Abstract

Rights of building use are land rights where the land is not owned by itself but still has the right to construct and own buildings in accordance with the provisions of Article 35 paragraph (1) of the UUPA. Building use rights are used if land is purchased in lots and the contractor who sells the land provides the land in the form of a building use rights status certificate. Many people do not realize that the term of the right to build has expired. In fact, if you want to change the status of the right to build to a property right, you can do this at the time of purchasing the land. However, the community is still indifferent to this matter, and begins to prioritize the transfer of usufructuary rights to become property rights when there is a transaction on the land, for example at the time of land sale. The problem that will be studied in this paper is about how the existence and legal certainty in guaranteeing land with the status of usufructuary rights that have expired and the obstacles in the process of changing land from usufructuary rights to land ownership rights. Normative legal research is the method with a statutory approach. The status of Building Use Rights that are still valid or those that have expired are regulated in PP Number 18 of 2021. As well as obstacles that occur in the process of changing rights from HGB to property rights such as timeframe and costs, citizen need to be aware for the legal of building use rights. Indonesian citizens need to pay more attention to the land rights they own, so that later mistakes will not occur, especially in the administration related to land rights.

Abstract

Urgensi pelekatan sidik jari para penghadap dalam minuta akta notaris sebagai upaya memperkuat keabsahan akta otentik dan mengurangi potensi sengketa hukum. Praktik ini didasarkan pada ketentuan Pasal 16 ayat (1) huruf c UU No. 2 Tahun 2014 tentang Jabatan Notaris, yang mengamanatkan notaris untuk melampirkan sidik jari penghadap sebagai bagian dari minuta akta. Melalui pendekatan yuridis normatif, penelitian ini menganalisis dasar hukum, implementasi di lapangan, serta dampak hukum apabila ketentuan tersebut tidak dipenuhi. Hasil analisis menunjukkan bahwa pelekatan sidik jari bukan hanya formalitas administratif, tetapi memiliki fungsi penting dalam pembuktian kehadiran dan identitas para pihak dalam proses pembuatan akta. Ketiadaan sidik jari dalam minuta dapat berpotensi menurunkan nilai kekuatan pembuktian akta sebagai akta otentik, bahkan membuka celah pembatalan atau gugatan hukum di kemudian hari. Oleh karena itu, pelekatan sidik jari harus dipahami sebagai kewajiban substantif yang tidak dapat diabaikan. Penelitian ini merekomendasikan penguatan pengawasan terhadap pelaksanaan kewajiban tersebut serta peningkatan pemahaman notaris dan masyarakat Urgency of attaching the fingerprints of the parties in the minutes of notarial deeds as an effort to strengthen the validity of authentic deeds and reduce the potential for legal disputes. This practice is based on the provisions of Article 16 paragraph (1) letter c of Law No. 2 of 2014 concerning the Position of Notary, which mandates notaries to attach the fingerprints of the parties as part of the minutes of the deed. Through a normative legal approach, this study analyzes the legal basis, implementation in the field, and legal impacts if these provisions are not met. The results of the analysis show that attaching fingerprints is not just an administrative formality, but has an important function in proving the presence and identity of the parties in the deed-making process. The absence of fingerprints in the minutes can potentially reduce the value of the deed's evidentiary value as an authentic deed, even opening up the opportunity for cancellation or lawsuits in the future. Therefore, attaching fingerprints must be understood as a substantive obligation that cannot be ignored. This study recommends strengthening supervision of the implementation of these obligations and increasing the understanding of notaries and the public regarding the importance of this aspect in legal protection.
