Abstract

This paper elaborates strategy to stop child marriage in NTB (Nusa Tenggara Barat) via local culture that internalized in formal education. Child marriage has ruined the future of children. This practice is not just as well as ignoring the rights of children under the disguise of religion and adat. Child marriage in NTB via merariq tradition has violated child’s rights as well as making girls vulnerable under Sasak Adat Law. However if being investigated further this tradition is giving full autonomy to girls in taking decision in marriage. In modern era, this rights and autonomy are not being exercised and even erased from girls’s rights. this creates more vulnerability to girls. The reformed merariq adat law need to be reformed and inserted into formal education so that girls are empowered and able to fight against child marriage.

Abstract

Abstract The persistent occurrence of gender-based sexual violence within Indonesian pesantren (Islamic boarding schools) demands urgent academic scrutiny, particularly due to its underreported nature and the complex power dynamics embedded within their exclusive and autonomous educational structures. While existing scholarship has primarily centered on the causes and prevention of sexual violence in these institutions, the lived experiences, agency, and resistance strategies of survivors remain critically underexplored. Addressing this gap, the present study investigates how survivors within pesantren contexts navigate their transformation from perceived powerless victims to active agents of resistance. Specifically, it examines the sociocultural barriers they encounter, the forms of resistance they employ, and the broader implications of their defiance. Employing a qualitative literature review methodology, this research synthesizes insights from 20 relevant studies—7 focused on pesantren in Indonesia and 14 international studies on survivor resistance. Thematic analysis was conducted, with data interpreted through the lenses of radical feminist theory and agency theory, focusing on female representation in pesantren and survivor-driven resistance. Findings indicate that, despite the deeply patriarchal and feudal systems that characterize many pesantren, survivors assert agency through diverse strategies—ranging from personal resilience and storytelling to legal advocacy and collective mobilization. These acts of resistance not only challenge systemic silencing but also contribute meaningfully to shifts in public discourse and legal accountability. This study contributes a critical perspective to gender and Islamic education scholarship by centering survivor agency and offering pathways for transformative justice within religious educational settings. Keywords: Resistance; Survivors; Sexual Violence; Pesantren; Santriwati.Abstrak Kasus kekerasan seksual berbasis gender yang terus terjadi di lingkungan pesantren di Indonesia menuntut perhatian akademik yang mendesak, terutama karena sifatnya yang jarang dilaporkan serta dinamika kekuasaan yang kompleks dalam struktur pendidikan yang eksklusif dan otonom. Meskipun sejumlah penelitian telah menyoroti penyebab dan upaya pencegahan kekerasan seksual di pesantren, pengalaman hidup, agensi, dan strategi perlawanan para penyintas masih sangat minim dieksplorasi. Untuk mengisi kekosongan ini, studi ini menelusuri bagaimana para penyintas di lingkungan pesantren membangun transformasi dari korban yang dipersepsikan tidak berdaya menjadi subjek aktif yang melawan. Secara khusus, penelitian ini mengkaji hambatan sosial dan kultural yang mereka hadapi, bentuk-bentuk perlawanan yang mereka lakukan, serta dampak yang lebih luas dari tindakan perlawanan tersebut. Dengan menggunakan metode tinjauan pustaka kualitatif, penelitian ini mensintesis temuan dari 20 studi relevan—7 di antaranya berfokus pada konteks pesantren di Indonesia dan 14 studi internasional tentang perlawanan penyintas. Analisis tematik dilakukan dengan menggunakan kerangka teori feminis radikal dan teori agensi, dengan fokus pada representasi perempuan dalam pesantren dan resistensi yang digerakkan oleh penyintas. Temuan menunjukkan bahwa, meskipun sistem patriarkal dan feodal sangat mengakar dalam banyak pesantren, para penyintas menunjukkan agensi melalui berbagai strategi—mulai dari ketahanan pribadi dan narasi pengalaman, hingga advokasi hukum dan mobilisasi kolektif. Tindakan perlawanan ini tidak hanya menantang pembungkaman sistemik, tetapi juga memberikan kontribusi signifikan terhadap perubahan wacana publik dan akuntabilitas hukum. Studi ini menawarkan perspektif kritis dalam kajian gender dan pendidikan Islam, dengan menekankan agensi penyintas serta membuka jalan bagi keadilan transformatif dalam lingkungan pendidikan keagamaan. Abstract

