Abstract

Anak adalah merupakan bagian dari generasi muda, penerus cita-cita perjuanganbangsa, dan sumberdaya manusia bagi pembangunan nasional, maka anak memiliki peranstrategis dan mempunyai ciri serta sifat khusus yang menjamin kelangsungan eksistensibangsa dan negara pada masa depan, maka kehadiran anak merupakan hal terpentingdidalam sebuah keluarga tetapi seringkali manusia dihadapkan pada suatu kenyataan akanketidak kemampuan terhadap takdir dari yang Maha Kuasa dimana keturunan tidak dapatdihadirkan didalam sebuah keluarga, sehingga dalam masyarakat dewasa ini berkembanglembaga pengangkatan anak dalam upaya memenuhi keinginan para orang tua yang tidakmampu memperoleh keturunan. Hukum Islam tidak mengenal pengangkatan anak dengan menasabkan dengan keluargaangkatnya, hanya sebatas hubungan kekeluargaan dan kasih sayang. Prosedur pengangkatananak melalui permohonan yang diajukan pada ketua pengadilan (pengadilan agama) denganmemenuhi syarat-syarat yang ditentukan, sedang akibat pengangkatan anak menurut hukumislam meliputi tentang status nasab, kewarisan, perkawinan, perwalian, dan nafkah.

Abstract

Konsumen tidak mempunyai posisi tawar yang kuat saat berhadapan dengan PDAM Kota Semarang karena sangat bergantun pada air yang dipasok oleh PDAM Kota Semarang. Sebaliknya PDAM Kota Semarang memanfaatkan keadaan mi untuk mengeksploitasi konsumen. Konsumen tidak menuntut sesuai hukumyang berlaku karena budaya hukum konsumen mempunyai penilaian yang negatif terhadap hukum itu sendiri. Akibatnya tidak ada sengketa yang diselesaikan sesuai hukum yang berlaku Pemberdayaan merupakan salah satu cara untuk memberi konsumer, kekuatan agar dapat memperoleh hak-haknya secara mandiri dan mempunyai posisi tawar yang sama dengan PDAM Kota Semarang.

Abstract

Pembagian harta bersama di Indonesia saat ini masih memiliki banyak permasalahan, saat ini banyakdijumpai kasus-kasus tentang pembagian harta bersama yang masih diangap tidak jelas/masih menimbulkanmasalah dalam pembagiannya dan tidak memiliki keadilan khususnya terhadap wanita, atas dasarpermasalahan tersebut maka penelitian ini memiliki tujuan yaitu Untuk mengetahui dan menganalisistentang faktor-faktor yang menyebabkan pembagian harta bersama akibat terjadinya perceraian tidakmelindungi wanita, serta upaya-upaya yang perlu dilakukan oleh para pihak (mantan suami dan isteri)dalam mengatasi permasalahan pembagian harta bersama akibat perceraian, setelah menganalisis tujuanpenelitian tersebut maka diharapkan penelitian ini juga dapat memberikan masukan tentang Bagaimanabentuk perlindungan hukum terhadap wanita dalam pembagian harta bersama akibat perceraian. Penelitianini merupakan penelitian yuridis normatif dengan pendekatan yang digunakan yaitupendekatan perundangundangan, spesifikasi penelitian yaitu deskriptif analitis. data yang digunakan adalah data sekunder yangdidukung oleh data primer, atas data yang digunakan, diperoleh dengan cara studi kepustakaan besertawawancara, data-data yang terkumpul kemudian di analisis secara kualitatif. Hasil penelitian menunjukkanbahwa faktor yang menyebabkan terjadinya pembagian harta bersama yang tidak berkeadilan terhadapwanita disebabkan karena dua faktor yaitu, faktor adanya peleburan harta bersama dan juga adanyapembagian yang didasarkan pada hukum adat. Sejatinya atas faktor tersebut dapat diminimalisir dengancara menmbuat perjanjian perkawinan, yang mengatur tentang pembagian harta bersama setelah adanyaperceraian perlu dilakukan berdasarkan ketentuan yang berlaku, yaitu dibagiseperdua.

