Abstract

This study aims to determine the meaning of the almsgiving earth tradition in people's lives and the correlation of the meanings of the almsround earth tradition in the perspective of the value of environmental protection and management. This research method uses normative legal research with a statutory and conceptual approach. As for the results of the research that the almsgiving earth tradition in people's lives in principle has values including the values ​​of hablum minallah, hablum minannas and hablumminal alam, while the meaning of the alms earth tradition has a correlation with the values ​​or principles of environmental protection and management, namely with some values ​​or principles include; the value of sustainability and sustainability, the value of harmony and balance, the value of integration, the value of utilization, the value of prudence, the value of justice, the value of participatory and the value of local wisdom, from this correlation it is hoped that the values of almsgiving can encourage the birth of habits from human awareness as khalifatul fil ardhi to position the environment as a subject that has fundamental rights (human rights as nature/environment) as well as human positions to be protected so that in the end between the environment and humans protect and love one another.

Abstract

Korupsi di Badan Usaha Milik Negara (BUMN), khususnya di PT Pertamina (Persero), merupakan tantangan sistemik yang menghambat pembangunan nasional dan merusak kepercayaan publik. Penelitian ini bertujuan untuk menganalisis akuntabilitas hukum atas korupsi sistemik dalam investasi BUMN, dengan fokus pada skandal pencampuran bahan bakar ilegal yang melibatkan Pertamina Patra Niaga. Menggunakan metodologi penelitian hukum kualitatif dan normatif, artikel ini mengkaji penerapan teori dualistik dalam mengevaluasi pertanggungjawaban pidana. Temuan menunjukkan bahwa korupsi di Pertamina sering kali merupakan manifestasi dari disfungsi struktural, lemahnya pengawasan, dan intervensi politik dalam pengambilan keputusan strategis. Akuntabilitas hukum ditegakkan melalui UU Pemberantasan Tindak Pidana Korupsi dengan menerapkan prinsip tanggung jawab komando untuk menjerat pejabat tinggi atas kegagalan sistemik. Lebih lanjut, penelitian ini menyoroti bahwa korupsi tersebut menyebabkan kerugian negara yang sangat besar diperkirakan mencapai ratusan triliun rupiah serta menimbulkan dampak ekologis akibat kualitas bahan bakar yang tidak sesuai standar. Penyelesaian yang efektif memerlukan pendekatan komprehensif, termasuk reformasi tata kelola struktural, audit independen, dan penerapan prinsip lex specialis secara konsisten untuk memulihkan legitimasi publik dan menjamin kepastian hukum.

Abstract

This study examines the relevance of village cooperatives from a human rights perspective, particularly in fulfilling economic, social, and cultural rights (ESCR) in rural communities. Using a normative legal research method, this study analyzes statutory regulations, legal doctrines, and human rights principles at both national and international levels. The findings indicate that village cooperatives, as community-based economic institutions grounded in the principles of mutual cooperation and economic democracy, have strong potential to function as instruments for the realization of human rights. Village cooperatives contribute to the fulfillment of economic rights by providing access to capital, employment opportunities, and market participation, thereby improving community welfare and reducing poverty. In addition, they support social and cultural rights through the provision of basic services, strengthening social solidarity, and preserving local cultural values. However, the effectiveness of village cooperatives remains constrained by challenges such as limited managerial capacity, restricted access to resources, and the lack of integration of human rights principles into cooperative governance. This study emphasizes the importance of strengthening village cooperatives through a human rights-based approach by enhancing institutional capacity, improving policy support, and promoting active community participation. By doing so, village cooperatives can serve as strategic instruments for achieving inclusive, equitable, and sustainable rural development
