Abstract

Pawnshop’s motto is to solve the problem without any problems that should be upheld as a form of social interaction in the field of Muamalah.But the reality in the society,mortgageis at issue by priests of Islamic sects because that is opposed the concept of Islam that has been previously codified. On the other hand, some scholars of Islam say that Mortgagor(Murtahin)have no right to exploit and use thegoodsthat pawned, and on the other handthere is the process of massive poverty in the society, especially forPledgor (Rohin). Therefore, the middle ground in this issue is the changing mindset of the public in understanding the meaning and the purpose ofmortgage and reformulate that utilization in accordance with Islamic law

Abstract

Najmuddin ath-Thufi is a scholar of fiqh and usulfiqh, born in Thufi Baghdat Iraq. He was a scientist, he studied fiqh, ushulfiqh, Arabic, manthiq, theology, hadith, tafsir, history, and jadal. Ath-Thufi is one of Islamic law philosophy, his theori is adabtabilitas, it’s rule that Islamic law as the law created by God, and can adapt to the times. So, it can be changed in order to realize the benefit of mankind. The framework is the principle Maslahah adaptability. Maslahah principle as a fundamental value for the sustainability of Islamic law in the context of social change, which is able to respond to any social change. This study to determine about al-Thufi theory, maslahah as istinbath Islamic law.

Abstract

According to Clifford Geertz, Islam in Indonesia is a religious tradition that is influenced by religious beliefs, ethnic preferences and political ideologies carried out by Modjokuto people as a reflection of the religious traditions of the Javanese community. Geertz states that the style of Islam in Indonesia, especially Java is syncretic Islam. It was from a combination of Islam and Javanese culture. Islam is only a mere accessory but its substance is a noble Javanese culture. Whereas according to Woodward, that religious conception has a big role in transforming certain cultures in this case is Javanese Islamic culture. According to Woodward, the style of Islam in the archipelago is acculturative. It was from the encounter with the local culture in a very long time.

Abstract

This Islamic law will continue to go along with the dynamics and changing of the era. The more complex real problems in society require fiqh experts to always be sensitive to reality. In producing the law, the jurists use various tools to produce laws that are in harmony with the benefit of mankind. This research is seen from the problems to be examined, the data collected is qualitative because it is in the form of thought, namely the conception of sadd al-dzarî'ah which was built by Islamic legal experts (fuqahâ 'and ushûliyyîn) in general and views on sadd al-dzarî'ah which was designed by Ibn al-Qayyim al-Jauziyah in his book I'lâm al-Muwaqqi'în. The concept of al-Dzarî'ah according to Ibn al-Qayyim can be used as an argument to establish the law. While the legal provisions of al-Dzarî'ah follow its (purpose). If the Ghâyah is in the form of benefit, then al-Dzarî'ah is opened and permitted, whereas if the Ghâyah is in the form of mafsadat, then al-Dzarî'ah is closed and prevented. The latter is what is called Sadd al-Dzarî'ah. For Ibn al-Qayyim Sadd al-Dzarî'ah, it can be used as an argument in determining the law because many texts of the Koran and Sunnah practice the concept of Sadd al-Dzarî'ah. Implicitly, these texts have legalized Sadd al-Dzarî'ah. However, if the practice in the field of Sadd al-Dzarî'ah is contrary to maslahat or hâjat, then Sadd al-Dzarî'ah is defeated. Benefits and hâjat are prioritized more than Sadd al-Dzarî'ah.

Abstract

Prilaku korupsi terjadi dimanapun dan ditempat manapun karena korupsi bisa terjadi disemua tempat dan waktu. Korupsi adalah juga merupakan kejahatan luar biasa karena didalamnya mengerogoti keuangan negara . Rakyat adalah yang dirugikan dalam prilaku korupsi . Di Indonesia korupsi politik semakin mewabah dan dilakukan oleh pelaku yang mempunyai kekuasaan politik. Pimpinan partai politik punya kuasa dan punya peran sentral dalam kekuasaan pimpinan politiknya. Bisa dikedudukan sebagai menteri atau jabatan birokrasi lainnya. Ada karakter hukum dalam korupsi politik dalam melakukan tindakan korupsinya. Di Indonesia punya karakter hukum tersendiri dalam prilaku korupsinya. Budaya ingin hidup mewah dan ingin cepat kaya itu salah satu mengapa melakukan sikap korupsi. Di Amerika Serikat juga terjadi korupsi politik karena pelaku punya kuasa dalam jabatannya. Prilakunya bermacam-macam salah satunya karena punya kuasa dalam jabatanya. Prilaku dan karakter hukum dalam korupsi politik di Indonesia dan Amerika Serikat ada kesamaan prilaku hukumnya. Tentunya dua duanya antara Indonesia dan Amerika Serikat ada sikap hukum dari pemerintah yakni korupsi yang dialkukannya harus ditindak secara hukum. Karakter korupsi politik ada arah dan dampaknya yakni merugikan keuangan negara.

Abstract

Penelitian ini bertujuan untuk mengidentifikasi langkah-langkah dalam menghitung sistem bagi hasil serta membandingkan kesesuaian perlakuan akuntansi pembiayaan mudharabah menurut PSAK No.105. Penelitian ini dilaksanakan di KSPPS . Tipe penelitian yang digunakan adalah kualitatif deskriptif dengan memanfaatkan data primer dan sekunder yang diperoleh melalui wawancara dan pengumpulan dokumen. Temuan dari penelitian ini menunjukkan bahwa metode perhitungan bagi hasil di BMT menggunakan Revenue Sharing, di mana PSAK menjelaskan bahwa metode ini menjadikan laba bruto sebagai dasar distribusi hasil usaha. Terdapat banyak ketidaksesuaian dalam praktik akuntansi yang diterapkan oleh BMT berdasarkan PSAK No.105. Pengakuan beban dan piutang sudah sesuai dengan PSAK No.105, tetapi pengakuan investasi, kerugian, keuntungan, pengukuran, penyajian, dan pengungkapan masih belum sejalan dengan PSAK No.105.
