Abstract

Berdasarkan Putusan Mahkamah Konstitusi, pembatasan hak politik mantan terpidana hanya berlaku bagi kandidat pada pemilihan kepala daerah pada tingkat kabupaten/kota dan provinsi, anggota legislatif pada tingkat kabupaten/kota, provinsi serta nasional. Sedangkan menurut Komisi Pemilihan Umum, untuk kandidat yang ingin mencalonkan diri menjadi anggota Dewan Perwakilan Daerah, tidak menerapkan syarat telah melewati jangka waktu 5 (lima) tahun setelah mantan terpidana selesai menjalani pidana penjara berdasarkan putusan pengadilan yang telah mempunyai kekuatan hukum tetap. Permasalahan yang timbul kemudian, bagaimana pembatasan hak politik bagi mantan terpidana mengikuti kontestasi pemilihan umum anggota Dewan Perwakilan Daerah di Indonesia tahun 2024.Metode penelitian yang digunakan adalah penelitian hukum yuridis normatif. Hasil penelitian menunjukkan bahwa kebijakan hukum terbuka pembuat undang-undang dalam merumuskan ketentuan perundang-undangan tentang kepemiluan, terkesan berat sebelah. Pembatasan hak politik bagi mantan terpidana yang hendak mengikuti kontestasi Pemilu tahun 2024 dengan syarat tertentu, hanya berlaku bagi calon kepala daerah serta anggota DPR, DPRD provinsi, dan DPRD kabupaten/kota. Sedangkan bagi mantan terpidana yang hendak mendaftarkan diri menjadi calon anggota DPD di Pemilu tahun 2024, adalah dengan tetap menggunakan Pasal 182 huruf g Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum.

Abstract

Law enforcement often shows inconsistencies, where victims of crimes who commit forced defense (Noodweer) can actually become suspects or defendants who cause legal uncertainty and a sense of injustice. This study aims to analyze legal protection and legal justice for victims who are also perpetrators of forced defense crimes. This study specifically highlights Decision Number 1225/ Pid.B /2020/PN- Jkt.Sel , where a wife who stabbed her husband in a situation of threat of physical and verbal violence was sentenced to 4 years in prison for alleged persecution that caused death (Article 351 paragraph (3) of the Criminal Code). The Panel of Judges argued that the defendant's actions could not be categorized as forced self-defense. The research method used is normative juridical law using legislative, conceptual, analytical, and case approaches. The scope of this research is legal protection for victims of criminal acts who commit forced defense (Noodweer) in the perspective of the old Criminal Code (KUHP) and Law Number 1 of 2023 concerning the new Criminal Code (especially Articles 34 and 43). The results of the study show that the defendant's actions were carried out because of force and there was a mental shock constituting a forced defense (noodweer ). The conclusion is that there is a reason for the pardon and the defendant should not be subject to criminal charges as specified in Article 49 Paragraph 1 of the Criminal Code.

Abstract

This study aims to analyze the arrangement and implementation of online medical dispute resolution in hospitals to ensure legal certainty, as well as formulate an ideal form of the resolution model to realize justice in the future. The research method used is normative juridical with a qualitative approach through a statute approach to health regulations and electronic transactions. Legal materials were collected through literature studies at the National Library and analyzed descriptively analytically to answer the complexity of medical disputes in the digital ecosystem. The arrangement for online medical dispute resolution currently still relies on Law Number 17 of 2023 concerning Health, which requires non-litigation mediation as a first step, as well as the ITE Law as the basis for the validity of electronic documents. Implementation in hospitals is still fragmentary through medical committees or internal complaint units that are limited to simple online communication, but do not yet have special regulations for Online Dispute Resolution (ODR) outside the courts that comprehensively regulate mediator standards and data security. The condition of the absence of a standard standard creates legal uncertainty, especially regarding the strength of execution of the results of online mediation agreements. The ideal model of the future requires an integrated ODR platform that includes video mediation features, encrypted medical records, as well as the involvement of a certified neutral mediator who understands health law and professional ethics. This system prioritizes the principle of restorative justice to restore the therapeutic relationship between patients and medical personnel through a transparent, efficient, and accountable process.
