Abstract

The issue of politics and ethics are two sides of a coin that invited attention of medieval scholars both in the West and the Islamic world. Although interrelated, but the implementation raises the difference between the two worlds. For the Western world, represented by Machiavelli, politics and ethics should be separated. A ruler should not be bound by ethics and tradition, and does not need to obey the law. In domestic relations affairs, a ruler must collect on his love and fear of people. While in foreign affairs, a ruler must reflect "a smart wolf and a strong lion. As for the world of Islam represented by al-Mawardi, politics and ethics cannot be separated. Even the basics of government, he said, are inspired by Islamic values based on the Qur'an and Hadith. Even a ruler must have and improve its ethical because it is a basic rule.

Abstract

Syuro has an important role in Islam. As a decision-making mechanism, syuro plays an important role in every aspect of human life. Syuro is also understood as an appreciation of the freedom of expression of human beings in social relations. Therefore, the true syuro in Islam is not always identical to politics. It's just that, as a large part of human life, the role of politics in social life is also very important. As a means of upholding shari'a, politics is considered capable of providing good legal certainty for human social life and also in determining a political leader. Due to these interests, the role of syuro in politics cannot be avoided. Syuro in Islamic politics cannot be directly equated with the practice of deliberation in the current political phenomenon. In addition to the uniqueness of the concept that emphasizes respect for human dignity in terms of his freedom, syuro in Islam places great emphasis on scientific authority, syuro in Islam is also not always identical with the concept of majority rule, because the basis is sharia. So if the majority opinion is contrary to what is in sharia, then the majority opinion is not acceptable.

Abstract

Basically, politics is a human need. As social beings, humans need to regulate political life. In order to be run in accordance with a common goal, the ethics and morals is a necessity that must be juxtaposed in politics. However, Machiavelli sense of ethics basing on two things, namely the Ancient Western ethics and Catholic ethics. He is holding on Western ethics derived from the Ancient Romans, whice based on the thinking that to retain power strength of spirit to fight to be the underdog. He stated that the Catholic ethics only make men weak because only orients his life on things that smelled hereafter. This thought does not give real contribution in political battles and power. As for foreign policy, Machiavelli emphasizes the shrewdness prince in terms of diplomacy. He stated that a prince in diplomacy must wear deception lion and the fox (deer). The difference between Machiavelli's political ethics is in stark contrast to what was formulated by al Mawardi. The difference is based on the basic beliefs between the two is also berbeda.Machiavelli leaned that ethics is not required in power when the condition of the people is unethical, because it was thought worth sia.Berbeda with al Mawardi, who rely on the Qur'an and Sunnah regardless of the conditions masyarakat. He always insisted that every ruler has always adhered to the ethical and moral values ​​that have been described in the Qur'an and as Sunnah. if thus, it can be concluded that, in truth Machiavelli does not provide solutions to community conditions and the improved of politis. Cause stability also what he says violates human nature when it agreed in shaping society, so that he saw the man was an enemy to the other man

Abstract

This paper aims to provide a comparative analysis between the concept of insurance and the concept of takaful from an Islamic perspective. The method used in this paper is the study of libraries, in which the author seeks to find, summarize, analyze and ultimately deduce from various authoritative data sources. Insurance is a non-bank financial institution that offers protection against difficulties to the public. By paying dues or premiums that have been determined, the public has the right to make a claim that will be reimbursed by the insured party several funds that have also been determined. The insurer states to bear all risks that occur in the future. Therefore, all dues paid will be covered and managed by the company. However, it turns out that attitude is detrimental. Because the claim from the customer is not filed, then the customer’s money is forfeited and entirely belongs to the company. In addition, the management of funds that are unclear and even almost unknown to customers makes this insurance practice illegal because it contains gharar and usury.
