yang dimaksud diterapkan dalam UU Nomor 1 Tahun 2023 Tentang Kitab Undang-Undang Hukum Pidana, karena apakah restorative justice yang tertuang dalam undang-undang terkait restorasi diatur dalam undang-undang terkait restorasi. Penelitian ini akan menentukan apakah restorasi keadilan yang diinginkan masyarakat telah dimasukkan dan diterapkan dalam setiap pasal baru dari Konstitusi Republik Indonesia (KUHP). Ini karena terciptanya restorasi keadilan berdampak pada kehidupan masyarakat di masa mendatang. Hasil penelitian ini adalah Konsep restorative justice berfokus pada pemulihan dan menolak pemidanaan sebagai pembalasan. Dalam hal politik hukum nasional, hukum yang berlaku harus sesuai dengan kebutuhan masyarakat. Melalui restorative justice dalam Undang-Undang Hukum Pidana, kehendak tuntutan masyarakat telah dipenuhi. Namun, seperti yang dinyatakan dalam Pasal 54 ayat (1) dan (2), penerapan restorative justice belum sepenuhnya diterapkan. hukum menurut Undang-Undang Hukum

Abstract

In general, general elections are conducted by a legitimate state in order to select a leader for the nation (a political position). Legislative regulations govern the procedures for holding elections, but some candidates use money politics to gain an advantage over their rivals. To genuinely be in line with the essence of money politics, money politics actions need to be carefully thought out. Legal studies must substantiate the practice of substituting transportation, fatigue, and food funds for voter mobilization in public campaigns. The use of criminal law as a last resort must be thoroughly examined, as well as the legal tools for preventing money politics. A number of additional strategies can. The recognition and assertion of the rule of law, along with the placement of the law as the supreme command in state administration, imply that all facets of government administration, including the regulation of general elections (Elections), are subject to stringent legal frameworks and legislative regulations. Election procedures must adhere to certain principles, including those of direct, general, free, secret, honest, and fair. Though in this instance the author focuses more on the application of the principles of honesty and fairness, the author believes that these five values have a similar role in developing officials with high integrity. Since it is commonly known that throughout the several elections that have taken place since they were first conducted in 1955 till the present Money politics is the area where election violations occur most frequently. Money politics is prohibited by legal instruments (criminal legal instruments), and there are two ways to deal with political violations: the police can impose administrative sanctions or criminal penalties. The issues brought up in this article are as follows, based on the introduction: first, how is money politics regulated by positive law? Secondly, how successful are the legal tools available to stop money politics, and what cultural countermeasures are there?

Abstract

In general, elections are actions carried out by a legitimate state to elect a leader or political position. Although positive laws regulate the holding of elections, general election participants sometimes engage in money politics to win the competition. All aspects of the Government of the Republic of Indonesia are strictly regulated by the provisions of the legislation, including the rules for the general election. By recognizing the state as the law and placing the law as the highest command in the maintenance of the state, every state action and operation is carried out through the mechanism of the law itself. A state is an organization that requires officials authorized by law to manage its governance. Success in combating corruption in Indonesia depends on an integrated electoral policy. But unfortunately, research shows that the agenda for improving our electoral political integrity is hampered by the abundance of money politics. The existence of democracy is a means for the people to control the government and a means to hold public officials accountable. This accountability changes direction if politicians have bought votes, there is a foundation that must be run well, that is, a direct foundation, general, free, secret, honest and fair. The author thinks the five foundations have the same position in producing high-integrity officers. The research focus of this article is political practice involving money in legislative elections involving voters and politicians. Monetary politics has become a new norm in post-New Order elections. Institutional design, especially an open proportional system, has proven to contribute to the plethora of monetary political incidents. In order to prevent the use of political money from becoming a habit in future elections in Indonesia, this paper recommends a thorough review of the open proportional system.