Pembangunan pariwisata di Indonesia diposisikan sebagai sektor unggulan ekonomi nasional, namun pendekatannya masih didominasi oleh paradigma ekonomi-politik yang mengabaikan dimensi gender. Perempuan, yang menjadi mayoritas tenaga kerja di industri ini, sering kali menghadapi beban ganda, diskriminasi, dan keterbatasan akses terhadap pengambilan keputusan serta perlindungan sosial. Penelitian ini bertujuan untuk mengkaji sejauh mana Rancangan Undang-Undang Kepariwisataan (RUU Kepariwisataan) mengakui dan melindungi hak-hak perempuan dalam pengembangan sektor pariwisata di Indonesia. Dengan menggunakan pendekatan kualitatif berbasis studi dokumen, analisis dilakukan terhadap isi pasal-pasal dalam RUU Kepariwisataan 2022, khususnya Pasal 18, 60, dan 67, dengan menggunakan lensa teori feminis Marxis dan pendekatan Gender and Development (GAD). Hasil analisis menunjukkan bahwa RUU ini memuat tujuan pembangunan dan penguatan sektor pariwisata, namun belum mengintegrasikan perspektif gender secara eksplisit dan kurang memberikan perlindungan serta pengakuan terhadap hak-hak perempuan. RUU masih mengadopsi paradigma Women in Development (WID) yang berfokus pada integrasi perempuan dalam ekonomi tanpa membongkar relasi kuasa yang timpang, alih-alih pendekatan Gender and Development yang lebih transformatif.

Abstract

Backgrounds: The existence of a guardian in the marriage contract within the framework of Islamic law in Indonesia is a condition that must be met by the bride. This means that the marriage contract is not valid if in the process there is no guardian accompanying the bride. The problem is that guardianship listed in the legal framework in Indonesia only gives full authority to fathers who are male. This is because the views of fiqh in Islamic marriage law in Indonesia take the Imam Syafi'i school of thought. Aim: The research would like to analyze the authority reformulation of gender equal marriage guardians through the lens of 4 jurisprudence schools. Methods: The article used the literature review method by utilizing secondary data from 3 Islamic yellow books and other supporting ones like journals and books. Findings: This study shows that the four schools of fiqh indicate the existence of opportunities or potential for female heads of households to become marriage guardians for their daughters.

Abstract

This article conducted study on court decisions on dispensation for marriage that occurred during the COVID-19 pandemic (June 2020 to February 2021) from the children’s rights perspective. The library research method was chosen to dissect 19 marriage dispensation decisions (12 decisions from religious courts and seven decisions from district courts) in Kraksaan and Sumenep districts, East Java. Child married couples were randomly selected with one or both parties under the age of 18. Three important findings in this study are: 1) the perspective of the best interests of the child has not been the main consideration for judges; 2) judges position girls as adults, standardize biased gender roles, and ignore children's experiences and aspirations; and 3) method of analysis that is not appropriate in measuring the meaning of a child's readiness to enter into marriage; neglect of children's basic rights, including education, reproductive health, and child development, as well as cultural bias makes the Marriage Dispensation Decision in this study a decision that is not in line with the prevailing laws on children’s rights.

Abstract

This article investigates how the female voice and body are constructed in the annunciation and pregnancy narratives of Maryam in the Qur’an (QS Maryam: 19–20) and Mary in the Gospel of Luke (1:34). The research aims to examine how these sacred texts reflect women’s experiences of alienation and agency in relation to pregnancy, situated within the tension between divine will, patriarchal norms, and autonomy. Methodologically, the study employs a qualitative literature-based approach combined with feminist critical discourse analysis, grounded in Simone de Beauvoir’s existentialist feminism and supported by gender-sensitive hermeneutics. Classical tafsir and biblical commentaries are re-read alongside contemporary feminist theological and philosophical literature to trace how religious authority and cultural expectations shape the meaning of pregnancy. The analysis demonstrates that the narratives of Maryam/Mary encode a recurrent pattern of alienation of the female body: pregnancy appears as something that “happens” to women, their honour is tied to sexual purity, and their consent is articulated within heavily gendered structures. At the same time, the figures of Maryam and Mary retain elements of questioning, resistance, and spiritual strength that disrupt purely passive portrayals. The main contribution of this study lies in proposing an alternative reading of Maryam/Mary as symbols of transcendent, spiritual resistance rather than merely immanent reproductive roles. By highlighting alienation, bounded agency, and embodied subjectivity, the article expands feminist theological discourse. It offers a critical framework for rethinking motherhood, consent, and women’s bodily autonomy in contemporary Muslim and Christian contexts.
