Abstract

The creation of employment and strive through the clarity of the rights and obligations of the parties (worker/workers and employers), to clarify the rights and obligations of the parties in industrial relations, both regarding the rights and obligations are the norms of work (Labour Legislation) as well as the nature of Work Terms (Terms of Employment), need a means of industrial relations in the form of Individual Work Agreements (PKP) who apply individually and joint work Agreement (PKB) who collectively apply. The problem examined concerns the political configuration of the legitimately in the manufacture of PKP and PKB. Research methods in this study using a descriptive analytical. The research results obtained that the making of PKP applies should be qualified legitimately an agreement as provided for in article paragraph (1) 1320 s. d subsection (4) the book of the law of civil law (KUHPerdata), and specifically the process of formulation of the PKB should match the concept of the Welvaartsstaat with the character of the legal product PKB responsive/populistik.Keywords: Political Configuration, Individual Work Agreements, Joint Work Agreement.

Abstract

There must be harmony between the awareness and political attitude of the government that views the UUCK wage law can realize the wishes of all parties in industrial relations (Employers, Workers / Labor, Government), namely the desire of employer groups to realize productivity and/or corporate profit, the desire of workers/labor groups in the form of decent income and the desire of the government to improve the investment ecosystem and competitiveness of Indonesia. Therefore, the government must take and/or recommend a decision, strategically to realize the UUCK wage law that can simultaneously realize the wishes of all parties in industrial relations.Keywords : UUCK Wage Law, Industrial Relations, Employers, Workers/Labor.

Abstract

ABSTRACTThe participation of the society, business community and the Government of Cianjurregency in creating the expansion of employment by the slogan "Cianjur Jago" in linewith the Vision of Cianjur Regency 2016-2021 "Cianjur Lebih Maju dan Agamis" (moreadvance and religious) and Medium Term Development Mission 2016-2021 for the nextfive years is a commitment to achieve the Vision of Cianjur, which is to increasedevelopment in all sectors without any boundaries. Abstract

Tulisan ini akan membahas kebijakan formulasi delik agama dalam Kitab Undang-Undang Hukum Pidana yang baru yakni dalam Rancangan Kitab Undang-Undang Hukum Pidana versi tahun 2015. Hal ini menjadi penting karena sila pertama dari Pancasila sebagai falsafah hidup, jiwa, pandangan, pedoman dan kepribadian bangsa Indonesia sekaligus menjadi falsafah bangsa dan Negara serta menjadi sumber dari segala sumber hukum di Indonesia adalah Ketuhanan Yang Maha Esa. Ini berarti, Indonesia adalah salah satu negara berTuhan dan memiliki filosofi Ketuhanan yang mendalam serta menempatkan agama sebagai sendi utama dalam kehidupan bermasyarakat, berbangsa dan bernegara. Dalam kedudukannya sebagai Negara hukum khususnya Negara hukum Pancasila (sebagai religious nation state), agama menempati posisi sentral dan hakiki dalam seluruh kehidupan masyarakat yang perlu dijamin dan dilindungi (tidak dapat dikurangi dalam keadaan apapun) sebagaimana diamanatkan oleh Undang-Undang Dasar 1945 sebagai Konstitusi Negara dan Undang-Undang Republik Indonesia No. 39 Tahun 1999 tentang Hak Asasi Manusia bahkan agama dan kerukunan hidup antarumat beragama (sehingga tercipta suasana kehidupan yang harmonis dan saling menghormati dalam semangat kemajemukan, memperkukuh jati diri dan kepribadian bangsa serta memperkuat kerukunan hidup bermasyarakat, berbangsa dan bernegara) dicantumkan sebagai hal yang penting dalam Garis-Garis Besar Haluan Negara (GBHN). Oleh karena itu, wajar jika Negara memasukan atau menjadikan agama sebagai salah satu delik didalam hukum positifnya. Pengaturan mengenai delik agama ini dipandang penting karena penghinaan (atau cara-cara lainnya) terhadap suatu agama yang diakui di Indonesia dapat membahayakan perdamaian, kerukunan, ketentraman, kesejahteraan (baik secara materil maupun spirituil), keadilan sosial dan mengancam stabilitas dan ketahanan nasional. Agama juga dapat menjadi faktor sensitif yang dapat menghancurkan persatuan dan kesatuan bangsa Indonesia. Atas alasan tersebut juga tulisan ini dibuat sebagai salah satu sumbangsih pemikiran dalam rangka mengetahui rumusan delik agama dan kelemahan-kelemahan yang ada didalamnya sehingga dimasa yang akan datang, dapat dilakukan pembaharuan. Diluar adanya pro-kontra dimasukannya delik agama dalam Kitab Undang-Undang Hukum Pidana yang baru, Hasil penelitian, menunjukan bahwa pengaturan mengenai tindak pidana terhadap agama dan kehidupan beragama dalam Rancangan Kitab Undang-Undang Hukum Pidana (RKUHP) mengacu kepada perkembangan blasphemy di Inggris atau perkembangan Godslasteringswet di Belanda. Kriminalisasi delik agama di Indonesia didasarkan pada religionsschutz theorie (teori perlindungan agama), gefuhlsschutz theorie (teori perlindungan perasaan keagamaan) dan friedensschutz theorie (teori perlindungan perdamaian atau teori perlindungan ketentraman umat beragama). Dalam RKUHP, delik agama ini dirumuskan dalam 8 pasal yang terbagi menjadi 2 kategori yakni: Tindak Pidana Terhadap Agama (yang mencakup penghinaan terhadap agama dan penghasutan untuk meniadakan keyakinan terhadap agama) dan Tindak Pidana Terhadap Kehidupan Beragama dan Sarana Ibadah (yang mencakup gangguan terhadap penyelenggaraan ibadah dan kegiatan keagamaan dan perusakan tempat ibadah). Kebijakan formulasi delik agama tersebut masih banyak mengandung kelemahan sehingga akan berpengaruh terhadap tahap aplikasi dan eksekusinya dalam praktik berhukum di Indonesia. Dalam kaitannya dengan delik agama, penggunaan sanksi pidana tentu harus memperhatikan rambu-rambu penggunaan pidana dan harus dilakukan dengan tujuan melakukan prevensi umum dan prevensi khusus. Oleh karena itu, hasil penelitian ini diharapkan dapat menjadi bahan masukan bagi penyempurnaan kebijakan formulasi RKUHP versi tahun 2015 khususnya yang berkaitan dengan delik agama. Penelitian ini menggunakan metode penelitian hukum normatif (yuridis normatif) dengan melakukan studi bahan kepustakaan guna mengumpulkan data sekunder dan dilakukan penafsiran dengan menggunakan pendekatan undang-undang, perbandingan hukum, sejarah hukum, asas hukum dan teori hukum.

