Abstract

The research aims at finding values, principles, and norms of customary law in Indonesia that are necessary to improve the concept of rule of law in Indonesia. One of the customary laws that still exists in Indonesia is Rejang customary law (Hukum Adat Rejang) which applies in Rejang society, Bengkulu Province. The existence of Hukum Adat Rejang as customary law is influenced by values of kinship, community groupings and pattern of traditional Rejang tribes. In order to find and identify such norms, a legal anthropological research with a qualitative research would be used. The research was conducted at the District of Rejang Lebong, Lebong, and Kepahyang. The result of the research shows that kinship system of Rejang is based on patrilineal or matrilineal system. Rejang tribes consist of four tribes, they are Petulai Tubeui or Tubai, Petulai Bemani or Bermani, Petulai Jekalang or Jurukalang, Petulai Selupue or Selupu. There are some norms that could be identified in Rejang customary law, namely Bemaling, Menebo, Tikam, Sigar Kulit, Cucuk Kulit, Mea Bayang Daleak, Iram Coa Badaleak, Iram Badaleak, Tukak Takek Kukuk, Membalew, Cido Celako, Kejujung Tenggak, Mendaur Tenggak, Samun, Upet, Dawa, Sumbang, Johong Permayo, Mbut, Tambang, Pascas Poncong, Tepeket, dan Kerineak.Key words: Rejang customary law, institution of adat Rejang, compilation of adat Rejang

Abstract

Unripe dates are believed by Indonesian citizens to increase fertility. This study aimed to assess the effect of unripe dates in the ovary of rats. Fresh yellow-colored dates were dried in an oven and crushed into powder. Eighteen rats aged three months and had given birth once were randomly divided into three groups. The treatment groups were given unripe dates at doses of 160mg/kgBW and 320mg/kgBW through a feeding tube for 28 days, and the control group was only given distilled water. Histopathological examination was carried out by the pathology expert using Hematoxylin-Eosin staining to observe the number of ovarian follicles according to their maturation stage. The results showed that the administration of unripe dates powder 320mg/kgBW increased corpus luteum number (21.50±4.72) and was statistically significant compared to the control group (15.16±3.71). Similar differences were also found in other stages of the follicle although not statistically significant. Administration of unripe date powder can increase ovulation induction among fertile rats.

Abstract

Abstract: Rindu Hati Village is one of the "old" villages located in Taba Penanjung District, Central Bengkulu Regency, Bengkulu Province. Most of the villagers come from the Rejang Tribe, who highly value the traditions and norms that live in the village community as a habit that will maintain the peace of the village community. Recognition and protection of the rights of community members is carried out by upholding customary law. Actions that can disturb the peace and tranquility of the Rindu Hati village community are violations of customary law norms that have been established by Kutei and disputes, conflicts regarding body and life, property, decency and the sustainability of the natural environment around the village. If there is a conflict that disturbs the balance in the community, then the Village Head, Hamlet Head, Chair or Member of the Customary Deliberation Board, in a "Kutei Customary Deliberation" which is also attended by the Chair/Member of the Village Consultative Body and Syara' Devices are obliged to resolve the conflict. The implementation of service activities is carried out in 3 months with several stages, namely (1) Situation and Needs Analysis, (2) Deliberation with Traditional Leaders and Village Government Apparatuses (3) Formation of the Kutei Customary Deliberation Manuscript (4) Signing of the Kutei Traditional Deliberation Process Manuscript. For each activity, an activity report will be made to LPPM. The final target expected from this service activity is the implementation of the Kutei Customary Law Enforcement in Rindu Hati Village so as to create order and security for the Village community.Keywords: Adat Institution; Community Conflict; Rindu Hati Village.

Abstract

Juvenille against the law (ABH) in the Child Criminal Justice System (SPPA) must receive a special approach, special attention, special consideration, care, special services and special protection because ABH has limitations compared to adults. Based on the purpose of SPPA is the best interst for children. According to Law Number 11 Year 2012 the settlement of child cases must be based on Penal Mediation. Penal mediation focuses justice on the victim according to personal interests, but is still able to hold the offender responsible for the crime he committed. The justice offered is a remedy for all parties involved. Law enforcement officials, juvenilles, families, victims and the community can agree to divert the case so that it is not brought to the criminal justice system. The study aims to describe the implementation of penal mediation at every level of the juvenile justice system in the Bengkulu District Court. research using socio-legal research research methods. By collecting data and information and the facts of the symptoms in the field, both through observation, interviews and documentation. Data collected in the form of primary data and secondary data, selected purposively according to the characteristics of the data. Data analysis was performed descriptively with inductive and deductive approaches. The results of the study found that the implementation of penal mediation in every level of the criminal justice system has been carried out in accordance with the SPPA Law but there are no standard implementation standards of the mediation process of penalties against children in conflict with the law, the implementation has not been effective. The most common penal mediation is at the level of the police investigator because it is the main gate of the juvenile justice system

