Abstract

Abstrak .Satu di antara hasil dari kontekstualisasi fikih dapat dilihat melalui keberadaan wasiat wajibah dalam hukum Islam di Indonesia. Wasiat wajibah yang ada dalam KHI di Indonesia lahir sebagai respon terhadap fenomena anak angkat yang terjadi dalam masyarakat. Dalam masyarakat Indonesia, minimal dalam lingkungan masyarakat, pengangkatan anak cenderung dihargai dan sering terjadi. Praktek pengangkatan anak yang dilakuakn tersebut, tidak sama dengan apa yang dikenal dengan istilah tabanni yang telah umum dikenal. Bila tabanni berarti pengalihan nasab dari orang tua asal kepada orang tua angkat, pengangkatan anak yang terjadi dalam masyarakat kita hanya sebatas pemeliharaan, pemenuhan biaya hidup dan pendidikan, dan hubungan kasih sayang sebagaimana layaknya seorang anak dengan orang tua dan tidak sampai kepada pengalihan hubungan nasab dari orang tua asal kepada orang tua angkatnya. Praktek pengangkatan anak semacam ini, yang sangat berbeda dengan praktek tabanni, tentu saja tidak dapat dijangkau oleh lembaga hukum tabanni yang ada. Kepadanya perlu diberikan lembaga hukum khusus yang sesuai dengan nilai-nilai keadilan yang hidup di tengah komunitas msyarakat. Untuk merespon kenyataan sosial seperti ini, KHI mengakui lembaga pengangkatan anak. Kebolehan praktek pengangkatan anak dimuat dalam Pasal 71, huruf (h) KHI di Indonesia. Di samping memberikan pengakuan terhadap lembaga pengangkatan anak, KHI juga memberikan pengakuan akan adanya hubungan hukum antara keduanya. Pengakuan terhadap hubungan hukum tersebut dibuktikan oleh KHI dengan melahirkan konsep wasiat wajibah, sebagaimana termuat dalam Pasal 209 ayat (1) ayat (2).Kata Kunci : Wasiat Wajibah, Hukum Keluarga Islam

Abstract

Domestic violence is a serious concern of all parties, thus giving birth to Law Number 23 of 2004 concerning the elimination of domestic violence. According to Islam, domestic violence is different from other criminal acts, such as murder, injuring qisahah, theft by cutting off hands, adultery with caning or stoning. The basis for criminal sanctions for domestic violence is not explained in the text (al-Qur'an and Hadith), so the punishment is expressly absent. This study uses a qualitative method that aims to enrich the scientific treasures of Islamic law and input for parties related to legal matters. The research found that domestic violence criminal sanctions are ta'zir punishment determined by the ruler (government), because it is not explained in the al-Qur'an or Hadith, so that its existence is left to the ruler's decision. This punishment (Jarimah) ta'zir is different from other punishments such as murder, adultery, theft and others whose explanation is contained in Islamic law.

Abstract

The ability of zakat institutions to collect zakat funds is still far from the existing potential. The collection of national zakat funds reaches Rp. 11.5 trillion to Rp. 233 trillion from the existing potential, or the funds that have been obtained are 5% of the existing potential. This percentage is still very small, so the development of fundraising needs to be continuously developed and solutions need to be found for existing problems. There is no doubt that the zakat institution is the main driving force behind the collection and distribution of zakat funds, the management development of zakat institutions is important. The problems faced by the management of zakat institutions need to be broken down and solutions sought. This study aims to explore solutions to these problems. This study uses field studies by collecting data through interviews and field observations. The results of the study show that management has a vital role in collecting and distributing zakat funds. The application of maqashid sharia principles in management has a significant impact on the development of the Institution. Which is indicated by several benefits obtained by stakeholders, namely muzaki, mustahik and the environment

Abstract

Education is the main aspect that can have an impact on the survival of individuals. For this reason, the right time to start education is during childhood. Children are parents' investment in the hereafter. So that children's education will be the main concern, especially in the aspect of Islamic education. The Qur'an is the main source of reference, collected in it various explanations of the concept of education. This study aims to determine the concept of child education in the Qur'an surah Luqman verses 12-15 through tarbawi tafsir analysis by presenting lughowi analysis according to the opinions of the mufassirs. The research method used is library research with a descriptive qualitative approach. The results of data analysis found that: (1) Education given to children is tawhid education, namely introducing the oneness of Allah SWT, worship education as an embodiment of tawhid education and moral education, one of which is doing good to both parents. (2) Child education is carried out with good communication and language full of affection, like Luqman who calls his son "yabunayya"
