Abstract

Di zaman modern seperti ini, kaum perempuan banyak yang bekerja di luar rumah, mencari penghidupan seperti halnya kaum pria. Bahkan tidak sedikit di antara mereka menjadi sosok yang berhasil. Meskipun kenyatan ini sedikit kontradiktif dengan hukum Islam klasik, karena mencari nafkah dibebankan kepada kaum pria sebagai kepala rumah tangga. Seperti yang termuat dalam undang-undang Perkaw inan No.1/ 1974 pasal 31 (3) & pasal 34 (1&2), KHI pasal 80 ( 2&4). Secara sekilas, terdapat beberapa indikasi yang memperkuat keterlibatan perempuan dalam upaya memenuhi kebutuhan ekonomi keluarga, seperti: terbukanya peluang atau akses pada jenis pekerjaan atau profesi tertentu yang membutuhkan skill perempuan, adanya tuntutan kebutuhan keluarga yang terus meningkat, pekerjaan tidak tetap ( serabotan), dan lain-lain. Bias Gender yang mengakibatkan beban kerja ganda (double burden) tersebut sering kali diperkuat oleh adanya pandangan atau doktrin di masyarakat bahw a pekerjaan perempuan hanya dianggap sebagai “jenis pekerjaan perempuan” dan dikategorikan sebagai “tidak produktif”- tidak di perhitungkan dalam statistik ekonomi Negara. Di lain pihak kaum pria diw ajibkan secara kultural untuk menekuni berbagai jenis pekerjaan domestik. Kesemuan ini telah memperkuat pelanggengan secara kultural dan struktural beban kerja kaum perempuan, sehingga perempuan diposisikan sebagai makhluk yang melebur ke dalam citra laki-laki. Selain polemik di atas, kecenderungan yang terjadi bahw a barometer yang menjadi pemicu terjadinya konflik atau disharmonisasi dalam kehidupan keluarga adalah karena kaum perempuan saat ini lebih banyak menghabiskan w aktunya di luar rumah untuk bekerja. Hal tersebut, semakin mengjustifikasikan posisi dan peran perempuan hanya sebagai makhluk domestik tanpa batasan ruang dan w aktu.

Abstract

Religion and democratization resurgence was the most important phenomena in the latest decade of 20 th century. Various regions in the world, religious resurgence movements run well and sometimes reinforce political system formation which is more democratic. Islamic politics is often seen as fusion between religionandpolitics. In modern term, Islam is religion and state (??????? ?? ???), in group of Islamic thinkers or non-Islam, they state that Islam is comprehensive way of life and know the clergy or formal institution. There were some political systems which were applied in Islamic world in the beginning of modern era. Some were big kingdoms, such as Usmaniyah Sultanate in Europe and Middle East and Mughol Sultanate in India, governed by Sultan. Islamic role in politics started changing significantly in 1970s. Instead of reactive element of political community, Islamic group could step forward as initiative resource for political development and change. Islamic organizations were important part of Islamic resurgence in the latest decade of 20 th century. They not only were busy to response initiative of other sides but also represented the beginning of alternative politic-social orientation which was able to be trusted. This movement reflected multiple aspirations from modern educated professional group and Islamic society that wanted to participate bigger in political process and to realize the more Islamic society. Therefore, these new organizations were success to join two main inclinations in the end of 20 th century, namely: “religious and democratic resurgence”.

Abstract

Al-Qur’an has been sent down to give guidance to people toward the bright goal and straight way by maintaining origin of life which is based on faith in Allah and his treatise. Al-Qur’an also tells the past story, events happen now and information will happen in future. Most of contains of al-Qur’an firstly were sent down to general purposes but life of disciple of the messenger saw many historical events and sometimes special events happened to them and needed the explanation from law of Allah or thatlaw was still unclear for them, and then they asked to the messenger to know the Islamic law about that thing. So, al-Qur’an sent down to the special events or to the questions appeared. It almost become axiomatic argumentation that thereis no text, anything the form, which come to empty room. It is always related to the event therefore the text is always complex. Activity of alQur’an interpretation is an activity to see and examine validity of a text for human life, especially for Islamic people. As we know that text is not always relevant, it always must beused or thought with reality or with interest; no matter what form and here alQur’an text will become “live”.

