Abstract

Indonesia is known as a predominantly Muslim country. The law of inheritance of Islam occupies a very important place in Islamic Law. The verses of the Qur'an govern the law of inheritance clearly and in detail. This is understandable because the inheritance problem must be experienced by everyone and it is easy to cause disputes between heirs. The method used in this activity is the counseling to the community and discussion. The result of the discussion can be concluded that: Group of heirs by sex there are 25 people consisting of 15 men and 10 women. Sections of the heirs according to Islamic Law, that is, one gets 1/2 of the inheritance, 2/3 of the estate, 1/3 of the estate, 1/4 of the estate, 1/6 of the estate, 1 / 8 of the estate, Acquires all inheritance, inheritance is equally divided, obtaining the remainder, depending on the position of the heirs.

Abstract

Abstract— The purpose of this study is to analyze and explain the role of BPSK in resolving consumer disputes and analyze the dispute resolution process BPSK. This research used normative juridical approach to the law (statute approach) and the conceptual approach (conceptual approach). The results showed that in the implementation of consumer protection in Indonesia, BPSK is spearheading role in the field to provide protection to consumers who have been harmed. The protection afforded by BPSK to consumers is through the settlement of disputes between consumers and businesses, and also through the inclusion of supervision of any agreement or document that outlines the standard clause. While the dispute settlement process is done for the sake of the stages of the stages are as follows: stage request of the applicant, ie the consumer as plaintiff; pretrial stages, namely the selection of completion method; settlement of disputes based on the decision of the parties, especially mediation, conciliation, arbitration and the decision of the Assembly. Keywords—: Role; BPSK; consumer disputes.

Abstract

The purpose of this study was to determine the regulation of levies for recreational and sporting places in Ngawi Regency and the contribution levy of recreational and sporting place fees in increasing local revenue in Ngawi Regency in 2014-2018. The type of method used in this research is normative research, with the method of statute approach, the legal materials in this study are primary, secondary and tertiary legal materials, through interview and documentation data collection techniques, with qualitative analysis. The regulation of recreational and sporting levies in Ngawi Regency has changed in structure and the amount of the retribution tariff is due to the addition of two recreational and sporting objects so that there are five recreational and sporting object levies owned by the Regional Government of Ngawi Regency. The contribution of recreational and sporting place fees in increasing local revenue in Ngawi Regency in 2014 was 0.58%, in 2015 amounted to 0.57%, in 2016 amounted to 0.64%, in 2017 amounted to 0.28% and in 2018 amounted to 0.96%. Recreation and sports places that contribute the highest retribution are Tawun, Alun - alun, Trinil Museum, Ketonggo Stadium and GOR Bung Hatta.

Abstract

Marriage is a very important event in community life. Because marriage does not only concern the bride and groom, but also the parents of both parties, relatives and their families. The purpose of marriage is to form a happy and eternal family. The method used in this community service activity is legal counseling and discussion about not to noted marriages. From the discussion conducted it can be concluded that. The legal status of marriage that is not to noted under the marriage law is illegal or has no legal force. The legal status of a child born from a marriage that is not to noted has a civil relationship with his mother, this has the consequence that the child born of marriage is not to noted the country of the child does not have a civil relationship with his father. But after the decision of the Constitutional Court Number 46 / PUU-VIII / 2010 in which the child can also have a civil relationship with his father as long as it can be proven by technological tools such as DNA testing.

Abstract

Abstract       The purpose of this study was to determine the implementation of Madiun Regent Regulation Number 39 of 2020 concerning the Implementation of Health Protocol Law Enforcement as Efforts to Prevent and Control Corona Virus Disease 2019 in Madiun Regency as well as supporting and inhibiting factors in implementing the Discipline and Law Enforcement of Health Protocols as Prevention Efforts and Corona Virus Control in Madiun Regency. In this research method, researchers use empirical, namely data obtained directly through field research with primary data sources, secondary data sources and tertiary data sources as well as data collection techniques carried out by observation, interviews, document study, to informants using descriptive data analysis techniques. qualitative. The results of this study indicate that the Regent's Regulation Number 39 of 2020 concerning the Implementation of Discipline and Law Enforcement of Health Protocols as Efforts to Prevent and Control Corona Virus Disease 2019 in Madiun Regency has been implemented quite well by the Regional Government by conducting socialization related to the application of discipline and enforcement of health protocol laws. . In implementing the Regent Regulation, there are supporting and inhibiting factors. The supporting factors are agencies that play an active role in the prevention and control of the corana virus, while the inhibiting factor is the lack of public awareness to comply with health protocols, the existence of false news (hoaxes). Keywords: Implementation, Regional Regulations, Corona Virus Disease 2019, Discipline Implementation and Health Protocol Law Enforcement

