Abstract

Beberapa produk hukum di Kampung terdiri atas Peraturan Kampung, Peraturan Bersama Kepala Kampung, dan Peraturan Kepala Kampung. Peraturan tertinggi yang ada di kampung yang dibuat secara bersama-sama oleh Kepala Kampung, aparat kampung dan Badan Musyawarah Kampung yang mendasarkan diri pada partisipasi masyarakat adalah Peraturan Kampung. Peraturan dibuat untuk mengatur urusan rumah tangga di Kampung. Ruang lingkup berlakunya hanya pada Kampung dimana peraturan Kampung itu dibuat. Peraturan Kepala Kampung ini merupakan peraturan yang materi muatan merupakan penjabaran dari Peraturan Kampun atau peraturan yang materi muatannya berdasarkan aspirasi masyarakat. Peraturan Bersama Kepala Kampung Peraturan ini merupakan peraturan yang materi muatan merupakan kesepakatan bersama antara dua Kampung atau lebih. Pengabdian masyarakat dalam bentuk KKN ini bertujuan untuk mengedukasi aparat kampung agar pemahaman terhadap penyusunan peraturan kampung dapat bertambah. Dengan adanya pemahaman yang bertambah maka akan ada koordinasi yang lebih antara masyarakat dan aparat kampung dalam penyusunan suatu pearturan kampung yang ada di kampung tobati. Sebab peratura kampung yang baik adalah peraturan kampung yang disusun atas aspirasi yang diterima oleh masyarakat dan disampaikan melalui Bamuskam yang ada di kampung tersebut. Hasil Pengabdian ini adalah masyarakat sangat antusias dalam mendengarkan penyampaian materi oleh narasuber dalam hal teknik penyusunan peraturan kampung.Kata kunci: Bamuskam, Penyusunan, Peraturan Kampung

Abstract

Burning forests or land is a crime that must be combated comprehensively by every party. One effort to punish perpetrators of forest or land burning is to impose a prison sentence and the maximum possible fine, to act as a deterrent and serve as a lesson to those who commit this act. The emergence of disharmonization between Law No. 32 of 2009 concerning Environmental Protection and Management and Law No. 39 of 2014 concerning Plantations regarding criminal sanctions against perpetrators of land burning is studied with the assumption that what is happening is the result of a malfunction of the law and related law enforcement. with land fires as expected. The type of research used is normative juridical legal research, namely research that focuses on examining the application of rules or norms in positive law. The existence of multiple interpretation articles has hampered the achievement of legal objectives, namely providing a sense of justice, legal certainty and legal benefits. This multi-interpretation article creates legal uncertainty due to the variety of judges' decisions on the same case. Law Number 32 of 2009 concerning Environmental Protection and Management and Law Number 39 of 2014 concerning Plantations are also less useful because they cause fear in the community, thereby triggering unrest in society. Commission I DPR RI needs to immediately revise or harmonize Law Number 32 of 2009 concerning Environmental Protection and Management and Law Number 39 of 2014 concerning Plantations, especially regarding restrictions or benchmarks for offenses and the application of criminal sanctions.

Abstract

This research examines the legal framework of the Presidential Threshold (PT) as stipulated in Law Number 7 of 2017 concerning General Elections, analyzing its effects on political stability, democratic representation, and the inclusiveness of the political process. Using a qualitative approach through literature study, the research reveals that while the PT mechanism, which requires a party or coalition to hold at least 20% of parliamentary seats or 25% of the national vote, contributes to reducing electoral fragmentation and promoting political stability, it also limits the diversity of candidates and political ideologies, potentially undermining democratic principles. The study highlights how this statutory provision restricts the participation of smaller political parties and independent candidates, consolidating power within larger political coalitions. It also raises constitutional concerns regarding the right to political participation under the 1945 Constitution and the fairness of the electoral system. The findings suggest that reforms to the legal basis of the PT, such as lowering the threshold or exploring alternative electoral systems, could enhance the inclusivity and representativeness of Indonesia’s presidential election process. Future research should focus on assessing the long-term effects of the PT's legal design on voter engagement and political trust in Indonesia.

Abstract

This research analyzes the position and functions of the Regional Secretary (Sekda) in the regional government administration system based on statutory provisions and examines its implementation in Puncak District. Using normative legal research methods with statutory and conceptual approaches, this study analyzes Law No. 23 of 2014 on Regional Government, Government Regulation no. 18 of 2016 on Regional Apparatus, and current state administrative law literature. The findings show that the Regional Secretary has a strategic legal position as a staff element of regional government responsible for assisting the Regional Head in policy formulation and coordinating government implementation. Functionally, the Regional Secretary acts as an administrative law bridge between political policy and regional bureaucratic implementation. In practice in Puncak District, the Regional Secretary's function faces challenges including limited human resources, difficult geographic conditions, and local political dynamics. Nevertheless, the Regional Secretary has made optimization efforts through strengthening administrative systems, civil servant development, and implementing good governance principles. In conclusion, the Regional Secretary's function reflects the application of rule of law principles and serves as an important instrument in realizing effective, transparent, and accountable regional government governance. This study recommends strengthening administrative law capacity for regional officials and improving ASN professionalism to optimize Sekda's functions
