Abstract

(Restorative Justice) adalah suatu pendekatan keadilan yang mengfokuskan kebutuhan dari pada para korban, pelaku kejahatan, dan juga melibatkan peran serta masyarakat, dan tidak semata-mata memenuhi ketentuan hukum atau penjatuhan pidana. Penelitian ini dilakukan pada Polsek Pariangan dalam perkara tindak pidana ringan pencurian. Focus permasalahan yang terdapat dalam penelitian adalah Bagaimana proses penyelesaian Restorative Justice perkara tindak pidana ringan melalui Restorative Justice oleh Bhabinkamtibmas di Polsek Pariangan ? serta Bagaimana hambatan dari Penerapan Restorative Justice Terhadap Pelaku Tindak Pidana Pencurian Ringan oleh Bhabinkamtibmas di Polsek Pariangan? Metode yang digunakan dalam penelitian ini adalah penelitian hukum sosiologis, yaitu penelitian dengan melihat kenyataan hukum dalam masyarakat, melihat aspek-aspek hukum dan interaksi sosial dalam masyarakat, berfungsi sebagai penunjang bagi keperluan penelitian atau penulisan hukum. Sedangkan sifat penelitian yang dilakukan adalah bersifat deskriptif, yaitu memberikan gambaran disertai penjelasan secara sistematis mengenai tindak pidana pencurian ringan yang diselesaikan melalui restorative justice. Hasil penelitian menujukkan bahwa Proses penyelesaian tindak pidana melalui restorative justice terbagi 2, yaitu Traditional Village or Tribal Moots, Model ini merupakan akar munculnya penyelesaian sengketa pidana berdasarkan mediasi. Victim Offender Mediation, Kemunculan model Victim Offender Mediation selain disebabkan kemunculan tribal moots, juga disebabkan oleh tidak efisiennya sistim peradilan pidana yang lebih menekankan pada aspek pembalasan semata. Hambatan atau kendala dari penerapan restorative justice terhadap pelaku tindak pidana pencurian ringan yaitu Pihak korban dan pihak pelaku tidak tercapai kesepakatan damai dan Kurang optimalnya peranan Lembaga dan fungsi adat dalam menyelesaikan permasalahan. Kata kunci : penegakan hukum, pencurian ringan, restorative justice, perdamaian.

Abstract

Islam prohibits all types of crimes, including all forms of fraud. Fraud is an evil act committed by someone by deceives others. When viewed from the perspective of the actions and elements of fraud, it appears that there are similarities between fraud and crimes regulated in Islamic law, such as ghulul, treason, and lying. The research approach used is Normative Juridical legal research. The purpose of this study is to determine the regulation of the Criminal Act of Fraud in the Criminal Code and Fiqh Jinayah. And how is the process of resolving the Criminal Act of Fraud in case NO 6 / Pid.B / 2024 / PN Bkt, with the following conclusions: In Islamic criminal law, perpetrators of fraud will receive ta'zir punishment. This is because ta'zir is a type of punishment whose final decision is in the hands of the government, especially the judge who gives the verdict. The judge has the freedom to choose the type of punishment based on their assessment. This also applies to cases of fraud that have been regulated in Article 378 of the Criminal Code.

Abstract

This study discusses the role of the Witness and Victim Protection Agency (LPSK) in providing protection for justice collaborators in the justice system in Indonesia. Justice Collaborators have an important role in uncovering organized crime. Lack of attention to justice collaborators and the absence of definite guarantees in the resolution of the criminal justice system make witnesses reluctant to cooperate. Therefore, Law 30 of 2014 LPSK in implementing and implementing protection for witnesses who cooperate must provide a sense of security from threats from perpetrators of crimes that are revealed. As a consequence and sacrifice of justice collaborators that must be appreciated by law. By using normative legal research methods and normative juridical approaches, this study examines the role of LPSK based on applicable laws and regulations and the impact of protection provided by LPSK to a Justice collaborator. The case study of Richard Eliezer shows how the role of LPSK in providing protection for justice collaborators is in accordance with applicable laws and regulations. The results of this study indicate that the protection provided by LPSK allows justice collaborators to provide information more safely and objectively

Abstract

Asia For Animals Coalition announced that Indonesia is the country with the highest number of animal content uploaded on social media. There is 1,626 content showing animal abuse originating from Indonesia, according to data collected from YouTube, Facebook and TikTok between July 2020 and August 2021. However, there is still a lot of similar content from locations that have not been identified. Animal Defender Indonesia noted that the high number of animal abuse videos uploaded from Indonesia was due to "legal uncertainty". Doni Hedaru Tona, Chair of the Indonesian Animal Welfare Association, said that violence and torture against animals in Indonesia has different characteristics and levels of sadism. Many perpetrators of animal cruelty do this because they are motivated by profit. The reason why so much cruelty against animals occurs is because the perpetrators lack humanity and compassion so they are willing to carry out torture. Therefore, research was conducted entitled Analysis of the Crime of Pet Abuse (Decision Study number 72/Pid.C/2023/PN.Pdg). The formulation of the problem in this research is: What are the Forms of Crime Against Pets and How is the Analysis of Decision Number 72/Pid.C/2023/PN.Pdg Regarding Pet Abuse. This research uses normative research methods. The focus of the discussion is that Indonesian law has several regulations to protect animals from cruelty, including Article 302 paragraphs 1 and 2 of the Criminal Code which can result in a maximum prison sentence of two months for the perpetrator. However, there is a problem where judges are less strict in imposing sentences on perpetrators of animal abuse, especially if the perpetrator has committed this act repeatedly against the same pet. This can open up opportunities for the perpetrator in the future to repeat the act, because there is no deterrent effect felt by the defendant. The punishment imposed should be more severe to prevent the same behavior from recurring in the future.