Abstract

Abs Rob is an event where sea air rises to inundate the surrounding land, causing environmental problems tract. This condition is the area in North Semarang City as one of the northern coastal areas of Java which is affected by tidal floods that enter villages and even enter people's houses that have not stopped for a long time, resulting in greatly disrupted activities and community access, including economic losses, damage to building facilities and infrastructure and the increasingly damaged environment. The University Service Team on 17 August 1945 Semarang has carried out socialization and assistance to communities affected by the tidal wave in the North Semarang area, especially the North Tanjung Mas Village with the Independent Learning Policy Program for the Independent Campus and received funding assistance from the Directorate General of the Ministry of Education, Research and Technology in 2021 and the results of the Service. this has been presented. The method of implementing community service is carried out by Tanjungmas Village, North Semarang District divided into two types of activities, namely: (1) Socialization activities and (2) Assistance for community groups in improving collaborative community service involving five parties (Pentahelic Approach) by involving regional officials ( in this case the Regional Disaster Management Agency, Bappeda, North Semarang District and Tanjungmas Village) as the regulator and executor of authority in the context of disaster management. There are several problems or obstacles found in the outreach and mentoring activities, namely the low capacity of human resources and the capacity of community institutions in Tanjungmas sub-district, low community involvement in tidal disaster management efforts, both individually and in institutions.

Abstract

Law number 28 of 2004 amendments to law number 16 of 2001 concerning foundations, in article 5 paragraph (1) explains that the assets of foundations are stopped or distributed directly or indirectly. In fact, there is a hospital from a foundation which, due to being pressured by the need to improve hospital management, the foundation which manages the hospital business unit forms a pt to manage the hospital business unit. This research discusses the role of a notary in the process of transferring assets from a hospital foundation to a hospital in the form of a limited liability company and what is the mechanism for the process of transferring assets from a hospital foundation to a hospital in the form of a limited liability company and what are the responsibilities of legal organ foundations in an effort to transfer the assets of a hospital foundation hospital to a hospital in the form of a limited liability company. This research is a normative juridical research with an approach based on the main legal material by examining the theories, concepts, legal principles and laws and regulations related to research. The results of the analysis are presented qualitatively. Data in the field was taken through interviews with the foundation and notary who made the lease deed. The results of this study are the role of the notary in the transfer of assets, namely the role of the notary as the maker of the land lease agreement owned by pt husada to khoirunissa hospital. The mechanism for the process of transferring assets from a hospital foundation to a hospital in the form of a pt is through a lease agreement. PT. Husada leases its assets in the form of land and is leased by the khoirunisa foundation on which a foundation hospital is built called rsia umi barokah.

Abstract

Tax on Acquisition of Land and Building Rights (Pajak Perolehan Hak atas Tanah dan Bangunan/BPHTB) is a tax that is imposed or must be paid by the taxpayer in connection with the transfer of Land and Building Rights. In Islam, the existence of heirs and heirs is regulated in the Qur’an contained in Sura al-Nisa. Inherited assets in the form of land and buildings, which are the right of heirs, can be owned by one of the heirs by buying or paying the other heirs. It is stated in the Deed of Sharing of Joint Rights (Akta Pembagian Hak Bersama/APHB) made by the Land Deed Making Official (Pejabat Pembuat Akta Tanah/PPAT). The results showed: 1) According to Islamic law, the calculation of the amount of BPHTB tax is not the same as the amount of tax calculated based on Law No. 20 of 2000 concerning Customs for Acquisition of Rights on Land and Buildings; this is related to the determination of the amount of inheritance received, where the amount depends on the number of inheritance rights holders and their gender and nasab and religious relationships. 2) The process of determining the number of taxpayers in the Customs Tax on Land and Building Rights, which is associated with tax validation, often creates uncertainty, both the transaction value can change, and the calculation and the amount of tax that must be paid by the taxpayer this is because the Regional Revenue Agency (Badan Pendapatan Daerah/BAPENDA) local does not have a fixed reference. PPAT’s role is to help calculate the amount of the BPHTB tax and pay it to the tax office. Abstrak Pajak Perolehan Hak atas Tanah dan Bangunan (BPHTB) adalah pajak yang dikenakan atau harus dibayar oleh Wajib Pajak sehubungan dengan peralihan Hak atas Tanah dan Bangunan. Dalam Islam, keberadaan ahli waris dan ahli waris diatur dalam Alquran yang tertuang dalam Surah al-Nisa. Harta warisan berupa tanah dan bangunan yang menjadi hak ahli waris dapat dimiliki oleh salah satu ahli waris dengan cara membeli atau membayar kepada ahli waris lainnya, hal ini dituangkan dalam Akta Pembagian Hak Bersama (APHB) yang dibuat oleh Pejabat Pembuat Akta Tanah (PPAT). Pembahasan: 1) Menurut hukum Islam perhitungan besarnya pajak BPHTB tidak sama dengan besarnya pajak yang dihitung berdasarkan Undang-Undang Nomor 20 Tahun 2000 tentang Kepabeanan Perolehan Hak atas Tanah dan Bangunan, hal ini terkait dengan penentuan besarnya harta warisan yang diterima, dimana besarnya tergantung dari banyaknya pemegang hak waris dan jenis kelamin serta hubungan nasab dan agamanya. 2) Proses penetapan jumlah wajib pajak dalam Bea Cukai Hak atas Tanah dan Bangunan yang dikaitkan dengan pengesahan pajak seringkali menimbulkan ketidakpastian, baik nilai transaksi dapat berubah, penghitungan maupun besarnya pajak yang harus dibayar oleh wajib pajak hal ini karena Badan Pendapatan Daerah (BAPENDA) setempat tidak memiliki acuan tetap. Peran PPAT adalah membantu menghitung besaran pajak BPHTB dan menyetorkannya ke kantor pajak. Kata kunci: Pejabat Pembuat Akta Tanah, Warisan, Hukum Islam, Perolehan Hak atas Tanah dan Bangunan

