Abstract

Tujuan penelitian ini adalah menganalisis pandangan Maqashid Syari`ah al-Khamsah terhadap putusan Mahkamah Konstitusi nomor 46/PUU-VIII/2010 tentang status anak luar nikah, pendapat Fatwa Maqashid Syari'ah al-Khamsah MUI No. 11 Tahun 2012 dan perbandingan diantara kedua putusan tersebut. Untuk memecahkan isu hukum terkait penelitian tersebut, pendekatan yang digunakan dalam penelitian ini adalah pendekatan undang-undang (statute approach) dan pendekatan perbandingan (comparative approach). Hasil penelitian mengungkapkan bahwa dalam Putusan Mahkamah Konstitusi Nomor 46/PUUVIII/2010 tentang status anak luar nikah, konsep al-dharuriyat, Maqashid Syariah al-Khamsah atau hifdz nafs dibahas sangat erat, karena membahas tentang hak anak melindungi jiwa anak dengan memenuhi kebutuhannya. Sedangkan menurut pemahaman prinsip hifdz nashl Maqashid Syari'ah al-Khamsa, keturunan yang sah adalah anak yang lahir dari perkawinan yang sah secara agama. Fatwa MUI No. 11 Tahun 2012 tentang status anak luar nikah dan perlakuan terhadap kelahirannya. Hal ini sejalan dengan Maqasid Syari'ah al-Khamsah, khususnya yang berkaitan dengan hifdz nashli karena Maqasid Syari'ah al-Khamsah yang menyatakan bahwa generasi anak bagi orang tuanya adalah yang lahir dari perkawinan sah. Fatwa tersebut juga sesuai dengan Maqasid Syari’ah al-Khamsah dalam hifdz nafs yaitu dengan diwajibkannya bagi laki-laki yang mengakibatkan kelahirannya untuk memenuhi kebutuhan hidup sang anak dan memberikan harta yang dimiliki melalui wasiat wajibah.

Abstract

Artikel ini bertujuan untuk menganalisis dan mengkaji pengaturan perlindungan hukum terhadap anak korban kekerasan seksual di Indonesia dan untuk menganalisis dan mengkaji bagaimana pelaksanaan perlindungan hukum kekerasan seksual secara represif di Indonesia. Masalah difokuskan pada perlindungan hukum terhadap anak korban kekerasan seksual di Indonesia. Guna mendekati masalah ini dipergunakan acuan teori dari artikel atau karya yang sesuai dengan masalah penelitian. Data-data yang didapat dikumpulkan melalui studi kepustakaan dan studi dokumentasi yang bersumber dari peraturan perundang-undangan yang terkait dengan masalah penelitian, buku-buku hukum yang mengandung konsep-konsep hukum, dokumen resmi, publikasi, dan hasil penelitian dan dianalisis secara kualitatif. Kajian ini menyimpulkan bahwa, Perlindungan hukum terhadap anak korban kekerasan seksual telah diatur secara spesifik dalam berbagai peraturan perundang-undangan tentang anak. Kasus kekerasan seksual di Indonesia sangat beragam dengan berbagai motif dan tindakan yang berbeda yang melibatkan berbagai pihak. Bentuk perlindungan hukum di Indonesia dalam praktek sudah sesuai dengan peraturan yang berlaku. Hal tersebut dapat dilihat dalam Putusan Nomor 320/Pid.Sus/2022/PN.Kpn yang memutus perkara tindak pidana melakukan ancaman kekerasan terhadap anak untuk melakukan perbuatan cabul yang dilakukan oleh orang tua secara berlanjut.

Abstract

This research focuses on the ambiguity of legal norms related to recidivism in the juvenile justice system in Indonesia, particularly within the framework of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (UU SPPA). This research uses a normative juridical approach with conceptual analysis methods and a statute approach, supported by empirical data from five case studies of recidivist juvenile cases tried at the District Court "X" during the period 2022–2024. The research findings indicate that the absence of explicit norms regarding juvenile recidivism leads to disparities in sentencing, weak legal certainty, and potential violations of the principle of child protection. This research recommends the need to reformulate the SPPA Law to include substantive provisions regarding recidivism, as well as harmonization with the National Draft Criminal Code which has systematically included the definition of recidivism. The implications of this research emphasize the importance of a more responsive and consistent legal reform in ensuring justice for children in conflict with the law

Abstract

This research aims to analyze the legal position of preferential creditors regarding collateral owned by third parties (guarantor) within the bankruptcy system in Indonesia, using a normative juridical approach and case studies of commercial court rulings. In practice, there is often inconsistency between legal norms and their application, especially when the curator includes third-party collateral in the bankruptcy estate without a valid legal basis. Based on Articles 55 and 56 of Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations (UUK-PKPU), a separatis creditor has an execution right that can still be carried out independently, even if the debtor is declared bankrupt. These rights are protected by the principles of droit de préférence, droit de suite, and the accessory principle in the theory of property security. This research also shows that the curator does not have the legal authority to determine the ownership status of the collateral object, which should be determined by the court. Protection of third-party property rights is guaranteed by the theory of property protection and the constitution. Therefore, consistency in the application of law, technical guidelines, and stable jurisprudence is necessary to ensure legal certainty, justice, and balanced protection of the rights of all parties in the bankruptcy process.

Abstract

This research is motivated by the lack of explicit regulations regarding the authority of notaries in making deeds of postponement of inheritance distribution which has the potential to cause legal uncertainty and disputes. This research aims to analyze the authority of notaries, the reasons for postponement, and legal protection for the parties. The method used is normative legal research with a statutory, conceptual, and case approach through literature study and analysis of court decisions. The results of the research indicate that notaries are authorized to formalize postponement in authentic deeds based on Article 15 of the Notary Law and a binding agreement according to Article 1338 of the Civil Code. The postponement is carried out for legitimate reasons as stated in Article 1066 and Article 1074 of the Civil Code as well as the notary's duty of prudence. This research concludes that postponement is a legitimate preventive mechanism based on Article 833, Article 955, and Article 1865 of the Civil Code as well as Article 16 and Article 65 of the Notary Law to ensure legal certainty and protection.

Abstract

The notary profession plays an important role in maintaining the credibility of notarial practice. The existence of Law No. 2 of 2014 concerning the Position of Notary has not yet been able to fully uphold this credibility, as in reality, issues related to improper recording practices in Indonesia often referred to as bogus records are still frequently encountered. This study aims to interpret notarial practice based on principles from the Qur'an, which emphasize the actualization of notaries as professionals. A qualitative-interpretative method was used, guiding the researcher to interpret the professional conduct of notaries. In conducting this interpretation, the researcher refers to QS. Al-Baqarah (2): 282, At-Taubah (9): 119, An-Nahl (16): 90, and Al-Ahzab (33): 72. The findings of this study indicate that Qur'anic values such as honesty (sidq), justice (‘adl), and trustworthiness (amānah) are essential in shaping the professional ethics of notaries. The implementation of these values can strengthen the integrity of the notary profession serving as a moral guideline in carrying out their duties not merely as an administrative obligation. This study proposes the need for integrating Qur'anic values into notary professional education and reinforcing ethical code supervision to create a more moral and civilized legal system.
