Abstract

There is a constitutional status quo regarding the urgency of establishing the Emergency Government of the Republic of Indonesia or Pemerintah Darurat Republik Indonesia (PDRI). The military aggression was carried out by the Dutch who had seized Yogyakarta's position as the State Capital and kidnapped President Soekarno, and Vice President Moh. Hatta and several ministers put the position and sustainability of the Indonesian state at stake. This paper discusses the urgency of the establishment of the PDRI and explores its constitutionality in a review of the state of emergency and the Triumvirate concept. Using the normative juridical historical research method, this paper discusses two findings: First, the formation of the Emergency Government of the Republic of Indonesia was motivated by the Dutch Military Aggression incident which occupied the State Capital of Yogyakarta and kidnapped the President, Vice President and several State Ministers resulting in a state crisis and a government vacuum. Second, the formation of PDRI using Law Number 6 of 1946 which contains Article 12 of the Constitution is included in the emergency legal regime. The appointment of Mr Sjafruddin Prawiranegara who at that time was the Minister of Prosperity received a direct mandate from President Soekarno to form the PDRI based on a telegram dated December 19, 1948. Although the mechanism for establishing an emergency government in the form of a triumvirate has not been regulated in the constitution, this is not a constitutional deviation as is known in the state of emergency doctrine.

Abstract

Perdebatan mengadili sengketa hasil Pemilu dan Pilkada menjadi tanggung jawab Mahkamah Konstitusi, meski terdapat hal yang berlawanan dari Putusan MK No. 97/PUU-XI/2013 dengan 85/PUU-XX/2022. Fenomena paradoks ini kemudian menjadi sisi yang menarik dan unik untuk dibahas dan dikaji secara mendalam serta menimbulkan pertanyaan mengapa tidak terdapat keserasian pada putusan Mahkamah Konstitusi bahkan kewenanganNya sudah melampaui batas yang ditentukan. Artikel ini menggunakan metode penelitian Doktrinal yang berorientasi deskripsi  analisis  terhadap hasil dari kepustakaan, hasil kajian menunjukkan bahwa badan peradilan khusus Pilkada masih dibutuhkan terlebih dalam menangani persoalan sebagaimana adanya konflik pelanggaran kode etik, konflik pelaku tindak pidana dll. Keberadaan badan peradilan khusus masih perlu untuk dikonstruksikan kembali konstitusionalnya.

Abstract

This study explores the role of mediators in Indonesia’s Islamic Courts, focusing on their unique integration of Islamic principles with Asian family mediation practices in divorce cases. Unlike the theoretical model of mediation, which emphasizes mediators as neutral facilitators without providing advice, mediators in Indonesia’s Islamic Courts adopt a distinctive approach. They incorporate Islamic values, often offering moral and religious guidance, while also drawing on Asian family-court traditions that prioritize familial harmony and community involvement. This study uses the qualitative framework to analyze divorce mediation approach in court and its dynamics in divorce cases. Moreover, observation and interview are methods that applied to get comprehensive picture in the mediation process such as the individual experiences of each party, the dynamics of the relationships between the parties and between the parties and the mediator, and the mediator's perspective on the case, the parties, and the resolution of the case. In-depth interviews were conducted with non-judge mediators and the disputing parties at the South Jakarta Religious Court.  This paper highlights how these mediators navigate cultural, religious, and legal dimensions to address divorce disputes. The findings reveal a fusion mediation model that challenges conventional Western approach  offering insights into culturally sensitive dispute resolution in Islamic legal contexts

Abstract

The Covid-19 virus has spread worldwide at an alarming rate, infecting millions who are expecting government assistance during the pandemic. This research aimed to evaluate the distribution process of the social assistance provided by the Indonesian government during the Covid-19 pandemic. A quick online survey was conducted on 279 respondents from 12 provinces in Indonesia. Furthermore, interviews were also conducted with seven informants to strengthen the quick survey's results, a form of triangulation method. The results show that most respondents felt that the distribution of social assistance during the pandemic was not transparent and on target, partly due to separate budget allocations between several ministries, inaccurate data and unintegrated data. Strengthening the role of local government and increasing the involvement of community organizations as well as the flexibility to adjust the form and mechanism of social assistance, are the recommendations of this study.
