<![CDATA[Tujuan penelitian menganalisi Proses Hukum Diversi Perkara Pidana Kecelakaan Lalu Lintas Yang Melibatkan Tersangka Anak Dibawah Umur di Polres Gowa. Jenis penelitian ini adalah penelitian hukum empiris. Hasil penelitian menunjukkan (1) Proses hukum diversi dalam perkara pidana kecelakaan lalu lintas yang mengakibatkan tersangka anak dibawah umur pada wilayah hukum Polres Gowa dilakukan dengan prosedur dan tata cara diversi sebagaimana yang telah diatur dalam undang-undang nomor 11 tahun 2012 tentang sistem peradilan pidana anak yaitu dilakukan melalui musyawarah dengan melibatkan anak dan orang tua/walinya, korban dan/atau orang tua/walinya, pembimbing kemasyarakatan, dan Pekerja Sosial Profesional berdasarkan pendekatan keadilan restoratif untuk mencapai kesepakatan bersama (damai) belum berjalan dengan maksimal karena beberapa faktor (2) Faktor-faktor yang mempengaruhi proses hukum diversi terhadap perkara pidana kecelakaan lalu lintas yang mengakibatkan tersangka anak dibawah umur pada wilayah hukum Polres Gowa adalah Faktor Hukum, Faktor Penegak Hukum, Faktor Sarana dan Prasarana, Faktor Masyarakat dan Faktor Kebudayaan.. The research objective is to analyze the legal process of diversion in traffic accident criminal cases involving underage suspects at the Gowa Police. This type of research is empirical legal research. The results of the study show (1) The legal process of diversion in traffic accident criminal cases resulting in the suspect being a minor in the jurisdiction of the Gowa Police is carried out with diversion procedures and procedures as stipulated in law number 11 of 2012 concerning the juvenile justice system namely carried out through deliberations involving children and their parents/guardians, victims and/or their parents/guardians, social counsellors, and Professional Social Workers based on a restorative justice approach to reach a mutual agreement (peace) has not run optimally due to several factors (2) Factors that influence the legal process of diversion in traffic accident criminal cases resulting in underage suspects in the jurisdiction of the Gowa Police are Legal Factors, Law Enforcement Factors, Facilities and Infrastructure Factors, Community Factors and Cultural Factors.]]>