Abstract

This study aims to identify and analyze the strengthening of the capacity of the Village Customary Institution (LAD) in the formation of village regulations. By using a normative juridical research method (doctrinal), based on primary legal materials, secondary legal materials and non-legal materials, then analyzed descriptively qualitatively. Based on the results of research and discussion, it shows that the Village Customary Institution as a forum for deliberative organizations to accommodate and channel the aspirations of the community to the government, resolve various problems that exist in society related to customary law, the existence of traditional institutions is also to create a democratic, harmonious relationship. and to empower the community in order to support the improvement of government administration, and the welfare of the village community. Village customary institutions are also a forum or organization where when in resolving a dispute or conflict there is a deliberation between the traditional apparatus which can be called a customary deliberation. Where customary deliberations are carried out in the community to realize the purpose of living together according to the local customary law. The Village Customary Institution will have legal certainty if a Village Regulation has been made so that the roles and functions of the Village Traditional Institution can be empowered as part of the implementation of the Village administration tasked with maintaining customs and resolving conflicts according to custom within the legal corridors of the Village Government as regulated in Law Number 6 2014 about Village

Abstract

ABSTRACT  Purpose of the Study: This research aims to analyze the State Administrative Court of Surabaya City judges’ basis of consideration in Decision No. 32/G/2023/PTUN.SBY in resolving the dispute of land ownership certificate overlapping through the litigation method and knowing the legal consequences of this decision. Methodology: This research employed the normative legal research method. The data were descriptively analyzed to obtain research results. It used applicable court decisions, legal regulations and the general principle of good governance as its basis of consideration. Results: In its relations with the Plaintiff's lawsuit, Judge Assembly stated that it had fulfilled the lawsuit’s formal aspect on deadlines in issuing the certificate which is the Defendant’s authority. However, in the issue of procedures and substances, there have been deviations that violate the applicable legal regulations and the general principle of good governance. Based on the author’s analysis, these judges have given accurate considerations. The legal consequences of State Administrative Court of Surabaya City's Decision No. 32/G/2023/PTUN.SBY are that the two land tenure certificates owned by Defendant II Intervention were revoked by Surabaya City's State Administrative Court. Apart from that, the Defendant and Defendant II Intervention are burdened with paying for the case fees. Applications of this study: This research becomes a reference for National Land Agency Officers to be more careful when issuing certificates to prevent administrative and/or juridical errors. Novelty/Originality of this study: This research analyzed the decision of Surabaya City’s State Administrative Court on the revocation of 2 (two) land ownership certificates issued by the Batu City Land Agency and the legal consequences of State Administrative Court of Surabaya City’s Decision No. 32/G/2023/PTUN.SBY. Keywords: Decision, overlapping, land tenure certificates, dispute resolution   ABSTRAK Tujuan Penelitian: Penelitian ini bertujuan untuk menganalisis dasar pertimbangan hakim Pengadilan Tata Usaha Negara Kota Surabaya dalam Putusan Nomor 32/G/2023/PTUN.SBY dalam menyelesaikan sengketa tumpang tindih sertifikat hak milik atas tanah melalui metode litigasi dan mengetahui akibat hukum dari putusan tersebut. Metodologi: Penelitian ini menggunakan metode penelitian hukum normatif. Data dianalisis secara deskriptif untuk memperoleh hasil penelitian. Dasar pertimbangan yang digunakan adalah putusan pengadilan yang berlaku, peraturan perundang-undangan, dan asas umum pemerintahan yang baik. Hasil: Terkait gugatan Penggugat, Majelis Hakim menyatakan telah memenuhi aspek formil gugatan mengenai batas waktu penerbitan sertifikat yang merupakan kewenangan Tergugat. Namun, dalam masalah prosedur dan substansi masih terdapat penyimpangan yang melanggar peraturan perundang-undangan yang berlaku dan asas umum pemerintahan yang baik. Berdasarkan analisis penulis, para hakim telah memberikan pertimbangan yang tepat. Akibat hukum dari Putusan PTUN Kota Surabaya Nomor 32/G/2023/PTUN.SBY adalah dua sertifikat hak milik atas tanah milik Tergugat II Intervensi dicabut oleh PTUN Kota Surabaya. Selain itu, Tergugat dan Tergugat II Intervensi dibebani biaya perkara. Aplikasi penelitian ini: Penelitian ini menjadi acuan bagi Pejabat Badan Pertanahan Nasional agar lebih cermat dalam menerbitkan sertifikat untuk mencegah terjadinya kesalahan administratif dan/atau yuridis. Kebaruan/Orisinalitas penelitian ini: Penelitian ini menganalisis putusan PTUN Kota Surabaya atas pencabutan 2 (dua) sertifikat hak milik atas tanah yang diterbitkan oleh Badan Pertanahan Kota Batu dan akibat hukum dari Putusan PTUN Kota Surabaya Nomor 32/G/2023/PTUN.SBY. Abstract