Abstract

ABSTRAK     Revolusi Industri 4.0  (RI 4.0) berpotensi meningkatkan kualitas hidup masyarakat di seluruh dunia, namun  RI 4.0 telah menimbulkan kekhawatiran bahwa mesin-mesin suatu hari akan mengambil alih pekerjaan manusia, antara lain kemajuan kecerdasan buatan dan otomatisasi dapat menggantikan tenaga kerja manusia secara keseluruhan yang digantikan oleh  teknologi robotik, digital dan otomatisasi (RI 4.0), hal ini berarti akan terjadi gelombang pengangguran dan pemutusan hubungan kerja (PHK) secara massal. Untuk menekan seminimal mungkin potensi negatif tersebut, perusahaan harus cepat tanggap dalam mengambil sikap demi menjaga kestabilan perusahaan salah satunya PT Fasic Indonesia harus meingkatkan kualitas keterampilan pekerja dalam menghadapi RI 4.0. Adapun metode yang digunakan dalam kegiatan tersebut perusahaan harus merencanakan, melaksanakan dan mengevaluasi hasil dari capaian yang ditargetkan. Tujuan dari pelaksanaan pelatihan diharapkan ketrampilan, keahlian, potensi kerja, produktivitas, disiplin, dan etos kerja) Supervisi di PT Fasic Indonesia dapat meningkat dan mengembang sesuai standar ilmu pengetahuan dan teknologi RI 4.0.ABSTRACTThe Industrial Revolution 4.0 (RI 4.0) has the potential to improve the quality of life of people around the world, but RI 4.0 has raised concerns that machines will one day take over human jobs, including advances in artificial intelligence and automation that can replace the human workforce as a whole being replaced. By robotic, digital and automation technology (RI 4.0), there will be a wave of mass unemployment and layoffs (layoffs). To minimize this negative potential, companies must be responsive in taking a stance to maintain company stability, one of which is PT Fasic Indonesia, which must improve the quality of workers' skills in facing RI 4.0. As for the method used in these activities, the company must plan, implement, and evaluate the targeted achievements' results. The aim of the training is that skills, expertise, work potential, productivity, discipline, and work ethic are expected) Supervision at PT Fasic Indonesia can increase and develop according to the standard of science and technology RI 4.0.