Abstract

Paradigm is a collection of assumptions, concepts, and proportions that are logically put together and function to direct thought and study. Celestial religion before Islam has a limited capacity of time and place. The temporary nature is limited by the presence of the Prophet afterwards, such as the teachings of Musa a.s. The deadline is when the teachings of Isa a.s arrived. In contrast, the religion of Islam brought by the Prophet Muhammad is the last and final religion. The Qur'an is essentially a document of diversity and ethics that aims to be practical, to create a society of good morality and justice. The doctrine of freedom of human will as proclaimed by the Mu'tazillah is part of the theological concept of God's justice and defeats the original aspect of freedom and human responsibility. Among Orthodox, this human freedom means God's indifference. They accused the Mu'tazilah sect as extreme humanism, they asserted that God is outside the human concept of justice. What human beings see as God's justice does not mean that to Him, but what He does for humans does seem fair and rational to humans.

firayuni0601@gmail.com, nunungsusfita@uinmataram.ac.idABSTRAKFenomena childfree di Indonesia setelah adanya pernyataan dari seorang influencer muslim yang menganut childfree sehingga menimbulkan pro dan kontra dari masyarakat karena merupakan sebuah sikap yang tabu dilakukan oleh pasangan suami-isteri terlebih Indonesia merupakan mayoritas masyarakatnya beragama Islam sehingga bagaimana pandangan hukum Islam terhadap hal tersebut serta  bagaimana ketahanan keluarga dari pasangan suami-isteri yang menganut childfree  dalam pernikahannya. Tujuan penelitian ini untuk mengetahui bagaimana konsep childfree pada pasangan suami-isteri, apa faktor penyebab lahirnya childfree, dan bagaimana tinjauan hukum keluarga Islam serta pengaruhnya terhadap ketahanan keluarga. Penelitian ini menggunakan metode penelitian kepustakaan. Metode pengumpulan data yang digunakan dengan dokumentasi dan wawancara, serta metode analislis data secara induktif. Hasil penelitian menunjukkan (1) konsep childfree merupakan suatu keputusan sadar  dan telah melalui pertimbangan serta keputusan yang matang yang dianut oleh pasangan dengan adanya kesepakatan dari kedua pihak. (2) Adapun faktor penyebab childfree diantaranya; faktor pribadi (kebahagiaan personal), psikis (ketidaksiapan mental), filosofis, ekonomi, dan alasan lingkungan. (3) Tinjauan hukum keluarga Islam tentang fenomena childfree apabila ditinjau dari segi alasan  pasangan suami-isteri menganut childfree yakni dilarang, karena memiliki anak merupakan salah satu tujuan utama dalam pernikahan serta konsep perwujudan keluarga yang sakinah, mawaddah dan rahmah, keputusan childfree ini diperbolehkan apabila memenuhi alasan yang bersifat syar’i. Adapun pengaruh ketahanan keluarga bagi pasangan childfree yakni berpengaruh, namun tidak terlalu signifikan dikarenakan keharmonisan dalam keluarga childfree masih tetap terjaga. Hal ini disebabkan adanya visi yang sama antara pasangan suami-isteri untuk komitmen memutuskan childfree.

