Abstract

The infanticide crime is a special crime, in which one can do so is the biological mother of the infant. This specificity will be the core of this paper, reviewing the factors that cause the crime is done because it becomes the specificity of this criminal act. In addition to reviewing it, the writing of this paper will also be mebahasa about things that the judges consideration who hear cases of infanticide murder, whether in the form of a mitigating or incriminating reason. This research is conducted by empirical juridical who examine the crime according to reality in real life of society. The end of this study concluded that the main thing that causes a mother to kill her baby is the embarrassment factor, because it has given birth to a child outside a legal marriage.

Abstract

Illegal sprint racing is a prominent type of adolescent delinquency in Indonesia, especially during Ramadan. This occurrence not only undermines public order but also violates various applicable laws. This study employs a normative legal approach, with a focus on legal principles, to identify positive legal doctrines relevant to the phenomenon of illegal sprint racing. A case study approach is used to investigate various aspects of the phenomenon using primary legal texts such as the Law on Roads, the Law on Road Traffic and Transport, and the Law on Policing. The investigation found that illicit sprint racing without appropriate license is a severe violation of the law. The findings demonstrate the critical role that law enforcement plays in preserving community welfare, security, and order in locations that are frequently the scene of illicit sprint racing. Repressive law enforcement, more frequent patrols, and raising community understanding of the law are all effective ways to address this issue. The goal of socializing legal awareness is to increase community knowledge of relevant laws and regulations, and routine patrols are carried out to stop and identify illegal activity before it gets a chance to start. Repressive law enforcement makes it clear to offenders that their actions will not be accepted.

Abstract

Penelitian ini mengkaji tentang fenomena swinger atau tukar menukar istri yang didasari oleh kesepakatan antar pihak, tanpa adanya pemaksaan ditinjau dari KUHP. Tujuan penelitian ini adalah untuk menganalisis fenomena swinger dalam KUHP di Indonesia dengan menelaah dua pasal yang relevan, yaitu pasal prostitusi dan perzinahan. Jenis penelitian yang digunakan dalam penelitian ini ialah penelitian hukum normatif. Hasil penelitian menunjukkan bahwa swinger tidak dapat dengan tepat digolongkan sebagai bentuk prostitusi karena karakteristiknya yang berbeda secara substansial. Dalam praktik swinger, tidak ada pertukaran uang atau transaksi komersial terlibat dalam hubungan seksual antar pasangan. Oleh karena itu, Pasal 296 dan Pasal 506 KUHP tidak dapat diterapkan dengan tepat untuk menghukum pelaku swinger, karena pasal-pasal tersebut ditujukan untuk menangani pelaku prostitusi dan pihak-pihak yang bertindak sebagai perantara dalam transaksi tersebut. Swinger bisa dikategorikan sebagai perzinahan sesuai dengan Pasal 284 KUHP jika dilaporkan secara aduan oleh pihak yang merasa dirugikan akibat pertukaran pasangan tersebut. Namun, mencoba mengaitkan praktik swinger dengan perzinahan secara langsung tidaklah tepat. Hal ini karena swinger umumnya didasarkan pada kesepakatan dan persetujuan bersama antara pasangan, sehingga sulit untuk menentukan pihak yang dirugikan dalam konteks hukum. Sementara Pasal 284 KUHP membutuhkan elemen perzinahan yang jelas, yang sulit ditemukan dalam situasi swinger yang didasarkan pada kesepakatan antara semua pihak yang terlibat.

Abstract

This research delves into the exploration of fostered children's rights discovery at LPKA Class II Yogyakarta, recognizing that children under guardianship are entitled to various rights as stipulated by law. Despite legal provisions, there remains a gap between theoretical entitlements and practical implementation within LPKA Class II Yogyakarta, necessitating an in-depth investigation. The study aims to scrutinize the extent to which fostered children's rights fulfilled. It also seeks to analyze the obstacles faced by LPKA Class II Yogyakarta officers in fulfilling these rights. The research will empirically examine the fulfillment of children's rights and the challenges encountered within LPKA Class II Yogyakarta through interviews with LPKA Class II Yogyakarta officers provide firsthand insights into policy implementation and challenges encountered in upholding fostered children's rights. The research findings highlight significant gaps in the fulfillment of subsidiary rights for detainees, particularly in education, healthcare, and access to reading materials. While efforts have been made to address some aspects of detainee rights, such as nutrition and religious practices, deficiencies persist in critical areas. Limited educational resources, inadequate healthcare services, and a dearth of reading materials pose significant challenges to fostered children's well-being and rehabilitation. Additionally, obstacles such as the absence of in-house schooling, insufficient medical personnel, and limited library resources further impede the realization of children's rights within LPKA Class II Yogyakarta.