Abstract

ABSTRAK Lembaga Kerja Sama Bipartit merupakan forum komunikasi dan konsultasi antara pengusaha dengan wakil serikat pekerja/serikat buruh dan/atau wakil pekerja/buruh untuk menciptakan hubungan industrial yang berkeadilan menjaga kelangsungan hidup, pertumbuhan, dan perkembangan perusahaan, termasuk kesejahteraan pekerja/buruh. sehingga dapat mencegah terjadinya perselisihan hubungan industrial, walaupun terjadi perselisihan hubungan industrial dapat selesaikan secara musyawarah (bipartit) tanpa harus melibatkan pihak ketiga, sehingga mogok dan penutupan perusahaan (lockout) tidak perlu digunakan untuk memaksakan kehendak. fungsi hukum LKS Bipartit, adalah: sebagai standard of conduct, sebagai as a tool of social of engeneering, sebagai as a tool of social of control  dan sebagai  as a facility on human interaction untuk mewujudkan hubungan industrial harmonis (Industrial Peace) yaitu hak dan kewajiban pengusaha serta pekerja/buruh terjamin dan dapat dilaksanakan, mencegah potensi terjadinya perselisihan hubungan industrial dan kalaupun terjadi perselisihan hubungan industrial tidak perlu melibatkan pihak ketiga karena dapat diselesaikan secara musyawarah (Bipartit) secara internal sehingga mogok dan penutupan perusahaan (lock out) tidak perlu digunakan untuk memaksakan kehendak.ABSTRACTThe Bipartite Cooperation Institution is a forum for communication and consultation between employers and representatives of trade unions/labor unions and/or representatives of workers/laborers to create fair industrial relations to maintain the survival, growth, and development of the company, including the welfare of workers/labourers. so that it can prevent industrial relations disputes, even though industrial relations disputes can be resolved by deliberation (bipartite) without having to involve third parties, so strikes and company closures (lockout) do not need to be used to impose their will. The legal functions of the Bipartite LKS are: as a standard of conduct, as a tool of social engineering, as a tool of social control and as a facility on human interaction to realize harmonious industrial relations (Industrial Peace), namely rights and obligations. employers and workers/labourers are guaranteed and enforceable, preventing potential industrial relations disputes and even if industrial relations disputes occur, there is no need to involve third parties because they can be resolved internally by deliberation (Bipartite) so strikes and company closures (lockout) do not need to be used to obtrude.

Abstract

Employers who hire at least 10 (ten) employees shall make a company regulation. A company regulation is a written rule made by the employer which contains the terms of employment and the rules of the company. In the rule-making companies need continually to do under the technical guidance in order to gain the company rules that provide a protection for workers. Rule-making company is the employers’ responsibility, which is in the drafting process should heed the advice and judgment of representatives of workers or from labor unions.

Abstract

The digital transformation of government systems through the Electronic Based Government System (EBS) in Sukabumi District reflects the government's efforts to achieve transparent, accountable, and responsive governance to public needs. This research aims to analyse the implementation of the digitisation policy as well as the challenges faced, including the development of telecommunication infrastructure, human resource skills enhancement, and integration of public service systems. Through qualitative methods and literature study, it was found that the success of SPBE requires not only strong technological infrastructure but also collaboration between central and local governments, as well as training for government employees. The results showed that despite obstacles such as limited infrastructure in remote areas, the strategic measures implemented were able to encourage the creation of a more modern and inclusive government.

Abstract

The open proportional electoral system implemented in Indonesia since the 2009 general election aims to improve political representation and strengthen democracy by giving voters more freedom to directly select legislative candidates. However, despite its good intentions, the system presents various challenges in practice, including high political costs, rampant money politics, and weak party control over legislative candidates. The main issue in this research is how the effectiveness of the open proportional system in achieving the goal of fair and stable political representation in Indonesia. This research uses a normative juridical approach to analyse the Constitutional Court's decisions related to the electoral system, as well as comparing with other electoral systems. The author argues that although an open proportional system can increase voter freedom, its negative impacts are greater, especially in terms of high political costs and money politics practices that undermine the integrity of elections. In addition, this system causes divisions within political parties, as legislative candidates focus more on personal votes rather than the collective interests of the party. The findings of this study suggest that although an open proportional system is more democratic in theory, its implementation in Indonesia tends to exacerbate political inequality and reduce political stability. Therefore, a mixed proportional system is suggested as a more effective solution to improve political representation and reduce the negative impacts.