Abstract

Topik yang paling penting dibicarakan dalam komunitas pencinta hukum adalah kedudukan hukum sebagai sumber dari segala sumber hukum. Pertanyaan berikutnya adalah apakah secara otomatis segala produk hukum baik berbentuk peraturan perundang-undangan, kebiasaan maupun putusan pengadilan yang ada di Indonesia telah di dasarkan pada nilai-nilai yang terkandung di dalam Pancasila. Pancasila sebagai pokok-pokok pikiran dan suatu cita-cita hukum diantaranya agar supaya negara dimaksudkan dan ditujukan untuk mewujudkan kebahagiaan dan kesejahteraan, perdamaian dan kemerdekaan dalam masyarakat bangsa Indonesia. Ide dan gagasan untuk mengimplementasikan nilai-nilai yang terkandung Pancasila sebagai sumber dari segala sumber hukum di Indonesia, merupakan perintah konstitusional. Tulisan ini membahas secara lebih jauh tentang penelaahan terhadap nilai-nilai khusus yang terkandung dalam sila keempat dari Pancasila yaitu kerakyatan yang dipimpin oleh hikmah kebjaksanaan dalam permusyawaratan perwakilan, yang terdiri dari unsur-unsur karakteristik kerakyatan Indonesia, hikmat kebijaksanaan, musyawarah dan mufakat dan lembaga perwakilan.Kata Kunci : Pancasila, Demokrasi, Undang-Undang Dasar .

Abstract

This study aimed to investigate: (1) the role of the Directorate Unit of Vital Object Safeguarding (Ditpamobvit) of Polda Bengkulu in safeguarding certain vital objects in Polda Bengkulu jurisdiction, (2) the inhibiting factors for the implementation of safeguarding certain vital objects carried out by the Ditpamobvit of Polda Bengkulu. In this thesis research method, the type of research used is descriptive. This study is included as an empirical legal research and it obtained that: (1) the role of the Ditpamobvit of Polda Bengkulu in safeguarding certain vital objects in Polda Bengkulu jurisdiction is carried out with security activities prioritizing pre-emptive and preventive principles but if needed in dangerous situations and conditions, law enforcement treatments (repressive) are allowed, (2) the inhibiting factors for the implementation of safeguarding certain vital objects carried out by the Ditpamobvit of Polda Bengkulu include the lack of security coordination between the Ditpamobvit unit of Polda Bengkulu and the security management of the vital objects, the lack of security unit officers compared to the level of vulnerability of the objects so that there is the potential for security threats/ disturbances to arise, and the lack of security infrastructure such as: number of guard posts, surveillance cameras (CCTV), patrol car units, area lighting, communication tools, and detection tools (metal detector/ search mirror/ manual detection tools).

Abstract

Indigenous village is important, therefore, it is required the establishment of indigenous villagein the respective regencies in Indonesia. To form the indigenous village needs to see some supportingaspects.One of sub-district which has a supporting aspect in the formation of indigenous villages in North Bengkulu is Enggano District. The research objective isto know and analyze the obstacles faced in implementing Law No. 6 of 2014 in the establishment of indigenous village in Enggano District of North Bengkulu. The methodology used is empirical juridical approach, byusing qualitative analysis. The result study showed that the obstacles encountered in the implementation of Law No. 6 of 2014 on Village in the establishment of the indigenous village in Enggano District of North Bengkulu consisted of two factors:Internal and external factors.

Abstract

This thesis is the result of research on "Process Attorney Researcher Case file in Determine Suspect New on Corruption", specifically this thesis discusses the process of determining the new suspects by prosecutors investigators file corruption cases and factor inhibitors for Attorney Researcher Files Case to determine a suspect new in the case file corruption. In particular, this thesis examines several cases of corruption filed by Investigator Police Resort Arga Makmur District Attorney of Public Prosecutions to Arga Makmur. The results of the study illustrate that the Attorney Researcher in determining new suspects in the case files submitted by police investigators are using the instrument giving direct instructions by the prosecution team of researchers P 19 and the instrument exposes / his case subsequently prosecutors investigators case file gives instructions to the investigator to be fulfilled within 14 days after prosecutors clue investigators met by investigators, the case file is declared complete by prosecutors investigators (P21).

Abstract

Tax fraud is a behavior that is not justified by law, but in Regional Police (Polda) of Bengkulu the behavior is often found by the supervisory apparatus in 2019 with a total loss that has been deposited of Rp 57,668,922. In order to minimize and eliminate these behaviors, efforts and sanctions were required by the supervisory apparatus carried out by Itwasda (Regional Inspectorate Supervision) Polda Bengkulu. From this background, the problemsexamined were: (1) What was the role of the Itwasda Polda Bengkulu in preventing Tax Fraud within Polda Bengkulu? (2) What was the form of sanctions imposed by Itwasda Polda Bengkulu in responding to the work unit that embezzled tax money? To answer these problems, this study used descriptive research method. The type of this research was an empirical research. The sources data used were primary and secondary data. The processing data was done by editing, coding, reconstructing, systematizing then analyzing qualitatively using the deductive-inductive and inductive-deductive methods. The results showed that (1) Preventive Field was held based on the number of findings related to tax fraud in 2019 and has been running quite well and effectively. In addition, Itwasda Bengkulu has also made innovations in the form of activities such as Prawasrik (Pre Supervision and investigation), Verification Team of Perwabkeu (Financial Accountabilty) and Internal Coordination improvement (2) Repressive Field was in the form of Wasrik activities by providing findings along with recommendations on the object of inspection. The result concluded that the number of findings in the field of taxation and deprivasion was increasingly reduced.
