Abstract

Tindak pidana perbankan merupakan tindak pidana khusus yang di tangani oleh Subdit Fismondev  Polda Bengkulu. Penyidik Subdit Fismondev telah melakukan  penyelesaian terhadap kasus PT BPRS Safir Bengkulu, yang dalam penyelesaiannya terdapat beberapa hambatan. Melalui Undang-Undang Republik Indonesia Nomor  21 Tahun 2008 tentang Perbankan Syariah pemerintah Republik Indonesia telah serius dalam menangulangi kejahatan perbankan syariah, dengan adanya Undang-Undang ini maka dapat dijadikan landasan Penyidik  Subdit Fismondev Bengkulu dalam melakukan peran penyelesaian tindak pidana perbankan di Polda Bengkulu. Tujuan penelitian ini adalah untuk mengetahui bagaimana peranan penyidik Subdit Fismondev Polda Bengkulu dalam melakukan peran penyelesaian tindak pidana perbankan pada PT BPRS Safir Bengkulu dan upaya mengatasi hambatan yang terjadi pada penyelesaian tindak pidana perbankan pada PT BPRS Safir Bengkulu. Penelitian ini adalah penelitian hukum empiris atau Law in action, penelitian ini menggunakan data primer dan data sekunder yang diperoleh melalui wawancara langsung maupun studi dokumen. Data yang diperoleh akan diolah dengan teknik editing kemudian dianalisis dengan metode analisis kualitatif. Hasil penelitian menunjukkan bahwa peran penyidik Subdit Fismondev melakukan peran penyelesaian tindak pidana perbankan di Polda Bengkulu belum berperan secara maksimal terlihat dari beberapa hambatan yang dihadapi penyidik dalam melakukan penyidikan. Upaya Penyidik Subdit Fismondev dalam menanggulangi hambatan yang terjadi pada penyelesaian tindak pidana perbankan adalah dengan menggunakan dokumen yang ada dan berhubungan untuk memback-up dokumen-dokumen yang tidak ditemukan. melakukan koordinasi kepada pihak Otoritas Jasa Keuangan (OJK) dan melakukan pelatihan dan penambahan personil guna meningkatkan kemampuan penyidik Subdit Fismondev terhadap tindak pidana perbankan.

Abstract

This research aims to explore the basics of the idea of abolishing criminal justice in Indonesia and possible alternative solutions to problems that arise in prisons, especially from a theoretical perspective and comparison with Islamic law and customary law. The legal research method in this research is normative (doctrinal), research activities carried out include inventorying, explaining, interpreting and systematizing and broadcasting all Islamic law and customary law, which are related to the idea of abolishing prison sentences. The results of the research show that imprisonment is not recognized in the Islamic view, whereas currently imprisonment is acceptable only as long as the punishment provides a lot of benefits or kindness or benefits to society. Thus, imprisonment is not an absolute in the view of Islamic law. Based on the inventory of customary law as the original unwritten law of the Indonesian nation, no form of imprisonment was found. Therefore, without imprisonment, customary law can be enforced to maintain order and create justice in Indonesian society. From this analysis, especially related to the study of Islamic law and customary law, it is concluded that imprisonment can be considered for abolition if its shortcomings are more dominant than its benefits. Apart from that, the Indonesian Government should provide a forum for the idea of privatizing correctional institutions in the sense that the management of correctional institutions is carried out by private parties on a non-profit basis.

Abstract

Domestic violence in Indonesia poses serious evidentiary challenges due to minimal independent witnesses and its occurrence within private family spaces. Visum et Repertum (VeR), as a medico-legal document, plays a strategic role in the criminal evidence system by providing objective proof of physical violence. This study analyzes VeR’s role in proving domestic violence cases, identifies implementation obstacles, and examines judicial considerations based on Decision Number 310/Pid.Sus/2025/PN Ckr. A normative juridical approach with case study method was employed, analyzing secondary legal materials through prescriptive-analytical qualitative analysis. The findings reveal that VeR performs essential functions in objectively documenting injuries, connecting wound characteristics with instruments of violence, strengthening victim testimonies, and serving as a primary judicial consideration in establishing the elements of Article 44 paragraph (1) of the Domestic Violence Elimination Law. In this case, VeR formed a coherent evidentiary construction with witness testimonies and physical evidence, resulting in an eight-month imprisonment sentence for the perpetrator.

Abstract

This article discusses the education of legal protection regarding the social security rights of fishermen in Indonesia, particularly related to BPJS Employment participation. A case study was conducted in Cilacap Regency to examine the disputes faced by fishermen in accessing social security benefits. The research results show that the lack of socialization, administrative obstacles, and limited access are the main factors hindering social security protection for fishermen. The government and BPJS Employment need to enhance education, coordination, socialization, and simplification of procedures so that legal protection can run effectively and sustainably. This article provides knowledge about legal education on a policy aimed at strengthening social security protection for fishermen to enhance their welfare and social security.