Abstract

This tragic story involves a young man named M. Adi (19 years old) in Mojokerto, East Java, who was desperate to rape the corpse of junior high school student AE (15 years old). This incident occurred after his life was taken by his classmate, AB (15 years old). Adi raped AE's corpse twice, as the victim's life was taken by AB. Adi's motive was lust. The young man worked as a labourer in an iron factory, earning around Rp500,000 per week. This case began with AB's murder in the rice field behind his house. AB then took AE's body on a motorbike belonging to the victim's uncle to his parents' house. There, Adi was invited by AB to help dispose of AE's body. Adi raped the victim's body twice in an empty house. AB confessed his actions to the police and explained that Adi committed the rapes when he went to buy raffia rope to tie the plastic sack that would be used to wrap the victim's body. This case revealed a cruelty and perversion of behaviour that was deeply disturbing, and society and the law responded strongly to it. Corpse rape, or necrophilia, is a highly reprehensible act that goes against moral and ethical values. Involving sexual acts against a dead human body, which lacks the ability or awareness to consent or engage in the relationship, necrophilia violates basic human principles and social norms held by society. This case also highlights the lacunae in the law regarding necrophilia. While there is a threat of punishment for individuals who engage in corpse rape or mutilation, the existing arrangements have not been specific and explicit enough in addressing acts of necrophilia. Therefore, it is important to consider criminalising necrophilia more explicitly in order to address such inhumane acts and protect human dignity even after a person has passed away. This research applies the normative juridical legal research method to analyse the criminalisation policy of the act of intercourse with a corpse in the case of a junior high school student in Mojokerto, with reference to Criminal Law and Pancasila. A case approach is used in analysing the criminalisation policy of Necrophilia from the perspective of Criminal Law and Pancasila.

Abstract

In Indonesia, social media's pervasive influence has led to the emergence of online prostitution, presenting complex challenges for law enforcement and criminal justice. Unlike traditional forms, online prostitution operates discreetly on digital platforms, complicating regulation and enforcement efforts. The research in this article uses normative legal research methods.  This research examines the socio-cultural, legal, and technological dimensions of this phenomenon, assessing the adequacy of existing legal frameworks and the efficacy of cyberpatrol units in addressing it. Insights aim to inform policy and law enforcement strategies to combat social media-based online prostitution effectively. The result of this research is the intersection of online prostitution and social media platforms presents a complex interplay between technology, commerce, and societal norms within digital environments. Leveraging the communicative potential of social media, individuals discreetly engage in commercial sex work, navigating a dynamic ecosystem that transcends geographical boundaries to create a global marketplace for commercial sexual services. Multimedia elements and specialized terminology tailored to the online sex industry augment the visibility of commercial sexual offerings and facilitate transactional negotiations. However, regulatory frameworks have not effectively addressed the challenges posed by online prostitution, creating a legal vacuum that hinders comprehensive law enforcement. This underscores the critical role of law enforcement agencies, such as the Cyber Police, in combating illicit activities in the digital sphere. By adopting a proactive and data-driven approach informed by social media analytics, law enforcement agencies can optimize their surveillance and intervention strategies to effectively combat online prostitution, safeguard vulnerable individuals, and uphold the integrity of digital platforms. Through continuous collaboration, capacity building, and innovative strategies, law enforcement agencies can mitigate the proliferation of cyber threats and ensure the safety and security of digital communities.

Abstract

Studi ini mengkaji implikasi hukum dari lelucon gelap dalam konteks hukum pidana Indonesia, khususnya berkaitan dengan masalah pencemaran nama baik dan penghinaan. Penelitian ini bertujuan untuk menganalisis batasan antara kebebasan berekspresi dan tanggung jawab hukum dalam ranah humor gelap, dengan menyelidiki bagaimana lelucon semacam itu dapat berpotensi melanggar Pasal 27 (3) Undang-Undang Informasi dan Transaksi Elektronik serta Pasal 310-311 Kitab Undang-Undang Hukum Pidana. Menggunakan metode penelitian normatif, studi ini menganalisis teks hukum, keputusan pengadilan, dan literatur terkait untuk memahami kerangka hukum yang mengelilingi lelucon gelap. Temuan menunjukkan bahwa, meskipun lelucon gelap sering dimaksudkan sebagai humor, lelucon tersebut dapat mengakibatkan konsekuensi hukum yang signifikan ketika menargetkan individu atau kelompok. Penelitian ini menekankan pentingnya menetapkan standar hukum yang jelas untuk menyeimbangkan kebebasan berekspresi dengan perlindungan reputasi individu. Selain itu, penelitian ini menggarisbawahi tantangan dalam menafsirkan dan menerapkan hukum terkait pencemaran nama baik elektronik di Indonesia, serta mengadvokasi pemahaman yang lebih mendalam tentang persimpangan antara humor dan akuntabilitas hukum.