Abstract

Paradigma merupakan suatu kumpulan asumsi, konsep dan proporsi yang disatukan secara logis dan berfungsi mengarahkan pemikiran dan pengkajian. Agama samawi sebelum Islam, mempunyai kapasitas jangkauan waktu dan tempat yang terbatas. Sifat temporer itu dibatasi dengan kehadiran Nabi setelahnya, seperti ajaran Musa a.s. Dead line-nya adalah ketika ajaran Isa a.s tiba. Berbeda dengan itu, agama Islam yang dibawa oleh Nabi Muhammad saw, merupakan agama terakhir dan penutup. Al-qur’an pada hakekatnya adalah dukumen keagaman dan etika yang bertujuan praktis, menciptakan masyarakat yang bermoral baik dan adil. Doktrin kemerdekaan berkehendak manusia seperti dicanangkan oleh kaum Mu’tazillah menjadi bagian dari konsep teologi mengenai keadilan Tuhan dan mengalahkan segi aslinya yaitu kemerdekaan dan tanggung jawab manusia. Di antara kaum Ortodoks, kemerdekaan manusia ini berarti ketidak-merdekaan Tuhan. Mereka menuduh aliran Mu’tazilah sebagai humanisme yang ekstrim, mereka menegaskan bahwa Tuhan berada di luar konsep manusia tentang keadilan. Apa yang dipandang manusia sebagai keadilan Tuhan tidaklah berarti demikian bagiNya, tetapi apa yang diperbuatNya bagi manusia memang tampak adil dan rasional bagi manusia.

Abstract

Sexual violence phenomenon to under age childerns have become a social problem started from national level untill international level. Because, untill now perecentage of this case numbers increased sharply in various regions or corners of indonesia. Childerns in under age are targeted both as perpetrators and victims on immoral behavior. One of the indicators, associated with the pattern of implementation of roles, rights and obligations parents to their children in family life. So, the outhor raises the theme of Sexual violence phenomenon to under age childerns based on islamic family law perspective in indonesia- (study case in Empang subdistrict regency of Sumbawa Besar).This research aims to analyze the sexual violence phenomenon to under age childern based on islamic family law in Empang subdistrict regency of Sumbawa Besar. This research uses a Normative-phenomenological aproach, the type is Qualititative-Deskriptive ( case study). Data sources are obtained through observation and interview methods. Based on the results of the research, it known there are several internal and ekternal factors underlying the occurrence of sexual violence phenomenon to under age childerns (study case in empang subdistrict regency of sumbawa besar), as like : a). Uncontrolled treatment and promiscuity from parents control. b). There’s no information, media, dissemination and counseling of the case received by childeren from school institution and goverment releted with impact and danger from sexual violence behavior. c). Lack of fungtion and role of basic aducation institution as counselors for childrens when they study at school and so on.

Abstract

Underage marriage remains a serious challenge in many countries, including Indonesia, where it is complicated by the intersection of legal regulations and customary norms. In Lingsar District, this practice persists through the Merarik kodeq tradition, which is deeply embedded in local culture. Within this context, this study aims to explain the implementation of the Gerakan Anti-Merarik Kodeq (GAMAK) as a community-based prevention strategy and to analyze it through the framework of Maqasid al-Shariah. This qualitative research employed a fieldwork-based approach using methods such as observation, in-depth interviews with 14 key informants, and document analysis conducted over a seven-month period from March to September 2022. The findings reveal that GAMAK is not merely a technocratic policy but has evolved into a transformative social movement that redefines the relationship between custom, religion, and the state. Unlike legal-formal approaches, GAMAK successfully presents an alternative narrative that positions religious and customary leaders not as opponents of the law, but as agents of change who reform local values from within. By embedding anti-underage marriage messages in Friday sermons, women's forums (PKK), and even in village awiq-awiq (customary regulations), GAMAK demonstrates that collective behavioral change can be achieved through grounded and contextual approaches. Viewed through the lens of Maqasid al-Shariah, GAMAK upholds the protection of the five essential principles of Islamic law—religion, life, intellect, lineage, and property—while opening space for negotiation between customary norms and Islamic law in favor of public welfare. The findings show that preventing underage marriage requires transforming entrenched customary norms through collaboration between community leaders, religious authorities, and state institutions. This study contributes to the discourse on legal pluralism and Maqasid al-Shariah in child protection, while offering a practical model for policymakers to replicate in regions with strong customary traditions.
