Abstract

Bank Tanah dibentuk berdasarkan hukum di Indonesia sejak Undang Undang Nomor 11 Tahun 2020 tentang Cipta Kerja yang sekarang ini menjadi Undang-Undang Nomor 6 Tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 dan Peraturan Pemerintah yang mengatur Bank Tanah. Pasal 1 Angka 1 Peraturan Pemerintah Nomor 64 Tahun 2021 tentang Badan Bank Tanah adalah: “Badan Bank Tanah yang selanjutnya disebut Bank Tanah adalah badan khusus (sui geneis) yang merupakan badan hukum Indonesia yang dibentuk oleh pemerintah pusat yang diberi kewenangan khusus untuk mengelola tanah.” Penulisan ini membahas mengenai fungsi bank tanah dikaitkan dengan Pasal 33 Ayat (3) Undang Undang Dasar Republik Indonesia Tahun 1945 dan teori keadilan sebagai fairness karya John Rawls Tulisan ini menggunakan metode penelitan hukum normatif/ yuridis normatif. Bank Tanah harus melakukan seluruh fungsinya yakni perencanaan, perolehan tanah, pengadaan tanah, pengelolaan tanah, pemanfaatan tanah, dan pendistribusian tanah untuk sebesar-besarnya kemakmuran rakyat dan agar sesuai dengan Pasal 33 Ayat (3) Undang Undang Dasar Republik Indonesia Tahun 1945. Konsep Bank Tanah dalam rangka menjamin ketersediaan tanah dalam rangka ekonomi berkeadilan tidak harus mengorbankan segelintir orang untuk sebagian besar keuntungan yang dinikmati banyak orang dan sebagian orang tidak harus kekurangan agar orang lain bisa menikmati kemakmuran berdasarkan teori keadilan sebagai fairness karya John Rawls. Kata Kunci : Teori Keadilan, Bank Tanah. Abstract The Land Bank was formed based on Indonesian law since Law Number 11 of 2020 concerning Job Creation which has now become Law Number 6 of 2023 concerning the Stipulation of Government Regulations in lieu of Law Number 2 of 2022 and Government Regulations governing Land Banks. Article 1 Number 1 Government Regulation Number 64 of 2021 concerning Land Bank Agencies is: “Land Bank Agencies, hereinafter referred to as Land Banks, are special bodies (sui geneis) which are Indonesian legal entities formed by the central government which are given special authority to manage land. ” This writing discusses the function of a land bank in relation to Article 33 Paragraph (3) of the 1945 Constitution of the Republic of Indonesia and the theory of justice as fairness by John Rawls. This paper uses normative/juridical normative research methods. The Land Bank must carry out all of its functions, namely planning, land acquisition, land acquisition, land management, land utilization, and distribution of land for the greatest possible prosperity of the people and in accordance with Article 33 Paragraph (3) of the 1945 Constitution of the Republic of Indonesia. The Concept of a Bank Land in order to ensure the availability of land in the framework of a just economy does not have to sacrifice a handful of people for most of the benefits enjoyed by many people and some people do not have to be lacking so that others can enjoy prosperity based on the theory of justice as fairness by John Rawls. Abstract

This study employs quantitative methods to evaluate the consistency of Indonesia's Omnibus Law on Job Creation (UU Cipta Kerja) with climate justice principles and sustainable development goals. Through statistical analysis of environmental licensing data, foreign direct investment flows, and ecological degradation indicators from 2019-2023, the research reveals significant regulatory simplification that potentially undermines environmental safeguards. The analysis demonstrates a 47.4% reduction in licensing procedures, correlating with increased investment but raising concerns about procedural justice and intergenerational equity. Panel data regression analysis indicates that while the law achieved its objective of improving investment climate, it simultaneously weakened environmental protection mechanisms, particularly through the replacement of environmental permits with environmental approvals. The findings suggest that the legislative drafting process prioritized economic efficiency over climate justice considerations, creating potential conflicts with constitutional mandates for environmental protection and Indonesia's commitments under the Paris Agreement. This research contributes empirical evidence to the discourse on balancing economic development with climate justice in emerging economies

Abstract

Correct notification of the insurance object by the insured to the insurer in an insurance law is very important. The conditions for the validity of the insurance agreement are 1320 of the Kitab Undang-Undang Hukum Perdata, Article 250 of the Kitab Undang-Undang Hukum Dagang, and Article 251 of the Kitab Undang-Undang Hukum Dagang. So, Article 251 of the Kitab Undang-Undang Hukum Dagang is a condition for the validity of an insurance agreement. The author agrees to the Judge's Consideration and Dictum of the Constitutional Court of the Republic of Indonesia Number: 83/PUU-XXII/2024. The decision is in accordance with the principle of utmost good faith. However, Article 251 of the Kitab Undang-Undang Hukum Dagang is more related to the principle of utmost good faith, according to the author, in line with the opinion in the book Prof. H. Man Suparman Sastrawidjaja, S.H., S.U and Endang, S.H, namely through a change in the law, namely Article 251 of the Kitab Undang-Undang Hukum Dagang, changes are made in such a way that the act of rejecting claims based on Article 251 of the Kitab Undang-Undang Hukum Dagang must be tested against Article 1338 Paragraph (3) of the Kitab Undang-Undang Hukum Perdata (principle of good faith / utmost good faith). The research method in this paper is normative descriptive that provides data/overview by analyzing using legal principles, examining the systematics of laws and regulations.