ABSTRACT This study explores and analyses the position and legal force of the Supreme Court Circular Letter (SEMA) issued by the Supreme Court, which regulates the prohibition of bankruptcy or suspension of debt payment obligations (PKPU) experienced by developers. The approach applied in this study is normative legal research. SEMA does not have a position in the hierarchy of laws and regulations and is only a circular issued by the leadership of the Supreme Court in the form of instructions, admonitions, or warnings, and its validity is only binding for judicial institutions under it. However, this legal product should not reduce the freedom of judges in examining and making decisions on a case. The prohibition on filing for bankruptcy and PKPU for developers of apartments and flats hinders the right of creditors or consumers to obtain justice. Meanwhile, bankruptcy and PKPU are tools that can help companies that are facing financial difficulties. Although consumers still have another legal alternative, namely civil suits, to obtain justice, this step is less effective given the large number of housing consumers. This mechanism can legally restructure the company's debt and provide legal certainty for creditors.

Abstract

ABSTRACT Purpose of the Study: This research aims to analyze the legal consideration that influence differences in a Supreme Court Decision and a Constitutional Court Decision in the Regional Head Election process in 2024, and these decisions’ implications on the age limit for regional head candidates in the 2024 regional general election in creating checks and balances in the government. Methodology: This research utilizes the normative legal research method with the jurisprudential approach, statute approach, conceptual approach, and analytical approach. The data were descriptively analyzed to obtain the research results on the interpretation of age limits for regional head candidates in the 2024 regional general election in the two decisions, namely the Decision of the Supreme Court No. 23P/HUM/2024 and the Decision of the Constitutional Court No. 70/PUU-XXII/2024. These differences led to a lack of legal certainty and a misalignment with the general principle of good governance that is in line with the checks and balances principle in the government. Results: The Decision of the Supreme Court No. 23P/HUM/2024 determines that the age limit for regional head candidates is calculated since the inauguration, while the Decision of the Constitutional Court No. 70/PUU-XXII/2024 regulates that it is calculated since the determination of candidate pairs. Such differences led to a lack of legal certainty, which impacts the implementation of the 2024 Regional Head Election. The legal implications are that these differences may potentially disturb the democratic and political participation processes, especially for the younger generation. The 2024 Regional Head Election applied the Decision of the Constitutional Court No. 70/PUU-XXII/2024, which regulates that the minimum age of regional head candidates is 30 years old for candidate governors and candidate vice governors, and a minimum of 25 years old for candidate regents, candidate vice regents, candidate mayors, and candidate vice mayors. This is calculated since the determination of candidate pairs, as they have passed the stages of the 2024 Regional Head Election.                                                                   