Abstract

School Operational Assistance, or BOSS, is one of the programs initiated by the government aimed at improving the quality of education, both means and supplies, as well as expropriation affairs. It is in accordance with the mandate given to the Fifth Path of the ideology of the nation, namely Pancasila, “Social Justice for All the People of Indonesia." Any budget-related program is highly vulnerable to corruption, so it needs to be monitored in its enforcement. According to Act No. 15 of 2006 on BPK, the financial audit of financial statements is carried out with the aim of giving sufficient assurance or reasonable assurance that the presentation of the report has been reasonably made in relation to all material matters in its substance, in accordance with the principles of accounting in general, such as the Central Government Financial Report. There are three principles to be met in the evaluation: continuity (continuity), comprehensiveness (comprehensiveness), and objectivity. For that, it felt important to raise the formula for the problem of how the arrangement of the management of the funds of the boss by the recipients should be channeled to the person entitled. How are criminal sanctions applied to recipients who commit fraud against the BOS Fund? And how is the supervisory mechanism used by the BPK as the authority to prevent the fraud of the BOS Fund from happening?

Abstract

ABSTRACTAromatherapy candles are candles that serve as air fresheners, calm the mind, assist in therapy processes, support a modern healthy lifestyle, and can also repel insects. Aromatherapy candles can be made from herbal ingredients that are commonly found and used. These candles have the potential to replace conventional candles that do not have a specific scent. However, not many people are familiar with aromatherapy candles because they are still rarely sold, especially in areas far from large cities. One of the candle artisans in Medahan Village, Gianyar Regency, is the Cahya Widhi 16 candle business group, which produces various scents and sizes of candles with unique appearances and distinctive fragrances that help people feel relaxed when inhaling the aroma. The Cahya Widhi candle business is a micro and small enterprise established in 2016, located on Banjar Anggarkasih Street, Medahan Village, Blahbatuh District, Gianyar Regency. One of the processes that requires attention is the quality of the candles. The issues faced by the Cahya Widhi 16 business group include the lack of equipment or machines to cut coconut shells, which are used as candle holders, and a drilling machine for the production process. The absence of drying racks has also led to less-than-optimal results in drying the coconut shells after shaping and painting, as well as the lack of a display case to showcase samples, preventing the candles from being preserved and keeping the aromatherapy candles from deteriorating quickly. Enhancing production quality is also balanced with improving the product brand/logo, which will be designed with attractive images, colors, and layouts, making potential customers more interested in buying the candles by seeing the product logoKeywords: Product Quality, Aromatherapy Candles, Cahya Widhi 16ABSTRAKLilin aromaterapi merupakan sebuah lilin yang bermanfaat menjadi pewangi ruangan, menenangkan pikiran, sebagai alat yang berguna dalam membantu proses terapy dan dapat mendukung gaya hidup sehat yang moderen dan dapat pula untuk mengusir serangga. Lilin aromaterapi dapat dibuat melalui bahan – bahan herbal yang sering kita temui dan gunakan. Lilin aromaterapi ini berpotensi sebagai pengganti lilin konvensional yang tidak memiliki aroma khusus, namun belum banyak orang mengetahui lilin aromaterapi karena memang penjualannya masih sangat jarang terutama di wilayah yang jauh dari kota besar. Pengrajin lilin di Desa medahan kabupaten gianyar salah satunya adalah kelompok usaha lilin Cahya Widhi 16 yang memproduksi berbagai varian aroma dan ukuran yang mempunyai tampilan unik dan wangi khas. Sehingga dapat membuat orang yang menghirupnya menjadi rileks. Kelompok Usaha lilin cahya widhi ini merupakan usaha mikro dan kecil yang didirikan pada tahun 2016 beralamat di jalan Banjar Anggarkasih, Desa Medahan, Kecamatan Blahbatuh Kabupaten Gianyar. Salah satu proses pembuatan yang perlu penanganan adalah masalah kualitas lilin tersebut. Permasalahan yang di alami oleh kelompok usaha Cahya Widhi 16 ini adalah kurangnya alat atau mesin yang digunakan untuk memotong batok kelapa yang merupakan sarana tempat lilin tersebut dan mesin bor dalam proses produksinya. Ketiadaan rak penjemuran membuat hasil dari pengeringan batok kelapa yang sudah selesai di bentuk dan di cat menjadi kurang maksimal serta ketidaktersediaan etalase sebagai tempat sampel untuk memajang sampel agar awet dan lilin aroma terapi tidak cepat rusak. Peningkatan kualitas produksi di imbangi juga dengan perbaikan brand / logo produk pada usaha cahya widhi 16 akan di desain dengan gambar, warna dan tata letak yang menarik sehingga calon konsumen lebih tertarik untuk membeli produksi lilin dengan melihat logo produk.Kata Kunci : kualitas produk, lilin aromaterapy, cahya widhi 16