Abstract

The act of beating is a phenomenon that is difficult to disappear in social life. A written report made by experts or a Visum et Repertum is needed to find the perpetrators and the cause of the beating. Visum et Repertum play a crucial role in influencing the course of criminal prosecution in cases of battering by strengthening existing evidence. However, to increase its effectiveness as valid evidence in law enforcement, various technical and social challenges still need to be overcome. This study aims to determine the role of Visum Et Repertum in influencing the direction of criminal charges in cases of beating that resulted in loss of life at the Sleman District Attorney's Office and to find out the obstacles of law enforcement officials when making Visum Et Repertum as valid evidence in assisting the direction of criminal charges. The research method used is empirical juridical research, using a statutory approach. The data is arranged systematically and then analyzed descriptively and qualitatively. The results showed that the role of Visum Et Repertum in influencing the direction of criminal charges in cases of beating is to strengthen the evidence even though there is already witness testimony and testimony of the defendant. Visum Et Repertum is also able to provide clarity and grounds for the public prosecutor to increase his confidence to make a criminal charge. Meanwhile, the obstacles of law enforcement officials in making the Visum Et Repertum valid evidence are technical obstacles and also obstacles to rejection from the victim's family, where technical obstacles investigators must wait several days or weeks to get the results of the Visum Et Repertum since the victim was delivered.

Abstract

This research critically examines Indonesian criminal law in addressing necrophilia's various manifestations, emphasizing the protection of deceased dignity and human rights. Using normative legal analysis, the study reveals that Indonesian criminal law provides partial coverage for necrophilia cases. Role Player necrophilia is addressed by Articles 6b and 12 of the TPKS Law, focusing on victim dignity and perpetrator sanctions. Romantic necrophilia, involving exhumation or corpse concealment, may fall under Criminal Code Articles 180 and 181, aimed at protecting the sanctity of the deceased. Necrophiliac Fantasizers, though not explicitly penalized, raise concerns due to the potential transition from fantasy to criminal acts. Tactile necrophilia is punishable under Articles 6b and 6c of the TPKS Law when physical abuse of corpses occurs. Additionally, Fetishistic necrophiles and Necromutilomaniacs who exploit corpses are subject to Criminal Code Articles 180 and 181. The findings indicate a need for legal reform, as current laws fail to comprehensively cover all necrophilia types, especially Romantic necrophilia and Necrophiliac Fantasizers. Furthermore, Homicidal and Exclusive necrophiles, committing extreme offenses, fall under Articles 338, 339, and 340, along with Article 6b and 180, addressing severe harm, murder, and corpse exploitation. This study’s novelty lies in categorizing necrophilia types within Indonesian law, highlighting gaps in legal protections. It recommends targeted legal amendments to ensure all forms of necrophilia are adequately recognized and prosecuted, thereby strengthening ethical and societal standards.

Abstract

his research delves into the intricate legal framework governing animal protection within the Indonesian Criminal Code, offering a thorough analysis of existing provisions aimed at ensuring animal welfare. Indonesia's commitment to humane treatment and ethical considerations in its legal system is underscored by several articles directly or indirectly addressing the welfare of animals. Employing a normative juridical approach, this study systematically examines the statutory provisions pertaining to animal welfare within the Indonesian Criminal Code. The findings illuminate the Indonesian Criminal Code as a robust legal framework that prioritizes respect, dignity, and compassion for animals. Article 302 serves as the cornerstone by establishing fundamental standards for humane treatment, reflecting intrinsic moral values deeply embedded within Indonesian societal norms. Complementing this, Article 409 addresses actions that incite animal aggression, thereby safeguarding both the physical and psychological well-being of animals. Article 540 further strengthens these protections by ensuring animals are shielded from excessive workloads and inhumane transportation practices, thereby addressing their rights and welfare comprehensively. Moreover, Article 541 specifically focuses on horses, mandating that they are not subjected to overwork and are treated with due consideration for their natural development and capabilities. Additionally, Article 544 regulates contentious activities such as cockfighting, aiming to maintain public order while upholding humane standards and preventing unnecessary suffering among animals. These provisions collectively demonstrate Indonesia's holistic approach to animal welfare, balancing societal needs with ethical imperatives.
