Abstract

AbstractLaundry is known as one of the rapidest growing businesses in Jebres District, Surakarta City. The presence of laundry makes it easy for people who live around such as residents, workers, especially students, because it can reduce the burden of homework they have without spending much energy and the price is affordable. As a business, laundry in its establishment requires a permit. The existence of permit is certainly associated to the role of Notary. The lack of knowledge that opening a business must have a permit, most of laundry in Jebres sub-district still not licensed. The analysis conducted during this thesis is an empirical study conducted from interviews with several experts in their fields and reference review. The conclusion obtained throughout this study is that the role of the Notary public in granting licensing for the concern of a business, which is a laundry business. In terms of the management of the business license, the laundry business owner has not been distributed properly bevause of lack of literacy of the law. Relating the licensing of the establishment of a laundry business, it’s hoped the notary can provide education such as counseling on laundry that does not carry out its obligations.Keywords: laundry; notary public; permissionAbstrakUsaha laundry dapat dikatakan sebagai salah satu usaha yang berkembang pesat di Kecamatan Jebres Kota Surakarta. Kehadiran laundry memberikan kemudahan bagi masyarakat yang tinggal di sekitar seperti warga, mahasiswa, pekerja, terutama mahasiswa, karena dapat mengurangi beban pekerjaan rumah yang dimiliki tanpa menghabiskan banyak tenaga dan harganya dapat dijangkau bagi masyarakat. Laundry merupakan penyediaan jasa yang dilakukan terhadap proses pencucian pakaian. Laundry merupakan sebuah usaha, yang dalam pendiriannya membutuhkan izin. Adanya perizinan tentunya berkaitan dengan peran Notaris. Minimnya pengetahuan bahwa membuka usaha harus memiliki izin, maka banyak sekali laundry di kecamatan Jebres yang masih belum berizin. Dampaknya usaha tersebut tidak terlindungi secara hukum dan tidak sah. Penelitian yang dilakukan ini merupakan studi empiris yang dilakukan dari wawancara dengan beberapa ahli dalam bidangnya dan tinjauan pustaka. Kesimpulan yang didapat dalam penelitian ini adalah peran Notaris dalam pemberian perizinan berdirinya suatu usaha, yang merupakan usaha laundry. Dalam hal pengurusan izin usaha itu belum dilakukan dengan baik oleh pemilik usaha laundry karena kurang meleknya/kepahaman mengenai hukum, keengganan berurusan dengan hukum atau dapat dikatakan kurangnya kesadaran untuk membuat perizinan pendirian usaha laundry. Terkait dengan perizinan pendirian usaha laundry, diharapkan notaris dapat memberikan edukasi seperti penyuluhan terhadap laundry yang tidak melaksanakan kewajibannya.Kata kunci: laundry; notaris; perizinan

Abstract

Land law policy covers fundamental aspects, namely the principle of fulfilling the people’s constitutional rights to meet daily life’s needs and respect the principle of human equality. One of the objectives of the establishment of the Republic of Indonesia, as mandated by the 1945 Constitution, is to realize public welfare. The government’s main task is to create a government management system that can properly manage national resources to achieve prosperity and prosperity and social justice for all the people of Indonesia. The government must be able to realize land law reform, especially public services in the land sector. The formation of the National Bureaucracy Reform Committee is aimed at continuing the government’s plans that have not been effective, namely the creation of an accountable, productive, professional, and free of corruption bureaucracy. The most important improvement effort on land law reform is to reconstruct the land registration system in realizing the industrial revolution 4.0, in the form of an electronic certificate on land as a form of creativity and innovation to grow and develop digital technology while forming a legal culture in bureaucratic services and strong public services. Abstrak Kebijaksanaan hukum pertanahan mencakup aspek-aspek mendasar, yaitu asas pemenuhan hak konstitusional rakyat untuk memenuhi kebutuhan hidup sehari-hari dan menjunjung tinggi asas persamaan hak asasi manusia. Salah satu tujuan berdirinya Negara Republik Indonesia sebagaimana diamanatkan oleh UUD 1945 adalah untuk mewujudkan kesejahteraan umum. Tugas pokok pemerintah adalah mewujudkan sistem penyelenggaraan pemerintahan yang dapat mengelola sumber daya nasional dengan baik untuk tercapainya kemakmuran dan kesejahteraan serta keadilan sosial bagi seluruh rakyat Indonesia. Pemerintah harus mampu mewujudkan reformasi hukum pertanahan, khususnya pelayanan publik di bidang pertanahan. Pembentukan Komite Reformasi Birokrasi Nasional bertujuan untuk melanjutkan rencana pemerintah yang belum efektif, yaitu mewujudkan birokrasi yang akuntabel, produktif, profesional dan bebas korupsi. Upaya pembenahan reformasi hukum pertanahan yang terpenting adalah merekonstruksi sistem pendaftaran tanah dalam mewujudkan revolusi industri 4.0, berupa sertifikat tanah elektronik sebagai bentuk kreativitas dan inovasi menumbuhkan dan mengembangkan teknologi digital, sekaligus membentuk budaya hukum. dalam pelayanan birokrasi dan pelayanan publik yang kuat. Abstract