Abstract

Crowdfunding, have become increasingly popular since the onset of the Covid era and have become a new social phenomenon until now. This is marked by the emergence of various donation collection platforms in Indonesia, making Indonesia the most generous country according to the Charities Aid Foundation World Giving Index 2021 survey. The regulation that serves as the basis for this activity is Law Number 9 of 1961 and Government Regulation Number 29 of 1980. Numerous cases with various methods of operation have begun to surface; however, regrettably, they fall short of the community's expectations, particularly those of well-meaning donors who are concerned about humanitarian issues. This study aims to create a more effective legal regulatory model by examining situations from a new perspective that incorporates economic characteristics. The subjects of this research are crowdfunding actors, donors, and other related parties.. The research method used is the normative research method with the help of Responsive Law Theory as an analytical tool. With a punishment model based on the value of economic loss and also implemented based on the principle of restorative justice, the research findings provide a more responsive resolution mechanism that does not undermine the authority of criminal law and views the legal system as not immune to the influence of other subsystems, including the economic subsystem. It is suggested that laws that are no longer effective in reaching social media-based crowdfunding patterns which not only spread swiftly but may also transcend national boundaries be renewed.

Abstract

Sejak 8 Juli 2020, dimulainya pelaksanaan Pelayanan Hak Tanggungan sesuai dengan Keputusan Peraturan Menteri ATR/BPN Nomor 5 Tahun 2020 yang diberlakukannya secara elektronik. Dalam dunia bisnis banyak sekali terdapat penggunaan layanan Hak Tanggungan, yang mana pihak kreditur meminta jaminan agunan yang telah disepakati dengan pihak debitur. dilakukan oleh Pejabat Pembuat Akta Tanah (PPAT), yang terdahulu dilakukan dengan menyampaikan Akta Pembebanan Hak Tanggungan (APHT) kepada kantor Pertanahan secara langsung kini berdasarkan ketentuan Permen ATR/BPN Nomor 5 Tahun 2020 ini pendaftaran Hak Tanggungan dilakukan secara elektronik saja dengan menerbitkan Aplikasi Mitra Kerja PPAT. Dalam pendaftarannya PPAT memiliki peran penting dalam layanan Mitra Kerja PPAT tersebut dimulai dari pembuatan Akta Perjanjian Kredit, pengecekan sertifikat tanah secara elektronik sebelum membuat APHT, mendaftarkan APHT beserta data pendukung lainnya pada layanan elektronik tersebut. Tujuan dari penelitian ini adalah untuk mengetahui peranan dan tanggung jawab PPAT dalam melakukan pendaftaran Hak Tanggungan secara Elektronik apabila terdapat kendala. Apabila terdapat sebuah kesalahan dalam sertifikat Hak Tanggungan bukan merupakan tanggung jawab PPAT melainkan kreditur. Penelitian ini menggunakan metode penelitian Empiris dengan pendekatan Perundang-Undangan (Statue Approach) dan pendekatan fakta (Fact Approach). Dalam pasal 10 Permen tersebut menjelaskan tentang wewenang PPAT dalam permohonan pendaftaran hak tanggungan.
