Abstract

This article presents the opinion of imams of four Islamic legal schools (mazhab) regarding the validity of hadits as the source of Islamic law. This study shows that the opinion of the imams on that issue is various. According to Abu Hanifah, al-sunnah can be accepted as the source of Islamic law with the condition that it is related by reliable men. As to hadits ahad, he requires that it does not contradict the principles agreed upon by ‘ulama, and its content (matan) does not concern with general issues, nor does it contravene the qiyas. He even accept the hadits mursal if it does not contradict the Quran. While according to Malik bin Anas, hadits can be accepted as the argumentation (hujjah), not only for hadits mutawatir, but also for hadits masyhur, hadits mursal, and hadits ahad, with the condition that they do not contradict the actions of Madinah scholars. Idris al-Syafi’i contends that hadits ahad can be accepted as the source of Islamic law with the requirement that it is related by dhabith transmitter. This is also the case with the hadits mursal. According to Syafi’i, the status of hadits mutawatir is higher than hadits ahad and hadits mursal. Another imam, Ahmad bin Hanbal, uses all kinds of hadits, mutawatir, ahad, mursal, and dha’if, as the sources of Islamic law. He even prefers hadits dha’if

Abstract

This article explores the ijtihad system in Islamic law with special reference to ibn Taimiyah’s reform method. This study reveals that ibn Taimiyah is one of proponents of reform in ijtihad methodology. In this methodology, he frequently follows the line of Hanbalite system, and neglects three other systems, Hanafite, Malikite, and Syafi’ite. He even produces some works according to his own methodology. Ibn Taimiyah lays so much emphasis on the application of ijtihad methodology based on Qur’an and Sunnah, yet does not neglect ijma’, qiyas, and maslahah mursalah, with strict requirement. He is different from Abu Hanifah who emphasizes the application of istihsan and ‘urf, from Malik who emphasizes maslahah mursalah, and from Syafi’i who prefers the istidlal methodology. Actually, ibn Taimiyah appreciates the rational faculty in analizing the texts (nash). According to him, the usage of rational reasoning makes Islamic law logical. In comprehending religious truth, especially related to natural phenomena and social life, ibn Taimiyah is an empiricist and rationalist. This in turn endorses the scientific experiment and direct observation.

Abstract

This research is an explanation of islamic religion make attention in the form of outward and inward towards orphans as one of the main indicators for the quality of a person’s religious. Similarly, the act of 1945 by one of the article, which reads: the poor and neglected children maintained by the state, in a brightly lit also showed a high concern for the lives of orphans.As the implementation of the country’s attention, the government through the ministry of social affairs has provided the institutional and fnancial resources. At the ministry of social affairs, there is one special directorate in charge of fostering orphans, among others, especially by means of the orphanage. One orphanage long-standing and growing signifcant in the management orphanage orphanage is Sitti Khadija Pinrang. Sitti Khadija orphanage Pinrang is the best in Pinrang, even one of the best in South Sulawesi. Orphanage Sitti Khadija Pinrang looks from day to day more and get a good response from the government and the whole society

Abstract

Kasus kekerasan pada anak masih marak terjadi khusunya yang terjadi dalam lingkup keluarga. Pelaku kekerasan berdasarkan hubungan orangtua baik suami maupun istri masih sangat tinggi persentasenya. Salah satu strategi yang dilakukan adalah dengan pengasuhan disiplin postif islami. Pengasuhan disiplin positif Islami mengarahkan orang tua melihat dibalik setiap perilaku, perasaan, dan pikiran anak sehingga orang tua mampu memahami perkembangan anak. Kekerasan disebabkan oleh persepsi yang terbangun yakni proses belajar, motivasi, dan kepribadian. Tujuan dari penelitian ini adalah efektifitas pengasuhan disiplin positif Islami bagi orang tua sebagai upaya penurunan kekerasan terhadap anak di Kabupaten Sidenreng Rappang. Desain penelitian menggunakan quasi-eksperimen yang dilakukan pada 34 orangtua yang berada dalam sebelas kecamatan di Kabupaten Sidrap. Taeknis analisis data yang digunakan adalah uji paired sample T Tes dengan desain eksperimennya yaitu pre test – post test design yaitu dengan membandingkan antara hasil pre test sebelum diberikan perlakuan dengan hasil post test setelah diberikan perlakuan. Hasil penelitian menunjukkan bahwa pengasuhan disiplin positif Islami efektif mengubah persepsi kekerasan orang tua terhadap anak di Kabupaten Sidrap.