The problem of narcotics is currently rife in Indonesia. The rise of drug cases is common among teenagers, especially. The territory of Indonesia is very strategic because of its extensive area with various small islands. Drug abuse is a criminal act because three things cause it: the first is applying criminal law, prevention without criminal punishment, and the last one that can make people's views of drug abuse users wrong. Abstract

This study discusses the application of the legal position of the presumption of innocence in efforts to protect notaries regarding the making of authentic deeds in Pekalongan Regency. The position of a notary as a public official is related to making an authentic deed. The problems in this thesis are 1) constraints and solutions to the application of the presumption of innocence regarding the legal protection of a notary regarding the making of an Authentic deed by a notary 2) efforts to protect the notary regarding the deed he has made. The purpose of this study is to identify and analyze the obstacles and solutions to the application of the presumption of innocence regarding the legal protection of a notary regarding the making of an authentic deed by a notary. The method used in this research is a sociological juridical approach. The specification of this research uses descriptive analysis. The types and sources of data used in this study are primary data, namely from interviews, while secondary data is obtained through library research. The data collected in this study was divided into 2 (two), namely primary data collection which was carried out by interviews and secondary data collection which was carried out by collecting data contained in laws and regulations, articles, books and others. The data analysis method used in analyzing the data is qualitative analysis. Authentic deed essentially contains formal truth according to which the Notary is responsible for what is witnessed, namely what is seen, heard and also carried out by the Notary as a public official in carrying out his position. Notary legal protection is carried out by UUJN, Notary Association.Keywords: Authentic; Innocence; Presumption; Protection.

Abstract

Abstract. Notaries are authorized to create authentic deeds under the Notary Law, including credit agreements secured by certificates to provide legal certainty for creditors and debtors. However, in practice, disputes often arise when one party reneges on their signature, as in Pati District Court Decision Number 10/Pdt.G/2023/PN.Pti. This situation emphasizes the need for legal protection for notaries who have carried out their duties in accordance with the provisions, so that they are not burdened with responsibility for the actions of parties who do not act in good faith. This study analyzes the protection of the notary's position and also analyzes the judge's considerations in the decision. This study uses a normative juridical approach, employing a statute approach and a case approach. This type of research is normative. The data sources and types are secondary data obtained through literature review. The analysis is prescriptive. The results show that in the legal protection of professional positions, a notary can undertake two legal protection measures: preventive measures to prevent disputes from arising, and repressive measures through the courts. In the judge's considerations in case number:10/Pdt.G/2023/Pn.Pti, emphasized that legal reasoning must be based on facts, evidence, and applicable legal regulations. This dispute stems from the plaintiff's claim that he never signed a power of attorney or credit guarantee deed. However, it was legally proven that there was a Special Power of Attorney dated February 28, 2013, signed by the plaintiff. Because the plaintiff could not prove any forgery of the signature, the lawsuit was rejected in its entirety by the panel of judges. This decision emphasizes the importance of the principle of legal certainty. As long as there is no criminal decision related to forgery, the deed and power of attorney remain valid. Keywords: Credit; Guarantee; Notary; Notarial Deed; Protection.

Abstract

Artikel ini mengkaji disharmoni norma antara Pasal 28–30 Permenkumham No. 17 Tahun 2021 dengan Pasal 66 Undang-Undang Jabatan Notaris (UUJN). Permasalahan utama terletak pada perluasan kewenangan pemanggilan notaris yang seharusnya hanya untuk kepentingan peradilan, namun dipaksakan berlaku sejak tahap penyidikan dan penuntutan. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan teori hukum (Stufenbau Theory Hans Kelsen). Hasil penelitian menunjukkan bahwa Permenkumham ini bertentangan dengan hierarki peraturan perundang-undangan, melampaui kewenangan (ultra vires), dan berpotensi melemahkan perlindungan profesi notaris. Artikel ini merekomendasikan adanya uji materiil ke Mahkamah Agung serta revisi regulasi agar selaras dengan UUJN dan asas perlindungan profesi hukum.