Abstract

Undang-undang No. 28 Tahun 2004 perubahan atas UU No. 16 Tahun 2001 tentang Yayasan, dalam Pasal 5 ayat (1) menjelaskan bahwa kekayaan Yayasan dilarang dialihkan atau dibagikan secara langsung atau tidak langsung. Faktanya, terdapat Rumah Sakit dari suatu Yayasan yang karena terdesak oleh kebutuhan peningkatan manajemen Rumah Sakit, Yayasan tersebut yang mengelola unit usaha Rumah Sakit membentuk PT untuk mengelola unit usaha Rumah Sakit. Dalam penelitian ini dibahas tentang peran Notaris dalam proses peralihan aset Yayasan Rumah Sakit kepada Rumah Sakit yang berbentuk Perseroan Terbatas dan bagiamana mekanisme proses peralihan aset Yayasan Rumah Sakit kepada Rumah Sakit yang berbentuk Perseroan Terbatas serta bagaimana tanggung jawab hukum organ yayasan dalam upaya peralihan aset Yayasan Rumah Sakit kepada Rumah Sakit yang berbentuk Perseroan Terbatas. Penelitian ini adalah penelitian Yuridis normatif dengan pendekatan yang dilakukan berdasarkan bahan hukum utama dengan cara menelaah teori-teori, konsep-konsep, asas-asas hukum serta peraturan perundang-undangan yang berhubungan dengan penelitian. Hasil analisis disajikan secara Kualitatif. Data di lapangan diambil melalui wawancara dengan Pihak Yayasan dan Notaris yang membuat akta sewa menyewa tersebut. Hasil Penelitian ini adalah peran Notaris dalam peralihan aset tersebut adalah Notaris berperan sebagai pembuat perjanjian sewa menyewa atas tanah milik PT Husada kepada Rumah Sakit Khoirunissa. Mekanisme proses peralihan aset Yayasan Rumah Sakit kepada Rumah Sakit yang berbentuk PT adalah melalui perjanjian sewa menyewa. PT Husada menyewakan assetnya berupa tanah dan disewa oleh Yayasan Khoirunisa yang diatasnya didirikan sebuah Rumah Sakit Yayasan bernama RSIA Umi Barokah. This research is normative juridical research based on the main legal material by examining theories, concepts, legal principles, and legislation related to research. The results of the analysis are presented qualitatively. Data in the field was taken through interviews with the Foundation and the Notary who made the lease deed. The result of this research is that the role of the Notary in the transfer of assets is that the Notary acts as the maker of the lease agreement on the land owned by PT Husada to the Khoirunissa Hospital. The mechanism for the process of transferring the assets of the Hospital Foundation to the hospital in the form of a PT is through a lease agreement. PT Husada leases its assets in the form of land and is rented by the Khoirunisa Foundation, on which a Foundation Hospital was established named RSIA Umi Barokah. Abstract

Inheritance law in the BW is basically regulatory and there is no element of coercion. The heir has the right to do anything with his property as long as he is still alive. However, the treatment of his assets must not violate the legitimacy of the portie or the absolute rights of the legal heirs. If the right of legitieme portie is violated, all the actions of the heirs are null and void as long as the demands of the heirs are valid. The purpose of this research is to find out the legal consequences of annulment of wills and awarding of deed for violating the legitieme portie. The method of analysis was carried out using a case study of the Supreme Court Decision. The results of the analysis of the case filed a lawsuit for Budijono Hartono's inheritance between Budijono Hartono's legitimate child as the legal heir and Budijono Hartono's wife, the Court judge decided to cancel the Will and Grant Deed for violating the legitieme portie, as a consequence of not fulfilling the provisions in the laws and regulations on the seduction of legitimaries. Deeds of wills and deed of grants are declared to have no legal force so that all assets listed in the deed of wills and grants are included in the boedel to be divided among all the heirs.
