Abstract

Environmental protection and management of domestic wastewater according to Article 63 Paragraphs (1), (2), and (3) of Law Number 32 Year 2009 shall be mandatory affairs related to basic services of regency / municipality governments, among them the provision of infrastructure and domestic waste water treatment facilities. Through the RPJMN 2015-2019 the government attempts, by 2019 every rural and urban Indonesian community already has access to proper sanitation facilities for domestic wastewater. In fact, the availability of domestic wastewater service to date is only 60.91% and not yet in Bengkalis Regency. This issue should not occur, because it will cause damage and / or environmental pollution. To respond to the needs of Bengkalis society it is treated a tool (tools) to regulate the management of domestic waste water in the form of local regulations. The result of the research shows that the consideration of the formulation of the regional regulation in Bengkalis Regency concerning the Management of Domestic Wastewater is philosophically the responsibility of the state and the government's duty to do so in order to realize the happiness of all Indonesian people and all mankind based on Pancasila and the Preamble of the 1945 Constitution. Juridical is based on the 1945 Constitution and other relevant legislation.

Abstract

Pancasila has a very strategic position in the life of the nation and state. Pancasila is not only as a source of all sources of law, but also as the basis of the state, state ideology, and philosophical basis of the state. Nevertheless, ironically the interpretation of Pancasila itself is even diverse. It simply depends on the holder of power. The purpose of this study is to find out the correct interpretation of Pancasila in Indonesia, especially the principle of the Almighty God who illuminates the other precepts. This research is a library research. Analysis was carried out qualitatively using a statutory approach, case approach, conceptual approach, and historical approach, political approach, and comparison approach. The results of this study are that there is a deviation from Pancasila when Pancasila is not interpreted correctly and does not want to be honest with the history of the formulation of Pancasila itself. Therefore it is not surprising when in practice, there are laws, understandings, actions or actions that are contrary to Pancasila.

Abstract

The appointment of an official head in the area, as regulated in the provisions above, gives rise to polemics at the level of implementation. Some of the polemics that arise as a consequence of appointing an official head area, among other things, is the lack of transparency in the appointment process of the official head area, and the appointment of an active TNI member as an acting head disfigures the spirit of reform. Additionally, there is not yet a rule managing the executor mechanism for the appointment of the official head area.This study aims to analyze the appointment process of the existing head area position at this moment as an effort to guard popular sovereignty, ensuring it is not injured by inadequate mechanisms, transparent, and yet firm policies that arrange the mechanism for appointing the official head area to prevent conflicts of interest. This study is a normative legal study, where the search uses secondary data with material references. The result of this study is the arrangement of the mechanism for appointing the current Regional Head acting is not yet arranged systematically, so the appointment process of the acting Regional Head experiences several problems, including the existence of a conflict of interest in appointing the acting Regional Head, and the duration of appointing the Acting Regional Heads, who have been around for quite a long time, has implications for the governance of the government area. Additionally, there exists the appointment of acting Regional Heads who are active TNI soldiers.

Abstract

Sikap Mahkamah Konstitusi terhadap pengujian undang-undang yang merupakan kebijakan hukum terbuka, telah berubah dengan dikemukakannya argumentasi baru, tentang pengertian atas salah satu prinsip konstitusi yaitu prinsip proporsionalitas. Putusan MK Ri No. 116/PUU-XXI/ 2023 telah menyatakan bahwa Pasal 416 ayat (1) UU No. 7 Tahun 2017 tentang Pemilihan Umum inkonstitutional bersyarat. Paper ini mengkaji implikasi putusan MK ini terhadap pelaksanaan UU No.7 Tahun 2017, khususnya yang berkenaan dengan Pasal 416 ayat (1) maupun kemungkinan perubahan sikap MK atas ketentuan Presidential Threshold (Pasal 222). Kajian ini merupakan kajian doktrinal, dengan menggunakan bahan hukum primer dan sekunder, berupa peraturan perundang-undangan, putusan-putusan Mahkamah Konstitusi, hasil penelitian yang relevan dengan kajian. Hasil kajian ini menyatakan bahwa pendirian Mahkamah Konstitusi akhirnya melakukan perubahan, dengan dikemukakannya argumentasi baru ketika memaknai sesuai tidaknya dengan konstitusi. Perubahan ini akan membuka peluang dimohonkannya kembali kasus-kasus pengujian tentang Presidential Threshold , yang selama ini ditolak oleh Mahkamah Konstitusi.