Applications of this Study: The state institution and the government are expected to be more careful when issuing interpretations through decisions that equally have final, binding, and erga ormes characteristics to prevent the occurrence of a lack of legal certainty. There should be efforts to align regulations to prevent legal dualism, which may lead to conflicts and issues in society. Novelty/Originality of this Study: It provides an analysis of the Decision of the Supreme Court No. 23P/HUM/2024 and the Decision of the Constitutional Court No. 70/PUU-XXII/2024 on the age limit for regional head candidates and the implications of these decisions in creating governmental checks and balances. Keywords: Decision, age limit, regional head election, checks and balances.   ABSTRAK Tujuan Penelitian: Penelitian ini bertujuan untuk mengetahui perbandingan pertimbangan hukum yang mempengaruhi perbedaan dalam putusan Mahkamah Agung dan Mahkamah Konstitusi dalam proses Pemilihan Kepala Daerah tahun 2024 dan implikasi putusan Mahkamah Agung dan Mahkamah Konstitusi dalam ambang batas usia calon kepala daerah pada Pemilihan Kepala Daerah tahun 2024 dalam menciptakan checks and balances di pemerintahan. Metode: Penelitian ini menggunakan metode penelitian hukum normatif dengan menggunakan pendekatan yurisprudensi, pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan analisis. Data dianalisis secara deskriptif hingga diperoleh hasil penelitian bahwa perbedaan pada kedua putusan, baik Putusan Mahkamah Agung Nomor 23P/HUM/2024 dan Putusan Mahkamah Konstitusi Nomor 70/PUU-XXII/2024, dalam penafsiran ambang batas usia calon kepala daerah tahun 2024 berakibat pada ketidakpastian hukum dan ketidaksesuaian dengan asas umum pemerintahan yang baik yang sejalan dengan prinsip checks and balances pemerintahan. Hasil penelitian: Putusan Mahkamah Agung Nomor 23 P/HUM/2024 menetapkan bahwa usia calon kepala daerah dihitung sejak pelantikan, sedangkan Putusan Mahkamah Konstitusi Nomor 70/PUU-XXII/2024 menyatakan bahwa usia dihitung sejak penetapan pasangan calon. Perbedaan ini menciptakan ketidakpastian hukum yang berdampak pada pelaksanaan Pilkada 2024. Kedua lembaga memiliki argumen hukum dan ada implikasi dari putusan tersebut terhadap sistem checks and balances dalam pemerintahan. Perbedaan pandangan antara Mahkamah Agung dan Mahkamah Kosntitusi tidak hanya mencerminkan ketidakpastian hukum, tetapi juga berpotensi mengganggu proses demokrasi dan partisipasi politik, terutama bagi generasi muda. Pelaksanaan Pilkada tahun 2024 menggunakan Putusan Mahkamah Konstitusi Nomor 70/PUU-XXII/2024, yang mengatur bahwa usia calon kepala daerah yaitu paling rendah 30 tahun untuk calon gubernur dan wakil gubernur, dan usia paling rendah 25 tahun untuk calon bupati dan wakil bupati serta calon walikota dan wakil walikota, yang dalam hal ini dihitung sejak penetapan pasangan calon karena telah melewati tahapan-tahapan Pilkada 2024. Penerapan Penelitian: Lembaga Negara dan Pemerintah diharapkan lebih teliti dalam menerbitkan penafsiran melalui putusan yang sama-sama bersifat final, mengikat, dan erga ormes, sehingga tidak terjadi adanya ketidakpastian hukum. Diharapkan adanya upaya harmonisasi peraturan untuk mencegah adanya dualism hukum, yang dapat menimbulkan konflik dan merugikan masyarakat. Kebaruan/Orisinalitas: Penelitian ini menelaah Putusan Mahkamah Agung Nomor 23P/HUM/2024 dan Putusan Mahkamah Konstitusi Nomor 70/PUU-XXII/2024 terkait ambang batas usia calon kepala daerah dan implikasi dari Putusan Mahkamah Agung Nomor 23P/HUM/2024 dan Putusan Mahkamah Konstitusi Nomor 70/PUU-XXII/2024 dalam menciptakan checks and balances di pemerintahan.