Abstract

This research investigates the impact of oyster business management on improving the economic conditions of families in Lajari, Barru district, through the lens of Islamic economics. The study has three primary objectives: firstly, to assess the economic status of families in Lajari, Barru district; secondly, to analyze the contributing factors to the success of oyster business management in enhancing the family economy in the area; and thirdly, to explore the implementation of oyster business management in light of Islamic economic principles. Employing a qualitative research approach with a descriptive method, the study utilizes observation, interviews, and documentation as data collection techniques, drawing information from interviews with oyster business practitioners. The findings reveal several noteworthy aspects. First, the establishment of grilled oyster enterprises has positively impacted the economic conditions of families in the locality, leading to an indirect increase in their income. Second, the success of the grilled oyster business can be attributed to effective sales promotion, marketing strategies, and responsiveness to consumer demands, allowing the business to sustain and thrive over time. Third, oyster entrepreneurs exhibit appropriate business practices, prioritizing the common interests of the family without causing harm to others, and aligning their actions with Islamic principles in both income generation and management.

Abstract

This study aims to evaluate the implementation of the Tahfiz Al-Qur'an Program in high school students in Bulukumba Regency, especially at SMAN 1 Bulukumba and MAN 2 Bulukumba, using the CIPP (Context, Input, Process, Product) evaluation model. The main purpose of this study is to assess the effectiveness of the program in improving students' memorization skills, comprehension, and religious character formation, as well as identifying supporting and inhibiting factors in its implementation. This study uses a qualitative approach with a multi-location case study method. Data was collected through interviews with tahfiz teachers, students, and principals, observations of tahfiz activities, and program documentation. The results of the analysis showed that the program received support from schools, parents, and external institutions, despite differences in resources between the two schools. The implementation process runs routinely, but still faces obstacles in terms of time allocation and limited facilities. In general, the program has a positive impact on improving Qur'an memorization, student involvement in religious activities, and character building. This research shows the importance of optimizing facilities, teacher training, and integrating tahfiz programs in the curriculum in order to contribute more to the spiritual and moral development of students at the secondary level.

Abstract

Government Regulation Number 45 of 1990 concerning Marriage and Divorce Permits for Civil Servants in article 3 stipulated that all civil servants intending to divorce had to have prior permission from their superiors or a letter of recommendation from a relevant official. This administrative requirement was mandatory, allowing the judge to consider and decide on divorce cases involving civil servants. This research employed field research with an empirical juridical approach, which was conducted directly to understand the real issues and was then linked to applicable laws, the legal certainty theory, and the maslahah theory (maintaining the objectives of shari'a and achieving benefits/avoiding harms). The research findings concluded that: 1) the divorce requirements in the maslahah theory aimed to reduce the divorce rate among civil servants. Superiors or authorized officials had the right to guide employees to try to preserve their marriages; 2) the Parepare Religious Court granted six months to obtain permission from superiors. If, by the specified deadline, the individual did not have this permission and still wished to divorce, they were required to submit a statement willing to bear the consequences of divorce without the superior's permission. The related consequences were outlined in Government Regulation Number 94 of 2021 on Civil Servant Discipline; 3) there was a connection between the judge's consideration and the maslahah theory. In addition to considering the applicable laws, the judge also took into account aspects of maslahah when making decisions. The maslahah obtained from a formal divorce in the Religious Court included legal certainty and justice in the judge's divorce decree.
