Abstract

Haryono No. 169 Malang e-mail: dyahkemalahayati_03@student.ub.ac.id ABSTRAK Penelitian ini, membahas mengenai urgensi pengaturan perizinan pada kendaraan autopilot (artificial intelligence). Dalam hal ini terjadi kekosongan hukum pada pengaturan perizinan pengemudi pada kendaraan autopilot (artificial intelligence). Tujuan penelitian ini untuk mengetahui dan menganalisis hukum positif Indonesia dalam mengatur perizinan pengemudi pada penggunaan kendaraan dengan sistem autopilot (artificial intelligence) serta urgensi perizinan pengemudi dalam penggunaan kendaraan dengan sistem autopilot (artificial intelligence). Penelitian ini merupakan penelitian yuridis normatif dengan pendekаtаn perundаng-undаngаn, pendekatan konseptual, dan pendekatan komparatif. Hasil dari penelitian ini menunjukan bahwa hukum positif Indonesia dalam mengatur perizinan pengemudi pada penggunaan kendaraan dengan sistem autopilot (artificial intelligence) ditinjau dari hukum lalu lintas dan angkutan jalan di Indoensia sudah tidak relevan apabila dibenturkan dengan fitur kendaraan berbasis autopilot (artificial intelligence) karena kendaraan tidak dikendalikan oleh orang melainkan komputer yang mengambil alih kemudi kendaraan. Perbandingan peraturan kendaraan artificial intelligence di negara Jerman dan negara Korea Selatan belum mengatur perizinan pengemudi kendaraan berbasis artificial intelligence. Urgensi peraturan hukum pengemudi kendaraan autopilot (artificial intelligence) bertujuan untuk memberikan kepastian hukum sebagai legalitas pada pengemudi kendaraan yang berbasis autopilot (artificial intelligence). Maka, perlu adanya pengaturan yang mengakomodir status perizinan pengemudi kendaraan autopilot (artificial intelligence) dengan kualifikasi pengemudi kendaraan tersebut. Kata Kunci: Artificial Intelligence, Perizinan, Pengemudi ABSTRACT This research discusses the urgency of regulating license regarding autopilot Vehicles (artificial intelligence). There has been a legal loophole in the permit issuance allowing for the operation of autopilot vehicles. Departing from this issue, this research aims to analyze the positive law of Indonesia in governing the license released for autopilot vehicles (artificial intelligence) and the use of these vehicles (artificial intelligence). This research referred to normative-juridical methods and statutory, conceptual, and comparative approaches. The research results discover that the positive law in Indonesia governing this matter is no longer relevant to the presence of autopilot vehicles (artificial intelligence), considering that such vehicles are not driven by humans but rather by computers. Germany and South Korea also have not regulated this matter. This urgency of the issuance of the license for autopilot vehicles (artificial intelligence) is intended to assure legal certainty and legality for the drivers of autopilot vehicles (artificial intelligence). Thus, it is considered necessary to accommodate the status of the license of the drivers of autopilot vehicles (artificial intelligence) according to the qualifications of the drivers of the vehicles. Abstract

One developmentartificial intelligence is a vehicle with an autopilot function. This issue needs to be regulated in Law Number 22 of 2009 concerning Road Traffic and Transportation, which does not accommodate the regulation of determining driving areas for autopilot-based vehicles. The added value of this article is that it discusses the settings for determining driving areas in autopilot-based vehicles. The aim of this research is analyzing the urgency of determining driving areas for vehicles with an autopilot system as well as reconstructing traffic and road transport laws regarding determining driving areas for autopilot-based vehicles. This research uses a normative juridical research method with a conceptual approach, a legislative approach and a comparative approach through a comparison of vehicle regulation laws with AI systems in Germany, South Korea and the United States. The results of this research show that the consideration and importance of determining the driving area in vehicles with the systemAutopilot is the level of safety and vehicle autopilot system, the condition of road infrastructure in Indonesia which must be adjusted to the autopilot system, traffic density in Indonesia and the potential risks and impacts on the safety of other road users. It is necessary to reconstruct the determination of autopilot-based vehicle driving areas in law number 22 of 2009 concerning road traffic and transportation.
